 INSTRUCTIONS TO TENDERERS

1- If the pre-qualifying conditions of the tender are not found Tender will not be accepted.
2- Validity of the tender bids should not be less than 90 days from the date of opening of the
tender.
3- The quoted prices should be firm in all respect.
4- The contractor shall be obliged to discharge his liabilities under the contract most diligently and
efficiently. In case he fails to do so, the Purchaser shall be free to take decision in this regard,
including assigning the work to some other person or agency debit able to the contractor.
5- The Engineer of Contract does not pledge to accept the lowest tender and deserves the right to
accept the whole or any portion of the tender as he may think fit without assigning any reason
for acceptance or rejection thereof.
6- All disputes arising out of and touching or relating to the subject matter of agreement shall be
subject to the jurisdiction of court of Kaushambi only.
7- Once the tender is submitted no subsequent correspondence will be entertained.
8- Tender document cost and Earnest money should be deposited in A/c #
4869002100001377 ¼IFSC Code-PUNB0486900, Punjab National Bank,
Kaushambi) of S.E. EDC, Kaushambi and scanned U.T.R. should be upload with Tender
Document failing which will not be Accepted any further.
9- The Contractor will have no claim to ask for the reason from the Engineer of Contract, if his
tender bid not Accepted.
10- Conditional tenders will not be accepted.
11- The undersigned reserves the right to reject/accept any or all tenders without assigning any
reason thereof.
12- In case the due date of tender opening is holiday, the tender will be opened on next working
day.
13- Tenderers should Uploaded the GST Registration Certificate photocopy with the tender

Dear Sir,
With the reference to your E-TENDER Notice No. (17/EDCK/2019-20), I/We hereby submit
my/our offer in accordance with the annexed terms and conditions, Specification to your satisfaction with
the following details:-

1. Acceptance of General Terms & Conditions and specification in schedule I/II/III on the form
enclosed and signed by me/us.
2. Deviations (if any) enclosed in separate schedule No. .................. Dully signed by me/us.
3. I/We agree to bind myself/our self that in the event of the supply/work being awarded to me/us.
I/We fail to executive the same my/our earnest money will be forfeited.

 TERM AND CONDITIONS

1. The work shall be carried out in accordance as per RESPO manual/standard

specification and working practice of U.P. Power Corporation Limited and as per I.E.
Rules. Contractor can consult RESPO construction manual on any working hours.
2. The work shall be carried out in accordance with standard specification and as per I.E.
Rules.
3. The Contractor shall take extreme and full care during erection of line to avoid all
possible accident and U.P. Power Corporation Ltd. will not be liable to pay any sort of
compensation arising out of any accident.
4. Materials:- All men materials will arranged by the contractor, until & otherwise
mentioned specifically.
5. All charges on account of damage, loss or expenses involved under condition, laid
above shall be brone by the Contractor and if paid by the Corporation, the same shall
be recovered from the Contractor.
6. If the Contractor with draw their offer his Earnest Money shall be forfeited by the
Corporation.
7. TOOLS AND PLANTS:
The Contractor shall arrange all the Tools and Equipment required for the work by them
at their own cost.
8. COMPLETION PERIOD OF WORK:
The entire erection is to be completed in all respect within 3 months from the date of
issue of order/agreement or Receipt of materials.
9. RATES:
The rates accepted shall remain firm through out the period of agreement.
10. PENALTY FOR DELAY IN COMPLETION:
½% Per week of the total cost of work will be charged subject to maximum 10%
on the total value of work, If the Contractor falls to complete the work within stipulated
time. Also if necessary the work will be carried out by other agency which have
agreement of similar work and agreement amount of defaulter shall be deducted
automatically.
11. PAYMENT:
100% Payment released by E.E. E.D.D., Chail, Kaushambi after satisfactory completion
of work.
12. SECURITY MONEY:
The earnest money deposited by the contractor shall be converted into security
deposit for above tender. The balance of security amount shall be deducted from
contractor amount @ 10% of value till. The security deposit shall be released to the
contractor after six month from the date of satisfactory completion of work.
17. SPECIAL CONDITIONS OF CONTRACT:
These above conditions shall be read & construed along with the General Conditions in
Standard Form ‘A’ annexed but in case there shall be any conflict and inconsistency
between these special conditions & of form ‘A’ these conditions shall prevail.
14. TAXES :
G.S.T. shall be paid extra as legally applicable.
15. VARIATION:
The quantity may vary 10% on either side as per site requirement with the
written order of the E.E. E.D.D., Chail, Kaushambi after getting approval from
appropriate authority.
16. The work shall be carried out under the super vision of concerned J.E./SDO under E.E.
E.D.D., Chail, Kaushambi.
