For any foreign investor, protection of their investment is a primary concern in host states. Nat... more For any foreign investor, protection of their investment is a primary concern in host states. National legislations and BITs usually provide legal security to them so that they can exercise their desired economic freedom in host countries. Without legal safeguards for their investments, they will not be motivated to invest their capital further. Like other host states, generally, the national laws and BITs of Bangladesh provide significant investment protection guarantees. This paper will discuss how far the protection through judicial or arbitral settlement is established in the legal framework and BITs of Bangladesh. Dispute settlement mechanisms in Bangladesh, various ICSID cases involving Bangladesh, and conflicts between Bangladesh and foreign investors are discussed. The paper also covers the issues and challenges of judicial arrangements in Bangladesh, and findings show that dispute settlement arrangements in Bangladesh are not up to international standards and require significant development. Last, recommendations are provided for consideration.

‘A journey to catch the Uncatchable CREATOR’ --- is a journey that based on spiritual believes i.e. looking beyond the scenes, thinking beyond the imaginations and has an ultimate intention that is to discover “the Almighty CREATOR”, to know “the Unknown CREATOR, to catch “the Uncatchable CREATOR”. This journey has intended for all people in this world, regardless of their religions. Our human life is very short in this temporary world, so before it is too late, I have decided to start the most difficult but easiest journey in my life to catch “the Uncatchable CREATOR”. I believe that if my intention is one hundred percent pure, I will be successful one-day (Insha’Allah), even if it may take many years to come. I will strongly suggest you to take some time off from your busy life and sit down and just try to think very deeply about yourself, the creatures and everything that exist between the land and sky. Try your hardest to begin your journey and I am sure that you will also start to see the light of Right Path like me, yes, you will (inshaallah). It is very difficult to start anything but once you are capable to start, it becomes easy to continue, so try your hardest to start the journey. There are many layers existing above the ground and it entirely depends on you – how far you would like to see, how much determination you have to see beyond the limitation. A person is quite happy to see the cloud only; another person wants to see up to the universe but third person wants to see beyond the universe – who is the best amongst them? You must direct your journey beyond the limitation to catch “the Uncatchable CREATOR” successfully; otherwise, you will only see the reflection but not be able to catch the CREATOR.
It is highly believed that Fakir Lalon Shah was a spiritual person, who had introduced folk songs in Bangladesh. I have quoted many songs of Lalon Fakir in this journey and each of them has a very thoughtful meaning, so while reading you have to think very deeply to understand them properly. I am very grateful to Mr Tanvir Mokammel for his own directed movie ‘Lalon’, which has helped me a lot to understand Lalon Fakir’s spiritual thoughts, and have used his English translation of the songs in this work.
I am also very grateful to Maulana Mufti Muhammad Shafi, as well as to professor Muhammad Hasan Askari and professor Muhammad Shamim who has translated ‘Ma’ariful - Qur’an’. I have used the commentary from ‘Ma’ariful - Qur’an’ in this journey for your better understanding of the Holy Qur’an. Should you have any question or confusion of any kind, please speak to a wise scholar without further delay.

Thereafter, few finding and recommendations are suggested so as to follow by the authority to determine the employment status of the temporary agency worker in the typical “triangular” relationship in Bangladesh.
