However, the cost of energy production remains a critical issue. If it is determined that providing a good or service in the market is too expensive, market operators may take actions to minimize costs, often at the expense of environmental protection efforts. European regulations on state aid are particularly significant for the energy sector and environmental protection. This study aims to analyze the relationship between green energy and the right to a healthy environment, as well as to examine the limitations of the state's discretionary power in supporting the green energy sector through the use of public resources.
