As you might be aware, Bureau of Indian Standards(BIS) is the National Standards Body set up under an
Act of the Parliament for harmonious development of the activities of standardization, marking and
quality certification of the goods in the country. The Bureau took over the assets, liabilities and functions
of the erstwhile Indian Standards Institution(ISI) with effect from 1 April 1987. The status of the
organization was enhanced by the Government with a view to provide more statutory power for enabling
the organization to carry out its functions effectively. The BIS operates Certification Marks Scheme under
which the licences are granted to the manufacturers for use of ISI mark on the products under specified
conditions. Thus, through this scheme, BIS makes available the benefit of third party certification to the
common consumers.
With the popularity of the ISI mark, the instances of misuse of the mark are on the increase. To check
such misuse, necessary prohibitory provisions have been made under Section 11,12,14 and 15 of the BIS
Act,1986. Also, penalties for the misuse have been prescribed under Section 33 of the Act. The employees
of the Bureau have been declared as public servants within the meaning of Section 21 of the Indian Penal
Code. Also, Inspecting Officers of the Bureau, to be appointed by the Competent Authority, have been
empowered to undertake search and seizure of any place, premises or vehicle where contravention of
Section 11 or 12 are believed to have taken place(Section 25 & 26).
During our recent market drives, it has been observed that a large number of manufacturers/dealers are
resorting to misuse of ISI mark and there is a need to check the same. Towards this objective, we seek
your help in the process of carrying out search and seizure operation on 18 July 2008 in accordance with
the provision under the BIS Act, for collection of direct evidence to facilitate prosecution of the offenders.
It is requested that you may consider advising Brahmani Tarang PS to provide necessary help as the
proposed places for search and seizure fall under the jurisdiction of Brahmani Tarang PS.
