SECRETARY HILARIO: Ladies and gentlemen, the 84 TH Regular Session of the Honorable
Sangguniang Panlungsod with the Honorable Jimmy L. Carbonell as Presiding Officer is
about to commence. Everybody is requested to please rise.
HON. TEMP. PRES. OFFICER CARBONELL: The 84 TH Regular Session of the 15th Sangguniang
Panlungsod is now called to order. May I request the City Choir for the Doxology and then
followed by the Honorable Peter Q. Maristela for the opening prayer.
(Note: At 9:55 in the morning, the 84TH Regular Session of the 15th Sangguniang
Panlungsod was called to order by the Honorable Jimmy L. Carbonell, Presiding Officer.
After the prayer which was led by the Honorable Peter Q. Maristela the singing of the
Philippine National Anthem followed which was led by the Puerto Princesa City Choir. The
recitation of the Pledge of Allegiance to the Filipino Flag was led by the Honorable Nesario
G. Awat in lieu of the Honorable Rolando T. Amurao while the recitation of the Philippine
Councilor’s League Creed was led by the Honorable Henry A. Gadiano. The singing of the
Puerto Princesa March and a Cuyono song followed, which were led by the Puerto Princesa
City Choir.)

August Body, good morning. Sa ating mga miyembro ng media, magandang umaga po sa
inyong lahat. Ganon din po sa ating mga bisita pa, iba pang mga panauhin na narito sa
gallery. Sa ating mga staff, secretariat, headed by the Honorable Attorney PJ Hilario, good
morning. Our secretary please, for the roll call of the members.
SECRETARY HILARIO: Thank you, Mr. Chair. Honorable Luis M. Marcaida III, City Vice Mayor,
Presiding Officer.
HON. TEMP. PRES. OFFICER CARBONELL: Thank you very much, Mr. Secretary. Considering
that we have nine (9) members, we have a quorum, and we can now proceed with our session
for today. And, at this juncture, may I request the Honorable Modesto V. Rodriguez II, our
Majority Floor Leader.
HON. MAJORITY FLOOR LEADER RODRIGUEZ: Thank you, Mr. Presiding Officer, good
morning. Mr. Presiding Officer, we are now under the Reading and Consideration. And I
move for the approval of the Journal of Proceedings of the 82nd Regular Session held last
February 26, 2018.
HON. TEMP. PRES. OFFICER CARBONELL: Before the motion, may I acknowledge the
Honorable Oliveros.
HON. OLIVEROS: Thank you very much, Mr. Presiding, good morning. Thank you very much, Mr.
Floor Leader. Mr. Presiding, I would just like to express my gratitude and thank to the
secretariat through the leadership of our Secretary Attorney Philip Jerome Hilario for our seal.
You will notice that they have changed.
HON. TEMP. PRES. OFFICER CARBONELL: Thank you very much, our Secretary, Attorney PJ
Hilario, thank you very much. So, there is now a motion for the approval of the Journal of
Proceedings of the 82nd Regular Session held on February 26, 2018, for approval. Any

HON. TEMP. PRES. OFFICER CARBONELL: There is a motion that the Journal of Proceedings of
the 83rd Regular Session held on March 5 be referred to the Honorable Members of this

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Thank you. Mr. Presiding Officer, before we
proceed to the Privilege Hour, our colleague, Acting Vice Mayor, Nancy M. Socrates would
like to be recognized and she is going to make an announcement.

