    Accused.

    MOTION FOR BAIL PENDING CASE INVESTIGATION

      THE ACCUSED, by counsel, respectfully moves to be allowed to post bail on
    the ground that a person in custody may apply for bail pending case investigation. In
    support, he respectfully submits that:

    1. The accused, DISIDIDO D. MUFASA, was arrested without a warrant of
    arrest on September 17, 2019 (Tuesday) at around 1:15 in the morning.

    2. The  accused  has  been  detained  at  the  Bureau of Jail  Management  and
    Penology (BJMP) since his arrest on the said day.

    3. On the same day (September 17, 2019), the accused availed of his right to
    a   preliminary   investigation   and   executed   a   waiver   of   his   rights   under
    Article 125 of the Revised Penal Code;

    4. Pending   preliminary   investigation,   the   accused   may   apply   for   bail


    pursuant  to  Rule  112, Section   7 (2nd  paragraph)   of the  Rules   of Court
    provides:
    Section 7. When accused lawfully arrested without warrant. x x x
    Before the complaint or information is filed, the person arrested
    may ask for a preliminary  investigation  in accordance  with this
    Rule, but he must sign a waiver of the provisions of Article 125 of
    the   Revised   Penal   Code,   as   amended,   in   the   presence   of   his
    counsel. Notwithstanding the waiver, he may apply for bail and
    the investigation must be terminated within fifteen (15) days from
    its inception.

    5. Moreover, accused is entitled to bail as a matter of right under Rule 114,
    Section 4 of the Rules of Court, to wit:

    Sec.   4.  Bail,   a   matter   of   right;   exception.   —  All   persons   in


    custody   shall   be   admitted   to   bail   as   a   matter   of   right,   with
    sufficient sureties, or released on recognize as prescribed by law or
    this Rule (a) before or after conviction by the Metropolitan Trial
    Court, Municipal Trial Court, Municipal Trial Court in Cities, or
    Municipal Circuit Trial Court, and (b)  before conviction by the
    Regional Trial Court of an offense not punishable by death,
    reclusion perpetua, or life imprisonment.

    6. Section 17 (c) of the same Rule provides:

    Section 17. Bail, where filed. –
    (c) Any person in custody who is not yet charged in court may
    apply   for   bail   with   any   court   in   the   province,   city,   or
    municipality where he is held. 

    7. Thus, notwithstanding that there was yet no information filed before the
    appropriate court, the accused, as a matter of right, is not precluded from
    posting bail pending case investigation.

    For these reasons, DISIDIDO D. MUFASA, the accused, should be granted bail,
    as a matter of right. 
    WHEREFORE,   it   is   respectfully   prayed   that   the   accused  DISIDIDO   D.
    MUFASA be allowed to post bail pending investigation of the case against him. 

    Other just and equitable reliefs are also prayed for.
