This academic paper proposes the adoption of restorative practices as a way to humanize Criminal ... more This academic paper proposes the adoption of restorative practices as a way to humanize Criminal Justice, to suggest a different way of responding to crime and manage the way justice is carried out. For this purpose, we consider the assumptions and consequences of Criminal Justice in comparison, though not necessary contrast with those of restorative practices. Based on this discussion, it will be possible to establish a notion of restorative proposal. Briefly, it's possible to say that the goal is the active participation of those involved to reach a resolution against the harm caused by crime. The priority is the resolution of the conflict and not just inflicting an evil as compensation for the harm caused. In this context, it's important to give voice to the victims and to their specific needs, which, usually, does not occur in ordinary criminal process and, for the offender, seeks to avoid custodial sentence for this by negotiation with the victim, recognized the damage he caused and actively propose an act in order to repair the loss caused. Subsequently, there will be a discussion about some approaches related to restorative justice, as well as critical and necessary caveats to this model. Finally, an analysis will be conducted on the possible integration of restorative justice within the conventional criminal procedure, besides being presented an overview of the experiences related to restorative justice has held in Brazil and the main barriers to their implementation.
