DEED OF ABSOLUTE SALE

WITH USUFRUCT

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Absolute Sale is made and entered this ____day of


_______________, in the City of Manila, Philippines, by and between:

CARMELITA ABAD, of legal age, widow and Filipino with


residence address at 2281 Road 5, Fabie Estate, Sta. Ana,
Manila, hereinafter referred to as the “VENDOR”;

- and -

DINARD ABAD, of legal age, single/married and Filipino


with address at ____________________________, hereinafter
referred to as the “VENDEE”.

WITNESSETH:

WHEREAS, the VENDOR is the absolute and registered owner of


2/3 portion of a real property situated in the District of Paco, City of
Manila containing a total area of 132.90 square meters, more or less, more
particularly described as follows, to wit:

“A PARCEL OF LAND (LOT 1, BLOCK 23 OF THE


SUBDIVISION PLAN PSD-48633, SHEET 3, BEIGN A
PORTION OF LOT 15, BLOCK 3059 OF THE CADASTRAL
SURVEY OF THE CITY OF MANILA, LRC CAD. RECORD
NO. 327), SITUATED IN THE DISTRICT OF PACO, CITY OF
MANILA. BOUNDED ON THE NE ALONG LINE 1-2 BY LOT
2, BLOCK 23 OF THE SUBDIVISION PLAN; ALONG LINE 2-3
BY ROAD LOT 15 OF THE SUBDIVISION PLAN; ALONG
LINE 4-5 BY ROAD LOT 3 OF THE SUBDIVISION PLAN;
ALONG LINE 5-1 BY LOT 3 BLOCK 23 OF THE SUBDIVISION
PLAN. BEGINNING AT A POINT MARKED “1” ON PLAN,
BEING S. 69 DEG. 23’E 953.10 M. FORM BLLM NO. 44,
MANILA CADASTRE; THENCE S. 85 DEG. 00’E., 11.40 M. TO
POINT 2; THENCE S. 5 DEG. 00’W., 9.17 M. TO POINT 3;
THENCE S. 50 DEG. 04’W M. TO POINT 4; THENCE N. 85
DEG. 00’W., 8.57 M. TO POINT 5; THENCE N. 5 DEG. 00’E.,
12.00 M. TO THE POINT OF BEGINNING; CONTAINING AN
AREA OF ONE HUNDRED THIRTY TWO SQUARE METERS
AND NINETY SQUARE DECIMETERS (132.90), MORE OR
LESS. xxx xxx xxx.”

WHEREAS, the VENDOR is willing to sell 2/3 portion of the


aforedescribed real property and the VENDEE desires to buy the same;

NOW THEREFORE, for and in consideration of the sum of THREE


HUNDRED THOUSAND (P300,000.00) PESOS, Philippine Currency,
receipt of which is hereby acknowledge by the VENDOR hereby SELLS,
CONVEYS and TRANSFERS unto the VENDEE his Heirs and successor-
in-interest or assigns the 2/3 portion of the aforedescribed real property;

WHEREAS, the VENDEE shall pay the obligation of the VENDOR to


Atty. Yolando F. Lim in the amount of P140,500.00 representing balance
and success fee which will be deducted from the consideration of the sale;

WHEREAS, the VENDOR will use the proceeds of the sale for her
medicines and other necessary expenses to make her life comfortable;

WHEREAS, in consideration of the VENDEE’S love for the


VENDOR, being his grandmother, the usufruct of the entire 2/3 portion of
the aforedescribed property such us right to use, enjoyment and
possession is given to her to last until she closes her eyes and faces her
creator;

WHEREAS, the VENDOR hereby warrants her full ownership over


the 2/3 portion of the aforedescribed real property, with full right to
dispose of the same, free from all liens and encumbrances except the
usufruct, and that henceforth, full right of naked ownership shall pertain
to the VENDEE.

IN WITNESS WHEREOF, Parties have hereunto set their hands and


affixed their signatures herein below on the date and place first above
written.
