Upon knowing their story I simply asked: Ok, if this is true, where is the original
invoicing of Sale? Even today Caterpillar still refuses to clarify how authorized

If you are wondering did I file legal action? Yes! but for 12 years Propmech has
not attended pre-trial hearing; not only do these corporations make a mockery
of law on contracts they also mock society.
You can do anything to help me; 15 years of my life’s opportunity is lost! But
you can help yourself: do not trust your money to Caterpillar, Monark or
Propmech!
With the foregoing reasons, I opted to bring this to the Jury of Public
Opinion, through the power of the Web, so justice will prevail. I will
bring to light this case with documentary evidence for the people and
buyers of Caterpillar products to show that Caterpillar does not

Robert Schwarz affidavit, narrating his dealings with Helen Tong, the Chief
Executive Officer of Propmech, which is self-explanatory…

That my first meeting with Helen Tong at Propmech occurred on March 23, 1995 and took place on
the 2nd floor of 509 Camba Street, San Nicolas, Binondo Manila;
That I was introduced in a meeting Ms. Tong and Mr. Nelson Ong by Richard Parker where I showed
around various photographs of the vessel and the boatyard where the boat in the beginning stages of
construction;
That Helen Tong informed me Propmech was a corporation whose business was exclusively selling
and servicing Caterpillar marine products as the authorized representative of Caterpillar in the
Philippines;
That I inquired with Helen Tong about Richard Parker’s status within the corporation and was
informed he had recently been promoted to corporate mechanical engineer after excelling in
Caterpillar’s service training program;
That I was contacted by Helen Tong through Richard Parker May `95 for permission to use my pearl
white Caterpillar 3208’s in a boat show and color chorography was excellent;
That when I called Propmech October 21st I listen to Helen Tong narrate how she had just paid the
PNP for recovering the Propmech service vehicle loaded full of expensive tools found unlocked and
abandoned outside a bar in Makati;
That from the sketches of information I received from Helen Tong about Richard Parker’s poor work
performance I could only suggest she have him tested for substance abuse;
That after patiently listening to Helen Tong’s story I demanded delivery which she had previously
assured was not a problem just to let her know when at which point she abruptly became unfriendly
claiming Richard Parker was no longer connected to Propmech and claimed money was due her;
The narration in the affidavit, quoted above, compliments and confirms the
substance of the documents shown here that Mr. Robert Schwarz is the
buyer of the said engine and not Richard Parker as Propmech alleged. This
affidavit narrated verifiable incidents and any reasonable and impartial
individual can discern its truth.

The above three letters, particularly from Caterpillar Vice-President Ramseyer, aside
from confirming that Propmech was the authorized dealer of Caterpillar, also
mentioned (and believed) Propmech’s allegation (misrepresentation?) that Richard
Parker was the buyer of the engine and refunded to him my money. He should have

conducted due deligence, if only to make sure and ensure Caterpillar’s image and
warranty.
Another distortion (that Caterpillar believed) is the claim of Propmech that they return
the money to Richard Parker. It was my money (as duly certified by the bank) and not
Parker’s. If there is such a refund, Propmech should have contacted me first and
verified if I authorized Parker to receive the refund…. But in the first place, I was not
asking for refund; I was asking for the delivery of my engine.
I cannot believe that Caterpillar (specifically Wesly Blumenshine, its Legal Officer, who
eventually sided with Helen Tong) would swallow “bait, hook and sinker” the allegation
of Propmech without going deeper into this controversy (even after I submitted the
documentary evidence of such fraud).
The so-called refund (which Blumenshine believed) was evidenced only by petty cash
vouchers (which can be interpreted in thousand ways) and that its value cannot even
stand the scrutiny of a grade school pupil.
Take note also that in paragraph 9 of the affidavit of Rober Schwarz (emphasis and
underlining supplied), states:
“That I inquired with Helen Tong about Richard Parker’s status within the corporation and was
informed he had recently been promoted to corporate mechanical engineer after excelling in
Caterpillar’s service training program;”
“That I was contacted by Helen Tong through Richard Parker May `95 for permission to use my
pearl white Caterpillar 3208’s in a boat show and color chorography was excellent;”
If I was not the owner of said engine, why should Propmech asked
permission to use it in a boat show?
I may not be the only one who experienced similar unfortunate incidents with how
Caterpillar treats its customers… and this story I hope will caution prospective
customers of Caterpillar… they can also narrate their stories in the section provided for
in this website….
