The president had announced he was leaving UND to become president of the University of Colorado but did not submit a formal resignation notice. However, the chancellor viewed public statements by the president about departing UND in June as a de facto resignation notice, which was accepted. The chancellor informed the president they would begin searching for an interim and permanent replacement.

    Re: Notice of Resignation

    Dear Mark:

    Congratulations on the news being named the sole finalist for the office of President at the University of
    Colorado. I would like to thank you for all your efforts on behalf of the University of North Dakota and
    the North Dakota University System over the last three years, and we wish you the very best in your new
    role in Colorado.

    While I have not received a formal notice of resignation, on April 10, 2019 you sent a statement to the
    UND community. In it, you stated that you were “excited for this new opportunity, but sorry to leave
    UND” and that you “look forward to . . . returning to witness UND’s continued success.” You have also
    been quoted in many news accounts as stating that your last day as President of UND will be June 15,
    2019, including in the UND Today publication, which stated that you would be “departing UND in June.”
    Under the circumstances, we view the April 10, 2019 statement, along with your statements to media
    outlets since then, as a de facto notice of resignation effective June 15, 2019. On behalf of the North
    Dakota University System, I accept your de facto notice of resignation.

    If you disagree with any aspect of this letter, please contact me immediately so we can discuss the path
    ahead. Time is of the essence, as we will need to immediately begin the process of appointing an interim
    President and beginning a formal search for your replacement.
