AFFIDAVIT

I, SAMUEL PASCUAL, forty-five years old, married, and a


resident of No. 2346 Barangay 245, Pasay City, after having
been duly sworn to in accordance with law hereby disposes and
say THAT:

1. I am the neighbor and best friend of herein respondent


in Criminal Case NPS Doc No. NCR-04-INQ-17090908 for the
crime of Rape.

2. On November 28, 2019, at 8 o’clock in the evening, I


approached the respondent and asked him if he would like to
work in the construction site operated by my company as a
replacement for our plumber who was confined in San Lazaro
Hospital for allegedly showing symptoms of Novel coronavirus
(2019-nCoV). The construction site is at Brgy. 169 Caloocan
City.

3. On November 29, 2019, respondent relayed his


acceptance of the employment offer to me. I informed him that
his work will start on December 2, 2019.

4. On December 2, 2019, at around 4:45 in the morning, I


went to respondent’s house at No. 2345 Barangay 245, Pasay
City to fetch the respondent so that we could go to the project
site together. At exactly 5 o’clock in the morning, we left
respondent’s house. I saw respondent kiss his wife (Apple Jade
Licuanan, For brevity Apple) and we boarded a jeepney bound
for Monumento at around 5:10 in the morning.

5. After boarding the jeepney, I saw respondent conduct a


“video call” with his wife. He informed her that we were on our
way to Monumento.

6. At around 7 o’clock in the morning, respondent and I


arrived at the Condominium construction site at Brgy. 169
Caloocan City.

7. After we arrived at the construction site, I introduced


respondent to Project manager/Supervisor Engr. Jennifer
Navarro (For brevity, Jenny) who welcomed respondent to the

construction site. She then let respondent sign the employment
contract.

8. After signing the employment contract, respondent


started working and finished at 4 o’clock in the afternoon.

9. After respondent’s work shift, respondent and I went


home together and arrived at our respective houses at around
6 o’clock in the evening.

10. At around 6:30 in the evening, while watching


television programs with my family, I was alarmed by the sound
of police sirens blaring outside respondent’s house. Through
our window, I saw police officers knock on respondent’s door
and talk to him although I did not hear what either respondent
or the police officers said. After a few minutes, I then saw
respondent go with the police officers, enter the police vehicle,
and sped away.

11. I am executing this Affidavit to attest to the truth of


the foregoing facts and that the highest interest of justice will
be served.

IN WITNESS WHEREFORE, I have hereunto set my hand and


this 3rd day of December 2019, at Pasay City, Philippines.
