ON MAY 7~ 2010 AT APPROXIMATELY 8:01 A.M. I DEPUTY DANCZYK WAS EAST ON HILLSIDE AT THE RAILROAD TRACKS WHEN I OBSERVED THE METRA TRAIN

WAS STOPPED JUST PAST THE CROSSING GATE. UPON FURTHER INSPECTION I OBSERVED A BODY ON THE TRACKS BEHIND THE TRAIN. I SPOKE WITH A TRAIN CONDUCTOR WHO INFORMED ME IT APPEARED TO BE A SUICIDE. I NOTIFIED THE MCHENRY COUNTY DISPATCH CENTER OF THIS INCIDENT AND I CONTACTED LT.

I SPOKE WITH BONNIE SPEECHLEY VIA THE TELEPHONE WHO INFORMED ME OF THE FOLLOWING. SHE STATED THAT SHE WAS STOPPED AT THE TRACKS AND THE

GATE WAS DOWN AND FUNCTIONING PROPERLY. SHE STATED THAT SHE OBSERVED THE TRAIN SLOWING DOWN AND THE HORN WAS ACTIVATED. SHE THEN OBSERVED THE TRAIN STOP JUST SOUTH AFTER THE HILLSIDE GATE. SHE STATED THAT SHE OBSERVED SOMETHING BEHIND THE TRAIN BUT WAS NOT SURE AS TO WHAT

IT WAS, THE GATE WENT UP AND SHE PROCEEDED EAST ON HILLSIDE ROAD. SHE DID STATE THAT SHE DID NOT OBSERVE ANYONE IN THE AREA OF THE TRACKS.

THE SCENE WAS TURNED OVER TO THE MCHENRY COUNTY SHERlFF'S POLICE INVESTIGATIONS DIVISION AND THE MCHENRY COUNTY CORONER'S OFFICE.

ON 05/07/10, AT 0833 HOlJRS, I, DEPUTY THOMAS, ARRNED ON SCENE AT HILLSIDE ROAD AND THE RAILROAD TRACKS EAST OF FOX TRAIL, CRYSTAL LAKE, REFERENCE A DEATH INVESTIGATION.

WHILE ON SCENE I ASSISTED SGT. GROVES, AND CONSERVATION PERSONNEL, RECORD THE INFORMATION FROM THE TWENTY FOlJR PASSENGERS, TWO METRA EMPLOYEES, AND ONE UNION PACIFIC RAILROAD EMPLOYEE WHO HAD OCCUPIED THE TRAIN AT THE TIME OF THE INCIDENT. ALL NAMES WERE ATTACHED AS RELATED PERSONS.

MYSELF, DEPUTY MATUSEK, AND SGT. GROVES THEN USED TWO 300' CLOTH TAPE MEASURES AND ONE 30' STEEL TAPE MEASURE TO DIAGRAM THE CRlME SCENE. I THEN DREW A SCALE DIAGRAM OF THE SCENE USING "THE CRASH ZONEtt VERSION 8.3 SOFTWARE AND SUBMITTED THE DIAGRAM AND POINTS LIST SEP ARA TEL Y FROM THIS SUPPLEMENT.

IT SHOULD BE NOTED OFFICER R. PUTYRSKI #912 OF METRA POLICE WAS ON SCENE AND DOCUMENTED THE INCIDENT AS REPORT NUMBER 10-007101.

assigned to respond to the

scene of a fatal train versus pedestrian accident which occurred at the Metra Railroad tracks located at 5300 E. Hillside Road, Crystal Lake. Upon arrival, I met with Sgt. Popovits who assigned me to interview the Engineerr Breakman and Conductor who were on duty at the time of the occurrence.

I met with the trains Engineer, Timothy W. Dwyer M/W DOB

After identifying myself, I requested an interview with Dwyer. I chose a passenger train compartment that was empty. The following is a summary and not verbatim of the interview. Dwyer related he was the Engineer of the train heading towards Chicago after leaving the Harvard area. Dwyer stated that as he was approaching the Hillside Road intersection he began slowing the train from 55 mph to 50 mph. Approximately 2500 feet from the intersection Dwyer related he began blowing the trains whistle. Dwyer related there is a sign at that location designating him to sound the trains whistle, he stated the order in which the whistle is to be sounded is two long burst followed by one short followed by one long.

Dwyer stated that as he approached the Hillside intersection approximately 200 to 500 feet from Hillside Road, he noticed a male

white subject walking towards the train tracks from the Westside of the road. While still sounding the trains whistle, Dwyer related the male subj ect walked and stood in between the center of the tracks. Dwyer then stated the subject faced the train and looked directly at him. Dwyer stated the male subject was wearing dark clothing with a dark colored baseball cap and appeared to be in his mid fifties.

Dwyer related he immediately placed the train in emergency breaking mode explaining, once this is done all the air is taken out of the wheels reducing the time the train usually takes to stop. Despite his at tempts, Dwyer related the pedestrian was struck. Once the train had stopped Dwyer related he contacted his officials and notified his co workers.

