Notification
Jammu, the 18th January, 2016.

SRO-18.––In exercise of the powers conferred by section 111 read


with sub-section (3) of section 110 and section 176 of the Motor Vehicles
Act, 1988 (59 of 1988), the Government hereby make the following
amendments in the Jammu and Kashmir Motor Vehicles Rules, 1991, the
same having been previously published vide Notification SRO-250

dated 11-08-2011 and SRO-250 dated 13-02-2012 as required under
section 212 of the Motor Vehicles Act, 1988 :––

1. Amendment in Rule 274–A.––In sub-rule (1), for the words


“No vehicle”, the words “No Commercial Vehicle”, shall be
substituted ;

In sub-rule (2), for the figures ‘5000’, ‘7000’ and ‘10,000’, the
figures ‘10,000’, ‘12,000’ and ‘15,000’ shall be substituted
respectively ;

After sub-rule (2), the following shall be added as sub-rules


(3), (4), (5) & (6),––

“3. “Non-Commercial Vehicle” shall be sold by a Trade


Certificate Holder (authorized dealer) after approval from
the Transport Commissioner, J&K :

Provided that where any Trade Certificate Holder is found


to have sold any vehicle which has not been introduced in
the transport system of the State, the registering authority
shall suspend the trade certificate of the certificate holder
forthwith and recover a composition fee of Rs. 1.00 lac
per vehicle from the certificate holder and the trade
certificate shall remain suspended till the composition fee
is deposited.

4. The vehicle manufacturer or any authorized person on


his behalf shall submit an application for each model to the
Transport Commissioner, J&K for seeking introduction of
the vehicle/model along with certificate of any testing
agency of Government of India (Like ARAI, ICAT etc.)
besides approved AUTO CAD/Schematic drawings and
followings fee :––

1. Two Wheelers Rs. 5000/-

2. Light Motor Vehicles Rs. 7000/-

3. Medium Motor Vehicles Rs. 10,000/-

5. The Transport Commissioner, after satisfying himself
with regard to authenticity of the certification and capacity
of the company to provide adequate services for the model
and make of the proposed vehicle in the State shall issue
approval within a period of 15 working days of filling the
required details in his office.

6. The type of vehicle once approved under sub-rules (3)


to (5) of rule 274-A shall not be considered for conversion
into categories of vehicles approved under sub-rules (1)
and (2) of rule 274-A.”