HON. SOCRATES: Thank you, Mr. Presiding Officer, and Mr. Floor Leader, good morning
everyone. I just wish to extend my invitation for tomorrow’s mass blood donation. Ito po ay
isang blood - letting activity na gaganapin po sa Robinson’s Place Palawan. It starts at eleven
(11:00) in the morning and all the way until six (6:00) pm or seven (7:00) pm. So, sana po ay
mag-donate po tayong lahat ng dugo. And special attention po sa ating media friends, sana po
ay matulungan nyo kaming ipagkalat po ito, at alam po nating lahat ang kakulangan po sa
dugo sa ating Lungsod. So, hinihikayat ko po kayong lahat na magbigay po ng inyong dugo
bukas. Maraming salamat po. Robinson’s Place Palawan, ten (10:00) am to six (6:00) pm,

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Thank you Mr. Presiding Officer. For the
Privilege Hour, our colleague, Honorable Matthew K. Mendoza is going to deliver a
privilege speech. This pertains to the support of the City Government’s thrust to fast track
building ICT Infrastructure, including expansion of fiber network across many parts of the
Province of Palawan and the City Government of Puerto Princesa. Mr. Presiding Officer, I
move that we recognize the gentleman from Barangay San Pedro, Honorable Matthew K.
Mendoza.
HON. TEMP. PRES. OFFICER CARBONELL: The Honorable Matthew K Mendoza is now
recognized for his privilege speech.
HON. MENDOZA: Good morning. Maraming salamat, Mr. Floor Leader, sa atin pong mga
kasamang Konsehal, good morning. I go straight to the point. Last week po, nakatanggap po
ako ng tawag from our First District Congressman Chicoy Alvarez regarding po sa proposal
or tulong, support na hinihingi ng Globe Telecom. Early this morning we were at the Mayor’s
Office and partially po na-discuss po natin yong hinihiling nila sa atin. This pertains to …
yong improvement nila ng kanilang mga telecommunications, yong mga plans nila for
telecommunications in Puerto Princesa. Sa lahat po ng na-discuss, may isang bagay po na
doon po nakuha ang aking attention. Iyong pagpapatayo po nila ng mga bagong mga cell sites
na matagal na po nating niri-request sa mga telecoms na lagyan yong ating western barangays
o yong west coast. At isa po sa mga plano nila, i-include po yon, kasama po sa
pagpapatayuan nila ang Barangay Napsan, Bagong Bayan, Simpocan at syempre po matagal
na matagal na po nating niri-request ang ating growing tourist destination dito yong
Nagtabon. So, Mr. Chair, inimbita po natin sila para mag-present ng kaunti. I believe, they
MR. CORDIA: Magandang umaga po sa inyong lahat, Honorable Councilor and Mr. Presiding
Officer. Ako po si Rob Cordia from Globe Telecom. Kami po ang … ang grupo po namin
ang in-charge sa site acquisition at kami po ang nag-a-acquire po ng mga sites for… yong
mga nabanggit po ni Councilor Matt na mga bagong tore or cell sites. At kami rin po yong in-
charge na mag-acquire ng mga lupa o mga posteng dinadaanan po ng mga fiber or ng mga
copper na internet to the home po. At kami po ay nagpapasalamat na binigyan nyo po kmi ng
tsansa na makapag-share po ng aming mga plano. Dahil po sa mga planong ito po ay tulong
din po ninyo ang kailangan po namin para ma-implement po namin ito. Gaya uli rin po ang
nabanggit ni Councilor Matt, matagal na pong niri-request ng Puerto Princesa na ma-i-
improve po ng mga telecoms ang signal or pati po ang LTE or internet data ng mga cellphone
natin. Kaya kami rin nandito o isa po sa pinakaimportanteng bagay na idi-discuss namin po is
ang improvement po or ang pagpapatayo namin ng mga bagong tore. Payagan nyo po kami
na i-share po sa inyo ang listahan ng eighteen (18) na bagong cell sites, ulit po eighteen (18)
na bagong cell sites na itatayo po namin sa loob ng Puerto Princesa. Nasa screen po ngayon
ang listahan. Ang unang fifteen (15) kasama po dito ang Barangay Bagong Bayan, Barangay
Simpocan, Nagtabon Beach, at dito rin po sa may City Hall, maglalagay po tayo sa area po ng
City Hall. Sa WESCOM, Barangay San Miguel, Barangay Bancao-Bancao, Barangay Bagong
Sikat, Barangay San Manuel, Barangay Napsan, PSU Sta. Monica, WPU, Barangay Sicsican,
Barangay San Jose, Barangay San Pedro, Barangay San Rafael at Barangay San Jose.
Makikita nyo po doon sa column ng status, ang sitwasyon ng bawat isang cell site at
karamihan po dito ay naghahanap pa po kami ng mga areas kung saan po namin ilalagay o ng
lugar kung saan po mismo ilalagay ang cell site. Ito naman po yong tatlo pa po ang tatayuan
namin which is ang Puerto Princesa Airport at ang PIRN po, dalawa pong site ang ilalagay po
namin diyan. Kami po ay nagpunta rito ngayong araw na ito, para ho humingi ng suporta sa
Council po with regards to… sa aming pag-iimplement at pag- acquire po nitong mga sites
na ito po. I’m sure po that you are all aware of that, all these sites po when we acquire a site
or before we do an implementation of a site, ay dumadaan po kami sa Council po for a
resolution. So, we have discussed this with the Mayor earlier. Last week din po kausap din
po namin si Congressman Alvarez, nong nakaraang Tuesday po. Nong nakaraang Thursday
po ay kausap din po namin si Governor Alvarez, at kanila pong ini-endorso po ito pong mga
sites na ito para ma-improve po ang telecommunications dito sa Palawan especially in Puerto
Princesa. One of the request po or the help that we will need from the Council is for you to
help us fast track or the permitting. Before that po, before I go to the permitting cycle na
mayroon po tayo, medyo malabo lang po doon sa ating projector po, pero yong nasa kaliwa
po natin, ay ang current signal coverage ng Puerto Princesa at yong nasa sa kanan po hindi
malinaw ang pagka-project. Yan po ang makikita nyo ang improvement after nitong eighteen
(18) cell sites na nabanggit ko po kanina. So, makikita nyo po doon sa may west coast area
may mga extra, one (1), two (2), three (3), four (4) sites po yan na naka-rely po diyan para
ma-cover po yan. Nabanggit ko po kanina yong permitting process na ginagawa po namin.
So, bilang Globe Telecom po, pag kami po ay nag a-acquire ng site, pag nag-apply po kami
from barangay level to LGU, marami po kaming dinadaanan na permitting. At isa po ito na
gusto naming ilapit sa inyo, kasi isa po ang Council sa pinaka nagbibigay ng stamp sa lahat ng
permits namin which is ang resolution po na inyong binibigay. So, kagaya po ng nabanggit
ko, with the support and endorsement of the governor, councilor and also the mayor, we
would like to seek your help po for us to be able to come up with a one- time resolution
covering these eighteen (18) sites. So, yon po kung inyo pong ibibigay yong inyong suporta
sa pagtayo po nitong mga cell sites na ito. Bukod po doon, mayroon din po kaming mga

