    IO has filed a report mentioning that the department i.e.


    CBI is under process of scrutinizing the last order dated
    18.10.2019, so as to take decision, if they want to comply with it or
    they would prefer to challenge such order. IO seeks one month
    time for the same. It is also mentioned in the report that the
    Defence Procurement Manual, applicable prior to 2006, is not
    traceable as per information received from Ministry of Defence.
    As far as production of Crime File is concerned, time is
    being granted to CBI to take their decision. However, it shall be
    expected that before next date of hearing they would take a final
    stand and shall act accordingly.
    As far as Defence Procurement Manual, applicable
    prior to 2006, is concerned, the case in hand related to such
    procurements prior to the year 2006. In these circumstances, in
    order to appreciate the transactions, which took place in such
    procurement, needed to be assessed on the parameters of
    Defence Procurement Manual, which were applicable at the
    relevant time. This is a bit surprising and shocking to see that CBI
    has completed investigation even without laying hand over such

    manual, so as to make the relevant assessment. How such
    transactions were assessed without taking inputs from the relevant
    procurement manual, is a question, which needs to be answered
    by CBI.
    The report filed by HIO today shows that CBI has now
    literally surrendered, as far as obtaining this manual, which was
    relevant at the relevant time, is concerned. Therefore, I need to
    know the stand of CBI in respect of aforesaid question raised by
    me. A specific report in respect of aforesaid question shall be filed
    on next date. Copy of this order be handed over to HIO, who shall
    deliver it upon concerned ld. Joint Director and it is expected that a
    complete inquiry shall be made by the responsible officers before
    filing any report to this court.
