May I please the Court? Your Honor. Council.

Ladies and
Gentlemen of the jury.
An instant. Anythingcan happen in an instant.
I am Kelly Ramsey and myself, along with my co-council
Richelle Johnson, are representing Mr. Charles Shrackle and
his company.
We have all experienced things that happen in an instant.
Some things are somewhat trivialMisdialing someone
locking your keys in your car
And then there are things, that are not at all trivial.
Unfortunately, when we talk about what can happen, in an
instant, tragic and horrible things can happen. Not by
design. Not by intentions, but justin an instant.

And in spite of our best efforts, to make the best decisions


and avoid misfortunes, by things that can happen in an
instant that is not always how it turns out.
We are all her today, because of a tragic event. Because my
client, hit Mrs. Katherine Potter, who did in fact die from her
injuries. And we all know, that accidents are one of those

things, that happenin an instant. The plaintiffs would like


you to believe that my client, Charles Shrackle, was solely
responsible for hitting Ms. Potter. Ladies and gentlemen, you
will find, through the testimony you will hear today, that it
was in fact, Ms. Potters decision, to cross the street, outside
of a cross walk, on a busy intersection. A decision that she
made. in an instant.
It is unfortunate, that her decision, to walk out into the
street, in that instant, has us here today. And has my client,
Charles Shrackle, having to defend himself.
This accident took place near the intersection at Mattis
and Kirby. For those of you familiar with the intersection that
the accident happened near, you know that it is a busy
intersection.
The plaintiffs are going to try to convince you that my
client was in a hurry on his way to a meeting on the day of
the accident. And it was because of that, that he hit Mrs.
Potter. I can tell you that he was in fact on his way to a
meeting that day. But as we all know, most every time we
are in a car, we are all on our way to get somewhereto get
to somewhere on time. Charles Shackle is a well-known
contractor in town. On that particular day, November 30 th,
Charles was on his way to a meeting with a general
contractor he is working on a job for. The plaintiff told you

that he will have evidence that Mr. Shrackle was in a hurry to


get to this meeting so as not to be late and that he was in
such a hurry that he didnt even see Mrs. Potter and hit her
with his truck. But Mr. Shrackle will tell you, in his testimony,
that he was extra cautious while he was driving through the
intersection, as there were children nearby.
The plaintiff is going to have witnesses testify, and have
evidence you are going to see and hear form that Mrs. Potter
was in the crosswalk when she was crossing the road, and at
that particular moment in time, she may have been, But as
you will hear from another witness, Ms Mallory, she did at
first notice Mrs. Potter in the crosswalk as she started to
cross Mattis Ave, but then saw her walk south, down the
median that divides Mattis Ave, away from the cross walk.
I know that Mr. Potter is grieving the loss of his wife. And it
was a terrible tragedy. But he evidence and testimony that
you are going to hear today, will clearly prove to you, that
Ms. Potter was in fact, not in the crosswalk as she crossed
the second half of Mattis Avenue. Not in the cross walk when
she was struck by Charles Shrackle. And because of that, we
ask that you find that Mr. Shrackle is not the liable for Mrs.
Potters death.