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Marami pong salamat, Ginoong
Tagapangulo. Doon po sa mga kinakailangan pong resolution na hinihingi po ng ating
panauhin, palagay ko naman po ay madali namang maibibigay yon. Sapagkat kung
matatandaan po natin Ginoong Tagapangulo, unang termino ko pa lamang po dito, naabutan
ko po si Konsehal Jimmy Carbonell at si Konsehal Henry Gadiano nong panahon pa lang nila
ay paulit-ulit na na nagsasagawa ng mga resolution na humihiling sa Globe na magkaroon ng
cell site sa mga areas na yon, lalong-lalo na po sa Napsan, Simpocan at Bagong Bayan. At
ngayon nga po, ito po’y katuparan na ng matagal ng pinapanaginip ng ating mga kababayan,
sapagkat alam po ninyo sa sitwasyon po ngayon ang komunikasyon po na aming ginagamit
doon sa mga barangay na yon ay yong old school na radio. Just imagine po, kapagka
mayroong emergency tatawag po rito, radio lang po ang ginagamit. Ganon din po pag yong
mga kababayan namin doon ay mayroong kailangan sa amin, kailangan pang i-radio dahil
wala nga pong cellphone. At alam din po natin na marami ng planong development ang
isasagawa sa mga areas na yan. Ngayon doon po sa hinihiling po nila na one-time release of
permit or resolution sa lahat ng sites, siguro po ay magandang pag-usapan po natin yan with
the Legal Officer. Sapagkat ang isa po sa mga requirements para po kami makapagbigay po
ng resolution ay yon pong barangay resolution. Ay kung makikita po natin doon po sa inyong
presentation ay yon pong mga cell sites ay isasagawa ninyo sa mga ibat-ibang mga barangays.
Kung mangyari po sana na magawa po ninyo na sa ngayon pa lang ay makakuha na kayo ng
mga resolution sa ibat-ibang barangay sa ngayon at matanggap naming lahat yon, ay palagay
ko po siguro ay pwede nating magawa yong isang resolution lang para sa lahat ng barangay,
ayon po.
MR. CORDIA: Salamat po, sa inyong advice. Actually, isa po sa mga tulong din po na hihingin
namin is kung kakayanin po ninyo kaming ma-endorso sa mga barangay na naibanggit din po
namin kanina.
WHEREAS, Article II, Section 25 of the Philippine Constitution guarantees that the State shall
ensure autonomy of local governments;
WHEREAS, Section 391 (a), (3) of Republic Act No. 7160, otherwise known as the Local
Government Code of 1991, provides, that Sangguniang Barangays shall have the power to enact
annual and supplemental budgets in accordance with the aforestated law;
WHEREAS, pursuant to Section 333 of the same Code, the Sangguniang Panlungsod is mandated to
review barangay budget to ensure that the provisions of the Code on Local Fiscal Administration are
complied with, which review power includes the authority to declare the same inoperative if it is
ascertained that the appropriations contained therein exceed the estimates of the income duly certified
as collectible or that the same has not complied with the budgetary requirements set forth; and the
authority to disallow the same if the items of appropriation are contrary to or in excess of any of the
general limitations or the maximum amount prescribed;
WHEREAS, in her letter dated March 5, 2018 addressed to the Honorable Members of the
Sangguniang Panlungsod, Ms. Maria Regina S. Cantillo, City Budget Officer, submitted the Annual
Budget of Barangay Irawan, this City, for the Calendar Year 2018, with the information that upon
preliminary review by her office, the Annual Budget of the aforesaid Barangay showed substantial
compliance with the provisions of the Local Government Code of 1991 and implementing circular
and issuances;
NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,
BE IT RESOLVED, as it is hereby resolved, to approve the Annual Budget of Barangay Irawan, this
City, for Calendar Year 2018.
RESOLVED further, that copies of this Resolution be furnished to Honorable City Mayor Lucilo R.
Bayron, the City Administrator, the City Legal Officer, the City Information Officer, and the
Sangguniang Barangay of Irawan, this City, for their information and appropriate action.
UNANIMOUSLY APPROVED.
HON. MAJORITY FLOOR LEADER RODRIGUEZ: To proceed, Mr. Presiding Officer, M.8, to the
Committee on Public Order and Safety. For M.9, likewise, Mr. Presiding Officer, there is also
a recommendation from the City Budget Office that the Annual Budgets of Barangays
Mabuhay and Maoyon complied with the accounting rules and regulations, Mr. Presiding
Officer. So, I move for its approval in the first and final reading.