I spoke with Richard Elli M/W DOB who was serving as the Conductor at the time of the incident. Elli stated that as Conductor he is in charge of the train and the entire staff. Elli stated he was in the middle car along with six passengers. Elli related there were twenty three passengers in all at the time of the incident. Elli stated he heard the whistle sound and shortly after felt the train enter emergency stop mode. Elli stated that a person can hear and feel the air being bled out of the trains system once this act is initiated.

Elli stated once the trained stopped, he checked the welfare of the passengers and proceeded to exit the passenger compartment to seek help. Elli also related that he has worked for the train industry long enough to know, that when emergency breaking is initiated it usually means someone or something was struck. Elli stated that as he approached the intersection of the tracks and Hillside Road he noticed and obtained the attention of a McHenry County Sheriff's Deputy who was passing by.

Donald A. Liedke M/W DOB was working as the Breakman on the train. Liedke related he was in the back passenger compartment when he heard the train's horn and proceeded to feel the emergency

stop implemented. Liedke had nothing further to say regarding the incident.

Once concluded with the interviews, I spoke with Deputy Coroner Kim Bostic who discovered a note in the victim, Phillip Pagano/s wallet. In summary I the note related whoever discovers the wallet to please contact his wifel Barbara and proceeded to give a cellular phone number to reach Mrs. Pagano. The note was taken as evidence and subsequently placed into evidence as item # 1.

It should be noted, Sgt. Popovits contacted the victim's wife, Barbara Pagano F/W DOB via telephone at 1045 hrs. Mrs. Pagano, who was in St. Louis at the time of her husband's death, was briefed on our investigation. Sgt. Popovits requested and obtained verbal consent to search the unlocked vehicle owned by her husband, Phillip. The vehicle being a 2009 Volkswagen bearing IL Registration and VIN # was parked in a conservation area approximately 300 feet from where Pagano's body was discovered. A search of the vehicle revealed a Metra train schedule from Harvard to Chicagoi the schedule was taken as evidence (item # 15).

At 1120 hrs Sgt. Popovits spoke with Mrs. Pagano regarding a search of her residence. Mrs. Pagano consented to a search and at 1135 hrs Sgt. Popovits, Det. McDonald, Det. Jonites and I arrived at the residence located at ,New Hamphshire Trail, Crystal Lake. We gained entry using a garage remote. Once inside, we discovered numerous notes on the Pagano kitchen countertop addressed to Barbara. At this time, Sgt. Popovi ts photographed the residence along with close ups of all materials left behind by the victim. Further search of the residence revealed numerous documents in the upper level office. All the documents were instructions for Barbara on what to do and who to contact upon hearing of his death. All the aforementioned items were taken as evidence, packaged and placed in a secure evidence locker. At the completion of the search the residence was released to family members.

On 05/14/10, Sgt. Popovits and I met with Daniel LaFave, General Attorney for Union Pacific Railroad and Delizia Jemison, Claim Representative for Union Pacific RailRoad. The meeting took place at Union Pacific Railroad Office located at 101 N. Wacker Dr. ln Chicago. We were advised that every Metra train has a video camera afixed on its passenger cars for incidents like the one involving Pagano. We were then shown the video footage which depicted the followingj at 0747 hrs and 1 second on 05/07/10, a white subject wearing dark clothing and baseball cap is seen waiting near a railroad junction shed off of Hillside Road and the train tracks in Crystal Lake. The junction shed is west of the train tracks and north of Hillside Road. Between 0747 hrs and 1 second through 0747 hrs and 16 seconds the male subj ect is seen walking towards the tracks as the train is approa~hing. The male subject is then seen stepping onto the tracks and standing in between the railroad tracks. Shortly after the subj ect is out of, the view, a small shake is seen on the camera. It is believed the shake is at impact.

On 05/17/10, sgt. Popovits and I met with Jennifer Pagano-Heiser at the McHenry County Sheriff's Criminal Investigation Division. Pagano-Heiser is daughter to the victim, Phillip Pagano. At this time, all evidence collected in this investigation and retrieved from the household was returned to Pagano-Heiser family.

At this time this case will be closed, no further police action taken at this time # 15.

On 05! 07 /10 I was assigned to assist with a death investigation that occurred in the 5300 block of East Hillside Road in Crystal Lake. I was assigned to interview the wife of the victim, Barbara Pagano, at her residence located at 6805 New Hampshire Trail in Crystal Lake, IL.

I met with Sergeant Popovits of the McHenry County Sheriff's Department at the Pagano residence located in Crystal Lake, IL. Sgt. Popov i.t s and I met with Barbara Pagano, Jennifer PaganoHeiser, along with other family members. Sgt. Popovi ts asked Barbara when the last time she had spoken with her husband, Phillip Pagano. Barbara stated that she spoke with Phillip via telephone on 05/06/10 at approximately 2130 hours. Barbara stated that they had talked about the board meeting to determine Phillip's job status. Barbara stated that Phillip was not sure of what they were going to determine, but stated that Phillip was afraid of going to jail. Barbara stated that they had talked about the board firing Phillip before he had the chance to resign. Barbara stated that Phillip was publicly humiliated by the information that was reported approximately two weeks ago. Barbara stated that they did talk about seeing their grandchildren. Barbara stated that she had received the telephone call from Phillip while she was on her way

down south to pick up the grandchildren. was talking via the house phone.

