    One of the Railways has sought clarification with regard to


    minimum Bank guarantee amount and its validity. In this connection,
    it is clarified that in term of clause 8.1 of model agreement, the minimum
    guaranteed amount is payable in three installments, Le. in 6 months, 42
    months and 66 months. Railway may take 1stand 2ndBank Guarantee
    bonds for the corresponding amount with validity of 6 months beyond
    the stipulated date and release the same on receipt of payments. The
    bank guarantee equal to the amount of third installment shall, however,

    have validity of one year beyond the penod of expiry of the agreeme!1t
    in order to secure due performance and observance of the terms,
    conditions and obligations on the part of J'v.Partner.

    Board have issued modal agreement for plantation on railway land


    vide letter referred to above. While Railways have started the process by
    inviting and finalizing the tender, Southern Railway have raised a doubt
    with regard to competent authority for approving such cases. The matter
    has therefore, been examined and it has been clarified that the activity of
    'commercial plantation' may also be treated as 'works contract' and
    Railways shall take action as per the powers applicable for 'works
    contract'. The minimum level of Tender Committee would however, be
    JAG and the higher level can be determined by Railways as per extant
    delegation on Zonal Railways. Hence, Railways can select the site for
    commercial plantation and deal it further as 'works contract'.
    This issues with concurrence of Finance Directorate of Ministry of
    Railways.

    Kindly refer to Board's letter under reference on the subject. A copy or


    Model Agreement and Bank Guarantee form duly vetted by Ministry of Law, Justice
    and Company Affairs and approved by the Board, was sent to Railways for
    necessary action. Considerable time has passed since issue of model agreement,
    Railways must have drawn action plan for taking up the scheme on larger scale.
    Feedback in this regard may be advised on the enclosed format.
    In the meanwhile, your attention is drawn to Board (CRB)'s d.o. letter No.
    02/Fuel/282/14 dl. 18.1.q3, regarding plantation of "Jatropha Curcas" for production
    of Bio-Diesel. Board desire that Zonal Railways should take up at least one project
    of plantation of "Jatropha Curcas" under commercial plantation scheme.

    Action taken may be advised to Board.

    Please refer to letter under reference on the subject. Zonal Railwayswere


    advised to start exercise to fmd out potential entrepreneurs who can be involved
    for plantation on commercial lines.
    Modal Agreement for plantation on railway land through private parties
    and Bank Guarantee form has been got vetted trom the Ministryof Law, Justice.
    and Company affairsand approved by Board. A copy of each of them is enclosed
    for necessary action. This has been vetted by Finance.
    Additional special conditions to suit the local conditions and requirements
    may be added,if necessary,.in consultation with Associate Finance and Legal Cell.
    An action plan [or plantation on commercial lines may be sent by your
    Railway.