WHEREAS, Article II, Section 13 of the 1987 Constitution provides, that the State recognizes the
vital role of the Youth in nation building and shall promote and protect their physical, moral, spiritual,
intellectual and social well-being. It shall inculcate in the youth patriotism and nationalism, and
encourage their involvement in public and civic affairs;
WHEREAS, further, Article II, Section 17 of the same organic law declares, that the State shall give
priority to education, science and technology, arts, culture and sports to foster patriotism and
nationalism, accelerate social progress and promote total human liberation and development;
WHEREAS, in his letter dated March 08, 2018, addressed to the Honorable Acting City Vice Mayor
Maria Nancy M. Socrates and to the Honorable Members of the City Council of Puerto Princesa, thru
Atty. Philip Jerome J. Hilario, Secretary to the Sangguniang Panlungsod, this City, Atty. Arnel M.
Pedrosa, City Legal Officer, Acting City Administrator, requested authority for Honorable City
Mayor Lucilo R. Bayron to enter into and sign the Memorandum of Agreement for Work Immersion
Partnership with the Palawan Polytechnic College Inc.;
WHEREAS, pursuant to Republic Act No. 10533, otherwise known as the “Enhanced Basic
Education Act of 2013”, the Department of Education enacted the guidelines for work immersion
program for senior high school. In compliance with the Department’s guidelines, Palawan
Polytechnic College Inc. proposed a partnership with the City Government for their senior high
school students to be accommodated in a Work Immersion Partnership;
WHEREAS, this August Body, after deliberation, finds the request in order and proper to support the
implementation of the K to 12 Program of the Department of Education in this City, as provided in
Republic Act No. 10533.
NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,
RESOLVED further, that copies of this Resolution be furnished to Honorable City Mayor Lucilo R.

