LEAVE AND LICENSE AGREEMENT

This LEAVE LICENSE AGREEMENT is made at Jamshedpur on 3rd May 2018

BETWEEN

Mrs. TULIKA KUMAR, aged about 51 years, wife of Mr. DIVESH KUMAR
residing at 4 Park Enclave Office Road, Northern Town Jamshedpur - 831001,
hereinafter referred to as the “LICENSOR” (which expression shall unless it be
repugnant to the context or meaning thereof, mean and include her successors,
administrators, bearers and assigns) of the FIRST PART;

AND

Mr. PANKAJ SINGH S/o. Shri P N SINGH having Permanent Address at HN – 6


Baridih Basti, Baridih, PS Sidhgora, PO Baridih PIN – 831017 hereinafter called the
“LICENSEE” of the SECOND PART.

WHERE AS the LICENSOR is the ABSOLUTE OWNER of the Duplex No. 60 H,


Vijaya Heritage, Uliyan, Kadma, Jamshedpur - 831005 (hereinafter referred to as the
‘SAID PREMISES’).

AND WHEREAS the LICENSEE has approached the LICENSOR and requested her to
grant a License to use as housing accommodation of the said premises for a temporary
period i.e. for 11 (eleven) months commencing from 1st May 2018 and ending on 31 st
March 2019 for the purpose of temporary housing accommodation for the LICENSEE
and his family.

AND WHEREAS the LICENSOR on the specific request and undertaking of the
LICENSEE to vacate the said premises definitely on the expiry of the period of eleven
months, has agreed to do the same on the terms and conditions hereunder mentioned.

1. The said LICENSOR hereby allows the said LICENSEE to occupy the said
premises on the basis of Leave and License for the period of Eleven (11) months
commencing from 1st May 2018 and ending on 31st March 2019.

2. That the said LICENSEE shall pay to the LICENSOR a sum of Rs. 17500
(Rupees Seventeen Thousand Five Hundred only) as and by way of monthly
compensation for the use of said premises as temporary housing accommodation
to be paid on or before the 7th (Seventh) day of each calendar month in advance
and the same is delivered every month to the LICENSOR.
3. The LICENSEE shall deposit with the LICENSOR on or before execution of this
agreement, a sum of Rs.24000 / - (Rupees Twenty Four Thousand only) being
the Security Deposit, FREE OF INTEREST, which will be returned to the
LICENSEE on the expiry of this agreement or on notice of one month in advance
for vacation of said premises and against vacant and peaceful possession of the
said premises, after deducting the cost of the damages, if any, to the fixtures /
fittings and outstanding Electricity Bills/ Water Bills/ Telephone Bills, if any.

4. It is expressly agreed that the LICENSOR shall be deemed to have the ultimate,
total and full control over the possession of the said premises and the LICENSEE
shall not claim any right by way of sub-tenancy or any other right in any manner
whatsoever in the said premises.

5. That the LICENSEE shall not sub-let partially or fully the said premises under
his/her license and if the LICENSEE shall do so then this Leave and License
Agreement shall stand cancelled automatically and the LICENSEE shall be liable
for ejectment from the said premises immediately and without any prior notice in
this regard.

6. The LICENSEE hereby admits and acknowledges that it is the expressed intention
of the parties to this agreement that the relationship of the landlord and tenant
shall not be deemed to be created hereby or otherwise between them under any
circumstances whatsoever. This agreement merely confirms bare permission of
Leave and License and does not create any interest into or upon the said premises
or any part thereof in favour of the LICENSEE. It is not intended by this
Agreement to create any lease/s or any part thereof in favour of the LICENSEE. It
is not intended by this Agreement to create any lease sub-lease or any other
Rights, Titles and Interests into or upon the said premises in favour of the
LICENSEE and the LICENSEE hereby agrees that under no circumstances the
LICENSEE shall claim any right to tenancy, sub-tenancy or any other right to any
nature into or upon the said premises.

7. That the LICENSEE is using the said premises as housing accommodation for
temporary period of 11 (eleven) months on Leave and License basis and it does
not create any right, title and interest in the said premises by way of sub-tenancy
or tenancy or otherwise. The License hereby granted to the LICENSEE is
revocable and non-transferrable one, which is to be terminated on expiry of 11
(eleven) months as stated hereinabove or earlier, subject to the terms and
conditions as laid down in this Leave and License Agreement.

8. That either party can terminate this Leave and License Agreement either with one
month’s notice in advance or with one month’s compensation of said premises as
temporary housing accommodation in lieu thereof.

9. That the above said premises shall be used by the LICENSEE only for the
temporary housing accommodation for himself and his immediate family and
shall not be used for any other purposes and the LICENSEE shall not do any
illegal activity in the said premises. The LICENSEE shall also not store any
narcotics, obnoxious and illegal substances such as liquor, bhang, arms, firearms,
ammunitions, gun powder, saltpetre, crackers, explosives, kerosene, petroleum or
other combustible and dangerous substances etc. illegally which are prohibited by
any laws of the government in any part of the said premises. LICENSEE shall not
act or carry out activities which are immoral obnoxious, antisocial, illegal or
prejudicial to the norms and etiquettes or act in a manner against the interest of
LICENSOR in respect to the said premises nor shall the LICENSEE allow any
person of anti social, criminal and immoral reputation to the said premises.
LICENSEE will be fully, totally and wholly responsible for breach of this clause
and shall be liable for immediate ejectment from the said premises without any
prior notice in this regard.

