Topic: Sexual Orientation, Gender Identity and Expression Equality SOGIE BILL
Have you ever thought about equality? One thing that people say that they want is for us all to
be treated equally. SOGIE Bill or the Sexual Orientation, Gender Identity and Expression Equality Bill
is an anti - discrimination bill that prohibits unfair treatment on the basis of a person’s sexual
orientation, gender identity, sex, religion and belief. The Bill recognizes the LGBTQ + as equals as
well as women and men and ensures that everyone’s rights are protected. The state recognizes the
fundamental right of every person to be free from any form of discrimination. Therefore, the proposed
bill is all about equality in general and does not suppose any special treatment. Why do I highly agree
about the implementation of SOGIE Bill?
Equality is a right. Many people disagree with the SOGIE Bill for it does not seek equality but
rather it seeks superiority for the LGBTQ+ community. Regarding the discrimination complaint of a
Trans woman Gretchen Diez on August 16, 2019 that is arrested for needing to use the women’s
comfort room in a mall in Quezon City, many people misinterpret the thought of the proposed bill
thinking that it is all about the rights about the LGBTQ+ and not about everyone’s right. According to
House Bill No. 136 The comprehensive Anti-Discrimination Act “An act Prohibiting Discrimination on
the Basis of Ethnicity, Race, Religion or Belief, Sex, Gender, Sexual Orientation, Gender Identity and
Expression, Language, Disability, HIV Status, Educational Attainment.” Thus, it aims to protect the
rights and welfare of everyone against discrimination. It is not all about which restroom they use, it’s
about equality in all preferences, genders and humanity. Transwomen being not allowed to use a
women’s comfort room is not a discrimination but a women’s prerogative. If transwomen would be
allowed to use a women’s restroom then I believe it will be a violation of women’s right. Gender
Identity is an individual person sense of having particular gender. Generally there are two; man and
woman. You being a woman or being a man cannot be discriminated because of it which means the bill
is not only limited to LGBTQ+ people but for every man and woman.
There are different kinds of religion in our country and most of them are being discriminated
like the Muslims. Many Muslims who came to Manila have been subjected to discrimination. This does
not only happen in Manila but also in some region in the country. There are cases where one cannot
rent a house because they are Muslim. According to Amihilda Sangccopan in an interview in ANC
News “Because of the war in Mindanao, there are Muslims who moved in Manila are subjected to
discrimination and cannot rent a house with the thought that Muslims cannot pay rent.” Many Muslims
support the Bill for they don’t want to be discriminated by their religion and seeks protection under the
Equality Act. Because of discrimination, a bill has to be proposed because instead kindness,
compassion, understanding it has come to a point where they need this bill to protect their rights as
human beings. Senate President Vicente Sotto III believes the SOGIE BILL will have a better chance of
becoming a law. The Bill seeks equality for everyone and not superiority. It is bound in the Republic of
the Philippines House of Representatives its objective is to eliminate discriminatory practices based on
sex, sexual orientation or gender identity or expression by proscribing and penalizing several
discriminatory practices. In my own perspective, the bill is for every person, the bill’s purpose is to
intensify its effort to fulfill its duties under the equal protection clause in our constitution.
Many people argued that SOGIE Bill is not necessary since there are already existing laws that
protects the rights of citizen against discrimination, which is correct. Magna Carta for women seeks to
eliminate discrimination and the person who violates is bound to be liable to pay damages to the
offended. There are a lot of laws that protects our rights so why do we still need the SOGIE Bill? There
are victims of discrimination because of their height, but do we need an Anti-Short Height
Discrimination Act? There are victims of discrimination because they are fat, but do we need an Anti-
Fat Discrimination Act? There are victims of discrimination because of their skin color, but do we need
an Anti-Skin Color Discrimination Act? My point here is the SOGIE Bill imposes and prohibits any
type of discrimination and can be legally penalized to the person who violates it. Equality is a right for
everyone and all of us needs protection against discrimination.