But now, with the change now that they will not be exempted from the locational clearance,
they have to undergo the process but this time instead of title or tax declaration, they have to
get a certification from the NCIP. I think there is no need to use the word “however”.

Peoples will clearly states that the one being applied for a locational clearance is the one

WHEREAS, Article II, Section 5 of the Philippine Constitution declares that the maintenance of
peace and order, the protection of life, liberty, and property, and the promotion of the general welfare
are essential for the enjoyment by all the people of the blessings of democracy;
WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code
of 1991, provides that every local government unit shall exercise the power expressly granted, those
necessarily implied there and from, as well as powers necessary, appropriate or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare and ensure and support, among other things, the maintenance of peace and order within their
territorial jurisdiction;
WHEREAS, presented to this August Body is a letter dated February 27, 2018 from Atty. Arnel M.
Pedrosa, City Legal Officer, Acting City Administrator, requesting for a legislative measure creating
the Puerto Princesa City Joint Task Force directing all uniformed agencies to constitute themselves
accordingly, primarily focused on the maintenance of peace and order situation, anti-terrorism and
counter insurgency measures;
WHEREAS, pursuant to its mandate, this August Body finds it necessary to enact this ordinance
considering that the maintenance of peace and order in the city is an imperative requirement in
various areas of development such as eco-tourism, agriculture, transportation and education.
NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,
BE IT ORDAINED by the Sangguniang Panlungsod of the City of Puerto Princesa in its regular
session assembled, THAT:
SECTION 1. TITLE. This Ordinance shall be known and cited as the “Puerto Princesa City Task
Force on Peace and Order and Public Safety Ordinance”.
SECTION 2. SCOPE AND COVERAGE. This Ordinance shall be enforced within the territorial
jurisdiction of Puerto Princesa City.
SECTION 5. CREATION OF JOINT TASK FORCE. There is hereby created the Puerto Princesa
City Joint Task Force on Peace and Order and Public Safety, which shall oversee the implementation
of the provisions of this Ordinance and other related activities as may be provided by rules and
regulations, as well as guidelines promulgated by higher authority or mandated by national laws.
SECTION 6. COMPOSITION. The Puerto Princesa City Joint Task Force on Peace and Order and
Public Safety shall be composed of the following:
SECTION 7. DUTIES AND RESPONSIBILITIES. The Puerto Princesa City Joint Task Force on
Peace and Order and Public Safety shall have the following duties and responsibilities:
a. Convene the Task Force at least every two (2) months except in case of emergency
situation where the Chairman may call for a special meeting;
c. Contribute to the strategies of the City Peace and Order Council that would effectively
address peace and order problems;
d. Coordinate and monitor the implementation of peace and order plans in the City;
SECTION 8. REPEALING CLAUSE. All ordinances, rules and regulations, or any part thereof not
consistent with this ordinance are hereby repealed, amended or modified accordingly.
SECTION 9. SEPARABILITY CLAUSE. If any provision or part of this Ordinance is declared
invalid and unconstitutional, other provisions and parts hereof not declared shall remain in full force
and effect.
SECTION 10. EFFECTIVITY CLAUSE. This Ordinance shall take effect fifteen (15) days
following its publication in a newspaper of local circulation in the City of Puerto Princesa.