10. That on the expiry of the Leave & License agreement, the LICENSEE shall
arrange and handover the vacant possession of the said premises to the
LICENSOR.

11. That the parties to this agreement agree to serve on the other 30 days notice for
termination of this Leave and License Agreement.

12. If the LICENSEE shall vacate the flat before 11 months, then Rs.17500 (Rupees
seventeen thousand five hundred) will be deducted from the security deposit for
white wash, paint and other maintenance work.
13. If the LICENSEE fails to pay the monthly compensation for the use of the said
premises as temporary housing accommodation for 2 (two) consecutive months,
the LICENSOR shall give notice in writing to the LICENSEE and if such dues are
not cleared within 7 (seven) days of the issue of such notice, LICENSOR shall
have to the right to terminate this Leave and License Agreement and the
LICENSEE shall have to vacate the said premise immediately.

14. That on expiration of this Leave and License Agreement, LICENSEE shall pay to
the LICENSOR the electricity, telephone, cable TV, water and other charges
incurred by LICENSEE during the period of use of the said premise as temporary
housing accommodation.

15. That the LICENSEE hereby agrees to vacate and handover the said premises on
or before expiry of this agreement. If he fails to vacate and handover the said
premises to the LICENSOR on expiry of this agreement, he agrees to pay Rs. 800
(Rupees eight hundred) per day in addition to the monthly compensation
payable to the LICENSOR. This payment/penalty however, does not absolve the
LICENSEE of his/her obligation to vacate the said premises promptly on the
termination of the License.

16. That the LICENSEE shall not make any addition or alteration to the said premises
without the written permission of the LICENSOR, and if the LICENSEE shall do
so then this Leave and License Agreement shall stand cancelled automatically and
the LICENSEE shall be bound to vacate the said premises immediately.

17. Fixtures & Fittings provided with the house (as per annexure “A” are an integral
part of this Leave and License Agreement. The same shall be handed over by the
LICENSEE in working condition upon termination of the agreement. LICENSEE
will be at liberty to install air-conditioners, water taps, gas connection, electrical
fittings, lights, fans, telephones, internet connection, cable TV, sanitary and other
installations as may be necessary at his own cost and without causing any
structural change or any damage whatsoever to the said premises. On the Leave
and License hereby granted coming to an end howsoever and whatsoever, the
LICENSEE shall by entitled to remove such fixtures and fittings without causing
any damage to the said premises or if any damage is caused, the LICENSEE will
resolve the same to its original condition and to the satisfaction of LICENSOR.
18. That the LICENSEE shall pay for electricity and maintenance charges and water
consumed by LICENSEE during the period of Leave and License Agreement as
per the meter readings, in the name and on behalf of LICENSOR on or before the
due date. While monthly compensation for the use of the said premises as
temporary housing accommodation is to be paid to the LICENSOR, maintenance
charges are to be paid directly to maintenance office i.e. Vijaya Heritage
Residents Welfare Association 6th & 7th Phase and the receipt to be handed over to
LICENSOR.

19. That the LICENSEE shall carry out all necessary minor repairs to the said
premises at his own cost. However, if any structural change or major repairs are
required to be carried out at the said premises, LICENSOR shall carry out the
same at their own costs and expenses. The LICENSEE shall not carry out any
permanent or structural alterations or additions to the said premises without the
written consent of the LICENSOR.

20. That the LICENSOR and/or his/her representatives, surveyors and the workmen
shall have right to enter into the said premises at all reasonable times for the
purpose either for inspection and repairs of the said premises.

21. That the LICENSEE will keep and maintain the said premises including walls,
floors, ceilings, doors, windows, garden in good condition(reasonable wear and
tear and damage by fire, earthquakes and other natural calamities due to an act of
God excepted).

22. That notwithstanding anything hereinabove contained to the contrary, if the


LICENSEE fails to use the said premises for bonafide residential purpose
temporarily, and /or commits any breach of the terms and conditions of this Leave
and License Agreement, then on happening of any such events, the LICENSOR
shall have the right to withdraw, terminate and revoke this Leave and License
Agreement and LICENSEE shall have to vacate the said premises immediately.

23. The LICENSEE hereby agrees to hand over the mails and correspondences
pertaining to LICENSOR that may be received at the above said premises to the
LICENSOR without any delay.
24. That the LICENSEE shall abide by the bye-laws, rules and regulation of all Govt.,
semi-Govt., local bodies and authorities concerned as applicable to the said
premises.

25. All notice, communication/correspondence between the LICENSOR and the


LICENSEE shall be made in the above addresses by registered posts and or email.

26. Both the parties will be bound by the terms and conditions of this Leave and
License Agreement.

27. Two original sets of Leave and License Agreement shall be prepared and signed.
Both LICENSOR and LICENSEE shall retain one original set of this Leave and
License Agreement.

28. This Leave and License Agreement is subject to the jurisdiction of appropriate
courts in Jamshedpur.

IN WITNESS WHEREOF THIS LEAVE & LICENSE AGREEMENT is signed and


sealed by the within named parties in the presence of the following witnesses:

1. Light fittings in all rooms, gate, kitchen, toilets, staircases and terrace

4. Exhaust fans in all three bathrooms – 3 nos.

5. Exhaust fan in kitchen – 1 no.
