Can I apply for a work permit from


inside Canada?
Only in some cases. You can only apply for a work permit from inside Canada if:

 you, your spouse or parents have a valid study or work permit,


 you have a work permit for one job but want to apply for a work permit for a
different job,
 you have a temporary resident permit that is valid for six months or more, or
 you are in Canada because you have already applied for permanent residence
from inside Canada. You will have to pass certain stages in the main application
process before you can be eligible for a work permit.

There are other requirements as well.

If you are already in Canada as a visitor, you may not apply within Canada. You
must apply for a work permit at a Canadian visa office:

 responsible for the country where you live,


 responsible for the country you are a citizen of, or
 at a Canadian embassy or consulate in the United States of America.

You may be asked to go for an in-person interview at that office. If so, make sure you
have all the documents you need to enter that country.

You must check:

 whether you need to fill out any other forms or provide any other documents, and
 how to pay the fee (visa offices do not accept fee payment receipts from
banks in Canada).

You are a business visitor if you plan to visit Canada temporarily to:

 look for ways to grow your business,


 invest or
 advance your business relationships.

If you are a business visitor, you may need to apply for an eTA or a visa to come to
Canada. Find out if you need an eTA or a visa.

If you need an eTA, you should:

 get it when you plan your trip – do not wait for the last minute to apply, and
 travel to Canada with the passport you used to get your eTA.

If you need a visitor visa, you must send certain documents with your application:

 a letter of invitation from your potential business partner in Canada; and

You may also need identification cards or proof that you have a job.

As a business visitor, you must show that:

 you plan to stay for less than six months,


 you do not plan to enter the Canadian labour market,
 your main place of business, and source of income and profits, is outside
Canada,
 you have documents that support your application and
 you meet Canada’s basic entry requirements, because you
o have a valid travel document, such as a passport,
o have enough money for your stay and to return home,
o plan to leave Canada at the end of your visit and
o are not a criminal, security or health risk to Canadians.

Cross-border business can include:

 buying Canadian goods or services for a foreign business or government,


 taking orders for goods or services,
 going to meetings, conferences, conventions or trade fairs,
 giving after-sales service (managing, not doing hands-on labour),
 being trained by a Canadian parent company that you work for outside Canada,
 training employees of a Canadian branch of a foreign company or
 being trained by a Canadian company that has sold you equipment or services.

Under the North American Free Trade Agreement, a U.S. or Mexican national may also
take part in other activities, such as research, marketing and general services. For more

If you plan to stay longer than six months or plan to work in Canada, you may be
considered a temporary worker and have to apply for a work permit.

Can I apply for a work permit when I


enter Canada?
You can apply for a work permit when you enter Canada if you

 do not need a temporary resident visa;


 have all the required documents; and
 meet the requirements for the type of work permit you are applying for.

An officer will make sure you meet all the requirements before you are allowed to enter
Canada.

To apply for a work permit when you enter Canada, you must bring with you

 your job offer and a positive Labour Market Impact Assessment (LMIA), which is a
document from Employment and Social Development Canada that says the employer is
allowed hire you; or
 the offer of employment number that your employer received when they submitted the
offer of employment through the Employer Portal if an LMIA is not needed.

You will also need

 proof that you meet the qualifications and experience for the job you will do in Canada;
 proof that you do not need an LMIA for the job you will do, if applicable;
 a valid medical certificate if you need it for your job or if you are from a designated
country; and
 a valid passport or other travel document.

You do not need to provide any documents from an employer if you are

 exempt from the LMIA process; and


 applying for an open work permit.
If you want to work in Quebec, you may also need a Certificat d’acceptation du
Québec (CAQ) from the Ministère de l’Immigration, de la Diversité et de l’Inclusion.

If you are exempt from the LMIA process, you are also exempt from the CAQ
requirement.

Francophones working outside Quebec


If this is your first work permit under an LMIA exemption for Francophones working
outside Quebec, you must:

 fill out the Application for Work Permit Made Outside Canada, and
 apply online or to a Visa Application Center (VAC).

Assessment?
A Labour Market Impact Assessment (LMIA) is a document that an employer in
Canada may need to get before hiring a foreign worker.

A positive LMIA will show that there is a need for a foreign worker to fill the job. It will
also show that no Canadian worker is available to do the job. A positive LMIA is
sometimes called a confirmation letter.

If the employer needs an LMIA, they must apply for one.

Once an employer gets the LMIA, the worker can apply for a work permit.

To apply for a work permit, a worker needs:

 a job offer letter,


 a contract,
 a copy of the LMIA, and
 the LMIA number.