HON. MAJORITY FLOOR LEADER RODRIGUEZ: Thank you, Mr. Presiding Officer. First item,
numbered as O.C.1, is a resolution requesting the Office of the City Mayor to strictly
implement Ordinance Number 17-92, otherwise known as an Ordinance fixing curfew hours
for minors below 18 years of age and imposing penalties for its violation. This is authored
by Honorable Jimmy Lagan Carbonell. And the author is requesting for the immediate
consideration of this item. And since the proposed resolution is not debatable, this is just a
request for the implementation of the ordinance, so, I move for the approval of the
resolution on the first reading dispensing the second and final reading.
HON. TEMP. PRES. OFFICER CARBONELL: Thank you very much. There is now a motion to
approve the proposed resolution in the second reading dispensing the third and final reading.

WHEREAS, Article II, Section 5 of the Philippine Constitution declares that the maintenance of
peace and order, the protection of life, liberty, and property, and the promotion of the general welfare
are essential for the enjoyment by all the people of the blessings of democracy;
WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code
of 1991, grants to local government units the power to pass ordinances for the purpose of the welfare
of the constituents within the jurisdiction of the City Government, under which, every local
government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as
well as powers necessary, appropriate, or incidental for its efficient and effective governance, and
those which are essential to the promotion of the general welfare;
WHEREAS, the 7th Sangguniang Panlungsod of the City Government of Puerto Princesa approved
Ordinance No. 17-92, entitled: “An Ordinance fixing curfew hours for minors below eighteen (18)
years of age and imposing penalties for its violation”;
WHEREAS, Chapter Three (3), Article XVI, Section 1 of Ordinance No. 544, known as the “Code
of General Ordinances of the City of Puerto Princesa”, enacted by the 13th Sangguniang Panlungsod,
prohibits minors below eighteen (18) years of age to roam around or loiter in public places or move
about outside their residences between the hours of 10:00 o’clock in the evening and 4:00 o’clock in
the morning without a curfew pass from the Office of the City Mayor or unless accompanied by their
parent or parents, responsible relative or guardians, or unless the minor, who is not a resident of the
City, is only passing through the City;
WHEREAS, be it noted that in view of Section 57 of Republic Act No. 9344, otherwise known as
the Juvenile Justice and Welfare Act of 2006 and other laws and rules as to minors, the penalty of
imprisonment cannot be imposed to persons fifteen years old and below and to those above fifteen,
below eighteen acting without discernment curfew violations, being the same as a status offense;
WHEREAS, it is the object of the ordinance to prevent the sustaining of injuries arising from
accidents happening during curfew hours and to promote morality, dignity, and decency within the
City of Puerto Princesa;
WHEREAS, there has been a lenient enforcement of the ordinance in the past years that resulted to
several commission of crimes during night time.
NOW THEREFORE, on motion of Hon. Modesto V. Rodriguez II, City Councilor, Majority Floor
Leader,
BE IT RESOLVED, as it is hereby resolved, to request the Office of the Honorable City Mayor to
strictly implement Chapter III, Article XVI, Section 1 of Ordinance No. 544, otherwise known as
“Code of General Ordinances of the City of Puerto Princesa”.
RESOLVED further, that copies of this Resolution be furnished to Honorable City Mayor Lucilo R.
Bayron, the City Administrator, the City Legal Officer, and the City Information Officer, all of this
City, for their information and appropriate action.
