Delighted again with 4 new error-ridden circulars in #GST. 224 - appeal memo itself is challan to pre-deposit disputed demand. If limitation to file appeal to Tribunal stands deferred, how then can this pre-condition be denied the same courtesy? And another new form DRC3A that everyone suffering an adverse order must 'apply online' immediately (to stave off premature recovery) and (compelled to accord) 'discharge' to disputed demand, is imminently capable of large-scale mess. Remember taxpayers have shown stellar incompetence when it comes to using (even simple) online functionalities. This is also by far the funniest, in that it directs taxpayers to apply online but is not operational yet. What should taxpayers do? And if nothing now, why this circular even? Perhaps this cookie needs reconsideration because no taxpayer can be offered a procedure too intelligent to comply, only to forfeit refund due to limitation that runs on failure to comply. Forget 3A and the mess it's going to create with everyone getting it wrong in every which way imaginable, this circular bears such a gargantuan illegality that nothing in it can be salvaged, not even by making amends, that it deserves nothing short of a quiet burial by withdrawing it gracefully. All it takes is for one distraught taxpayer to go to Court with the very first question - when limitation to appeal stands deferred, how can a pre-condition to such appeal be enforceable already - to seek their Lordships to weigh in on such atrocious use of rule 142(2B). Also, what statutory authority vests with PO to entertain manual undertaking and hold off statutory duty to recover disputed demands that have passed limitation (to appeal) and become undisputable arrears? And such a terrible precedent too. If disputed demands are to be adjusted with pre-deposit, will interest apply on gross demand (on rejection of appeal) or only on demand net of pre-deposit? Will interest be payable on pre-deposit (if appeal is allowed)? Is this circular attempting to legislate? While others are still to join and list the mindless illegality that is rife in this circular, it begs to submit that giving quietus is the only way forward to this cookie that's all set to crumble. 225 - less said the better. 226 - circular expanding statutory limitation to claim refund of additional consideration received on past exports. Case of circular altering limitation under 54 when ToS remains date of original export. If altering ToS were (somehow) lawfully permissible, then it will not only deride interest recovered on belatedly discharged dues but will also engender mischievous use of DN by sectors that suffer from extended credit terms. 227 - refund to be claimed manually since online functionality is not available even though right to refund accrued long ago and claim is beyond limitation. There's only so much that a circular ought to do because a delegate cannot, in exercising power delegated, alter or expand that very power!

It appears that appointments for in-country applications are starting to appear on the TLS contact website. A significant issue escalated for applicants following the switch of commercial partner for the UKVI from Sopra Steria to TLS Contact due to the unavailability of appointments to enrol their biometrics. While the problem isn't entirely resolved, there is a positive development with availability starting to show up at some major centres in the UK. New appointments were typically released between 8:30 am to 9:00 am (Mon-Fri) allowing applicants or their representatives to book appointments. However, new appointments are becoming available as early as 7:30 am, potentially adding pressure on representatives to book appointments outside their regular working hours. This situation highlights the urgency for the problem to be addressed promptly. #immigration #businessimmigration

Making the Business Case for Mediation I see that Acas recently hosted an online event looking at the challenges of low productivity across the British economic landscape. Economist and journalist, Will Hutton talked about how business should invest in skilled managers to address them. He said: "We should start to talk about 'constitutionalising mediation' so that it's understood by all parties, employers and employees. This means that you never allow disputes to collapse into conflictual situations, such as strikes or the withdrawal of labour." The video also features Prof Richard Saundry and Dr Gemma Wibberley on the lessons learned from how an acute Healthcare Trust changed its culture, based on early informal dispute resolution with skilled managers. Not as much fun as the MII TED Talk Club and twice as long, but essential viewing if you have a couple of hours to spare and are serious about embedding mediation as the key early dispute resolution process. https://lnkd.in/dwuDA8_r

Last week Marsden’s Karen Glass chaired a fully-subscribed event with General Counsel and Chief Legal Officers to discuss the relationship between Boards and General Counsel, offering advice for transitioning wishing to transition into NED roles. Organised by Winmark and hosted by Cooley LLP in London, the panel featured Erica Handling, Andrew Ballheimer, and Dame Janet Gaymer, who shared insights from their successful journeys into NED portfolios. Despite perceptions that lawyers aren’t natural choices for Boards, these leaders demonstrated the unique value lawyers can bring. The row over litigation funding... Class Actions and the Debate Over Litigation Funders: The largest class action in British legal history is set to begin this month, drawing attention to the litigation funding industry, according to The Times. The £36bn claim is being brought against UK-listed mining giant BHP over the 2015 Fundão dam collapse in Brazil, which caused significant loss of life and environmental damage. Litigation boutique Pogust Goodhead is representing more than 700,000 individuals, 1,600 businesses, several municipalities, and utility companies, while Slaughter and May is defending BHP. Litigation funding involves a third party, often a private equity firm, financing all or part of a lawsuit in exchange for a fee from the proceeds of a successful claim. The industry is valued at £2bn in the UK. Supporters argue that it promotes access to justice, but critics claim that it encourages frivolous claims and that too much of the compensation goes to lawyers and funders. For example, in the VW ‘dieselgate’ litigation, Pogust Goodhead’s £343 million costs claim was reduced by 75% by the High Court, which called the figure “absurd” and suggested it was inflated by "over-lawyering." Despite these criticisms, litigation funding remains profitable. Pogust secured a £450 million funding deal with US investment firm Gramercy last year and introduced a “synthetic equity programme” where some City associates could earn up to £2 million over three years, based on profits. Linklaters Launches GenAI Training for Lawyers: Linklaters has partnered with King’s College London to launch a training programme for its lawyers on generative AI, Legal IT Insider reports. This follows Linklaters’ global rollout of Microsoft 365’s Copilot earlier this summer. The programme aims to give lawyers a deep understanding of generative AI and prompt engineering, with a focus on how these technologies can be applied to legal practice. The training was developed by Linklaters’ GenAI Programme Team in collaboration with The Dickson Poon School of Law at KCL. Ex-DWF Partner Struck Off for Sending Sexual Photos to Minor: David Walton, a former partner at DWF, has been struck off after being caught in a sting operation by a paedophile hunter group. Walton admitted to trying to communicate with a minor for sexual gratification between 11 and 25 October 2019, which involved sending sexually explicit photos and inappropriate messages. At the time, Walton was a partner at DWF in Manchester, leaving the firm in December 2019. The Solicitors Disciplinary Tribunal (SDT) struck him off last month, noting that the offence involved a decoy rather than a real child, meaning there was no direct victim. CC: Non-Billable

What will a new Labour government mean for AI in the UK? Fortunately that issue was addressed at last night's talk by Bates Wells. The topic was 'Balancing responsibility and innovation - How can we develop and implement ethical AI?'. The stellar panel of Tim Clement-Jones, Dee Masters and Neil Ross was expertly steered by my former colleague Eleonor Duhs. Key takeways were: 1) Labour will put the current voluntary AI code onto a statutory setting 2) They have committed to create a Regulatory Innovation Office which will have the mandate to co-ordinate across regulators to remove duplication 3) Expect an AI Bill to be part of the Kings Speech but it's unlikely to be debated until the second year of Parliament 4) There's been a huge turnover of the old guard and a new intake of young, digital savvy MPs.
