The development of renewable energy to gradually replace energy produced from fossil fuels is a s... more The development of renewable energy to gradually replace energy produced from fossil fuels is a significant component of the objectives that states must pursue to protect the environment and individual health. However, the cost of energy production remains a critical issue. If it is determined that providing a good or service in the market is too expensive, market operators may take actions to minimize costs, often at the expense of environmental protection efforts. European regulations on state aid are particularly significant for the energy sector and environmental protection. This study aims to analyze the relationship between green energy and the right to a healthy environment, as well as to examine the limitations of the state's discretionary power in supporting the green energy sector through the use of public resources.

The present study was prompted by a recent decision of the European Court of Human Rights issued ... more The present study was prompted by a recent decision of the European Court of Human Rights issued under Article 39 of the Court’s Rules concerning a request for interim measures filed by a Romanian citizen. This decision serves as an opportunity to reflect not only on the Court's perspective regarding the urgency of adopting measures to prevent the risk of subjecting an individual to ill-treatment but also on the institution of the European Arrest Warrant, particularly the possibility of suspending its immediate effects under the protection provided by Article 3 of the European Convention on Human Rights and Article 4 of the Charter of Fundamental Rights of the European Union.

Modern economies rely heavily on private undertakings to decide what goods to produce and trade, ... more Modern economies rely heavily on private undertakings to decide what goods to produce and trade, what kind of projects to invest in, and where all these activities should take place. As a rule, competition between undertakings spurs investment and innovation, which theoretically benefits the population. Nevertheless, governments often interfere in markets through their regulatory power, pursuing goals that have nothing to do with economic efficiency. Thus, governments spend large amounts of money to implement policies that may target the provision of public services, important sectors of the economy or environmental protection. State aid is just one of many channels through which governments have an impact on the functioning of markets, but it is the most regulated channel under European Law.1 However, there is always a downside of these state aids. State aid, by default, will ultimately lead to a distortion of competition. Consequently, as a result of any measure, one undertaking will gain something, while another will be disadvantaged. This material will focus on the state aid granted for the production and consumption of green energy, analyzing in particular the topicality of the European Green Pact, the notion of state aid and the case law of the Court of Justice of the European Union ("CJEU").

La discrimination provient souvent de stéréotypes implicites ou de généralisations sur les caractéristiques que l'on attribue aux membres d'un groupe particulier, uniquement en raison de leur appartenance à ce groupe. Cette compréhension de la discrimination fondée sur les stéréotypes met en lumière l'importance d'une protection constitutionnelle spéciale des droits à l'égalité.