Barbara stated Phillip

Sgt. Popovits asked Barbara if she had noticed any changes in

Phillips demeanor.

Barbara stated that Phillip started to become

depressed when criminal allegations through his work on Tuesday of last week (April 27, 2010). Barbara stated that an editor from a newspaper wrote an article accusing Phillip about receiving unauthorized bonus money. Barbara stated that Phillip had found about the allegations through the newspaper and was caught off guard. Barbara stated that the. press made several attempts to contact Phillip at his residence and added to the humility (Barbara stated that the press left contact information on their door and left several voicemail messages for him to contact them).

Sgt. Popovi ts asked Jennifer Pagano-Heiser the last time she had made contact with her father, Phillip Pagano. Jennifer stated that she had last spoken to her father via telephone on 05/06/10 at

approximately 1900 hours.

Jennifer advised that they spoke about

the issue he was having with work briefly.

Jennifer stated that

near the end of their conversation her father told her to take care of her mother.

Prior to our arrival to the residence, I made contact with Detective Maldonado of the McHenry County Sheriff's Department. Det. Maldonado advised that a search of the residence was conducted with the permission of Barbara Pagano. Det. Maldonado advised that several documents created by Phillip Pagano were recovered and entered into evidence. A couple of documents had instructions regarding financial information (how to pay the bills) and some

telephone numbers. Barbara Pagano.

A copy of the documents were made and given to See Det. Maldonado's report for information

regarding the search of the residence.

I, Det. McDonald, assist with a

death investigation that occurred at the 5300 block of Hillside Rd., Crystal Lake, IL. While en-route to the scene, I was notified that the investigation involved a pedestrian that was struck by a train.

Upon arriving at the scene I was instructed by Lt. Miller to interview a male that had spoken to our victim (Philip Pagano) I prior to the incident. Lt. Miller stated that the male was currently located at Stearne's Woods, talking to Sgt. Ellis.

I met with Sgt. Ellis, who informed me that the male, later identified as Albert M. Jourdan, was sitting in a car behind Sgt. Ellis, and that he had spoken to Pagano just prior to the incident. I approached the vehicle and greeted Mr. Jourdan. I asked Jourdan if he would be willing to speak with me and he stated he would. I suggested to Jourdan that we speak at Crystal Lake Police Department (CLPD) due to several media outlets beginning to arrive at our location for staging. Jourdan agreed and we met at CLPD.

Present during the interview were Jourdan, R. Mark Gummerson, Det. Jonites, and I. We met in a small conference room located off

of the lobby of CLPD.

I asked Jourdan about his relationship with

Pagano and he stated that they had been friends for approximately twenty five years. Jourdan stated that Pagano had called him on 5/6/10 and was upset about the pending investigation involving him

with Metra.

Pagano began telling Jourdan that he was headed for

the last train and gave Jourdan instructions on where his car would be left and what to do with the keys.

Due to the nature of the call, Jourdan stated he went to meet with Pagano and talk with him. Jourdan stated that they met at Pagano's house and spent the next few hours discussing the investigation and the future. Jourdan stated that Pagano was worried about the future of his family and was concerned about them receiving his benefits from Metra. Jourdan believed that Pagano had calmed down and was stable after they spoke. Jurdan left the residence at about 0215hrs on 5/7/10.

At approximately 0745hrs on 5/7/10, Jourdan received a call from pagano. Pagano began instructing Jourdan on where his car was and that the keys were in the glove box. He told Jourdan, " I can't take this anymore". Pagano told Jourdan " You're the best friend I got". As Pagano was speaking, Jourdan stated he heard a train in the background. At that moment, Pagano hung up the phone. Jourdan stated he then called the police.

I asked Jourdan if he knew anything about the investigation that Metra had launched. Jourdan stated that to the best of his knowledge it had to do with Pagano cashing in benefit time. Jourdan stated that Pagano informed him it was nothing that wasn't past practice. Jourdan stated he had no furthe~ knowledge of the investigation and did not know of anything else that would cause Pagano to be concerned.

At the conclusion of the interview, I responded to the Pagano residence at New Hampshire Tr I Crystal Lake, to assist with evidence collection. Several items were collected and turned into evidence by Det. Maldonado, Sgt. Popovits, and Det. Jonites.

On 05/08/10 at 0830hrs I met with Dr. Mark Witeck, Dep.

Coroner Kim Bostic, and Dep. William Dooley at the McHenry County Coroner's facility. Dr. Witeck conducted the autopsy procedure with Dep. Coroner Bostic assisting. The autopsy was photographed by Dep. William Dooley.

I fingerprinted Phillip A. Pagano and placed the fingerprint card with his latent fingerprints attached into a white evidence envelope and sealed it. I later turned the sealed white evidence envelope containing the fingerprint card over to Det. Maldonado.

Upon completing the autopsy Dr. Witeck in summary stated that his complete report will be forthcoming.
