PETITION FOR ADOPTION


WITH APPLICATION FOR CHANGE OF
NAME
Petitioner, through undersigned counsel, respectfully
states:
1.
Petitioner is of legal age, a Spanish citizen,
single, and presently residing at 77 A Edades Street, San
Lorenzo Village, Makati City, where he may be served with
legal processes. A copy of Petitioners birth certificate is
attached herewith as Annex A while a copy of
Petitioners Spanish Passport is attached herewith as
Annex B. Petitioner has been residing in the Philippines
for at least three (3) years, or since September 2010.

Petitioner is in possession of full civil capacity
and legal rights. A Certification issued by the Consulate
of Spain concerning his capacity or suitability to adopt is
attached herewith as Annex C.
3.
Petitioner has not been convicted of any crime
involving moral turpitude.
A copy of Petitioners NBI
Clearance is attached herewith as Annex D while a
copy of the certificate/clearance issued by the
Department of Justice of Spain where Petitioner previously

resided with the corresponding translation in English,


attesting to the fact that there are no criminal records
against the Petitioner, are attached herewith as Annexes
E and E-1, which are made integral parts hereof.

Moreover, Petitioner is of good moral character
as proven by copies of character reference letters which
are
attached
herewith
as
Annexes
___________________________________________.

Petitioner is physically, emotionally and
psychologically capable of caring for children and the
Adoptee herein, as shown from the medical certificate
and psychological report issued in respect of the
Petitioner, copies of which are attached herewith as
Annexes G and H.

Moreover, Petitioner is at least sixteen (16)
years older than the minor adoptee, and is in a position to
support and care for children and the Adoptee herein in
keeping with the means of the family.
Petitioner is
currently working as the Administrator of Instituto
Cervantes in Manila with a gross annual compensation of
54,847.69 Euros under a Working Contract effective
September 6, 2010, a copy of which is attached herewith
as Annex I.

Petitioner has undergone pre-adoption services
as required by Section 4 of Republic Act No. 8552, as
shown from a copy of the Certification of Attendance
issued by the DSWD, attached herewith as Annex J
which is made an integral part hereof.

Petitioner desires to adopt the abovereferenced minor whose first name and surname is
ISIDRO
CENICERO
(hereinafter
referred
to
as
Adoptee), eleven (11) years of age at present, as shown
from the childs Certificate of Live Birth, a copy of which is
attached herewith as Annex K and which is made an
integral part hereof.

The Adoptee is legally available to be adopted
as shown from the Certification of Child Legally Available
for Adoption, a copy of which is attached herewith as
Annex L and made integral parts hereof. Presently, the
Adoptee has no estate of any value or character.

The Adoptee was initially placed in the custody
of and has been residing with the Petitioner since May 20,
2011 through foster care by virtue of the Foster Family
Care License and Foster Placement Authority granted to
Petitioner copies of which are attached herewith as
Annexes M and M-1. Thereafter, Petitioner applied
with the DSWD to adopt the Adoptee and was issued a
Pre-Adoption Placement Authority a copy of which is
attached herewith as Annex N.

Based
on
the
DSWDs
findings
and
recommendations, the DSWD issued its Affidavit of
Consent to the petitioners adoption of herein Adoptee, a
copy of which is attached herewith as Annex O which is
made an integral part hereof.
11. The adoption of the subject minor Adoptee by
the Petitioner will redound to the childs welfare and
benefit, and hence, Petitioner prays that the same be
granted by this Honorable Court.
10. Petitioner further prays that the Adoptees
name, as indicated in his birth certificate, be changed to
ISIDRO PALOMO which is in keeping with legitimate
filiation.
PRAYER
WHEREFORE, Petitioner prays that this Honorable
Court, after notice and hearing, render a Decision:
1.

Granting the Petition for adoption and


ordering the issuance of a Decree for the
adoption of the Adoptee by the Petitioner;

2.

Granting the Adoptees change of name,


which shall be stated and registered as
ISIDRO PALOMO.

Petitioners further pray for such other reliefs as may


be deemed appropriate and equitable.

citizen, after having been sworn in accordance with law,
hereby depose and state that:
1. I am the Petitioner in the this Petition;
2. I hereby verify that I have read the foregoing
Petition and that all averments therein are true and
correct of my own knowledge and belief.
3. I have not commenced any other action or
proceeding involving the same issues in the Supreme
Court, the Court of Appeals or different divisions thereof,
or any other tribunal or agency and that should we learn
that a similar action or proceeding had been filed or is
pending in the Supreme Court, the Court of Appeals or
different divisions thereof, or any other tribunal or
agency, I undertake to inform the aforesaid courts and
other tribunal or agency within five (5) days from notice.
