    JOINT AFFIDAVIT OF ADVERSE CLAIM

    We, LUCRECIA BARING and DIOSCORO BARING, of legal ages,


    Filipinos, each married, and residents of Suba Masulog, Basak, Lapu-Lapu
    City, are some of the heirs of the late JULIAN BARING;

    We, REYMUNDO BARING and BONIFACIO EYAS, of legal ages,


    Filipinos, each married, and residents Soong, Lapu-Lapu City, are some of
    the heirs of the late FELIPE BARING;

    We, AQUILINO BARING and NICOLAS BARING, of legal ages,


    Filipinos, each married, and residents of Mactan Proper, Lapu-Lapu City, are
    some of the heirs of the late MONICO BARING;

    In this Joint Affidavit of Adverse Claim, after having been sworn to in


    accordance with law, we depose and say:

    1. That we are the representatives of the Heirs of Julian Baring,


    Heirs of Felipe Baring, and Monico Baring, respectively;

    2. That our predecessors are the lawful owners of Lot 3789-C,


    more particularly described as follows:

    “A parcel of land situated in the Barrio of Mactan, Lapu-Lapu


    City, Philippines (Lot 3789-C of the subdivision plan Psd-
    74631, being a portion of Lot 3789 of the Cadastral Survey of
    Opon, LRC Res. No. 1004); containing an area of NINE
    THOUSAND TWO HUNDRED FORTY SIX (9,246) square
    meters. Covered by Transfer Certificate of Title No. 110-
    2018003025 , in the name of M & J SONS REALTY AND
    HOLDINGS COMPANY.”;

    3. That we discovered that the abovementioned lot was sold by


    only three (3) heirs representing Hipolita Dihayco namely, SABINO
    BARING, EUSTAQUID REMULTA, and EUGENIO BARING, without
    the knowledge and express consent of Julian Baring, Felipe Baring, and
    Monico Baring, the other heirs of Hipolita Dihayco and our predecessors-in-
    interest;

    4. That we discovered about the sale only very recently when some
    people started to develop the property by building improvements thereon;

    5. That we hereby declare our rights over our pro-indiviso shares
    corresponding to the undivided shares of our predecessors-in-interest,
    Julian, Felipe, and Monico, all surnamed Baring;

    6. That we execute this Affidavit in order to record our adverse


    claim over the real property covered by Transfer Certificate of Title No. 110-
    2018003025, which obviously is the title issued as a result of the
    unauthorized sale; and

    7. That unless an adverse claim is annotated on the afore-described


    Transfer Certificate of Title, we, the heirs of Julian Baring, Felipe Baring,
    and Monico Baring, will be in danger of being defrauded and deprived of our
    just and valid right over the abovementioned parcel of land.

    FURTHER AFFIANTS SAYETH NAUGHT.

    IN WITNESS WHEREOF, we have hereunto set our hand this
