Public Corporations/Local Government Law

Terminologies:
1. Public Office
 A position of authority or service involving responsibility to the public, especially within
the government
2. Administrative Agency
 An official governmental body empowered with the authority to direct and supervise the
implementation of particular legislative acts. May be called commissions, corporations,
boards, departments, or divisions.
3. Government Agency
 An official government body empowered with the authority to direct and supervise the
implementation of particular legislative acts. In addition to agency, such governmental
bodies may be called commissions, corporations, boards, department, or divisions
4. GOCC
 Refers to any agency organized as a stock or non-stock corporation, vested with functions
relating to public needs whether governmental or proprietary in nature, and owned by the
Government of the Republic of the Philippines directly or through its instrumentalities
either wholly or, where applicable as in the case of stock corporations, to the extent of at
least a majority of its outstanding capital stock
5. Government Instrumentality
 Any government run by a branch of the government that is immune from taxation
6. LGU/Political and Territorial Subdivision/Municipal Corporation Proper
 LGU-- A body politic and corporate endowed with powers to be exercised by it in
conformity with law; performs dual functions, governmental and proprietary
i. Governmental—concern the health, safety and advancement of the public good or
welfare as affecting the public generally
ii. Proprietary—seek to obtain special corporate benefits or earn pecuniary profit and
intended for private advantage and benefit
 Political Subdivision—local governments created by the states to help fulfill their
obligations
 Territorial subdivision—a geographic area belonging to or under the jurisdiction of a
governmental authority; and administrative subdivision of a country
 Municipal Corporation—legal term for a local governing body
7. Quasi-corporation
 An entity that exercises some of the functions of a corporation, but has not been granted
separate legal personality by statute
8. Quasi-public corporation
 Corporation in the private sector that is backed by a branch of government that has a
public mandate provide a given service. Most quasi-public corporation corporations began
as government agencies, but have since become separate entities
9. Quasi-municipal corporation
 A public entity created by law to deliver limited public services
