This paper deals with social damage as an instrument for the sustainability of the consumer socie... more This paper deals with social damage as an instrument for the sustainability of the consumer society by separating the criteria of moral damages in compensatory, punitive and pedagogical damages. With the purpose of rebalancing the difficult dilemma of illicit enrichment versus non – exemplary indemnity, so that each has its own recipient, separately: society or the injured individual. Through a report of results composed on the basis of logic-inductive, the research is divided into three parts, besides the introduction: in the first, the punitive aspect of moral damage and the “new damages” are framed; in the second, it seeks to delimit a new perspective for social damage; and finally, in the third part, the social damage is included as an instrument for the sustainability of the consumer society. It closes with the final considerations that contemplate the difficulties found for the practice of collective thinking in the judicial tools already available.
