Assignment no. 3

Case
This story happened under the Diocese of Legazpi specifically under the Parish of St.
Nepomuceno in Bonga, Bacacay, Albay. Antonio was a bachelor from a nearby barangay
before he met Lydia in Bonga, Bacacay on one occasion. When he met Lydia for the first time,
he immediately got a feeling with her. It seems that it was love at first sight. He immediately
inquired about her background and where she lives. Luckily, the sister of Antonio was living at
the same barangay where Lydia is.
Antonio started to makes friends with her and started to visit her in their house from time
to time. It takes more than a year before they became officially boyfriend and girlfriend. Since
Antonio was courting Lydia for almost two years, he decided to ask her for an engagement. At
first, the woman was very hesitant for the engagement since she is not yet ready for that even
though both of them were already in their late 30’s. But the family of Lydia advised her that
she’s getting old already and she’s at the right age already to decide for herself. Because of the
pieces of advice of her family member, she accepted the proposal of engagement. Both families
agreed upon and decided when will be the schedule for their wedding. Since they were already
engaged with each other Antonio did all his best to make her happy with their relationship. The
woman also looks happy especially when they go for a date. People from their place commented
that they will become a good and lovely couple soon since both of their families were not against
their relationship.
Here comes the day of their wedding in June 2005. It was really extravagant and
beautiful. They invited all their relatives and friends for this very special event in their lives to
witness their union as husband and wife in St. John Nepomuceno Parish, Bonga, Bacacay,
Albay.
After the celebration, the people were congratulating them and giving them best wishes
as they will start a new chapter in life. But an unsurprising event happened during their
honeymoon. Their families, relatives, and friends were expecting that there will be a honeymoon
until the next day they have heard that nothing happened during their honeymoon. Out of
curiosity, the sister of Antonio asked him what had happened? Antonio told his sister that his
wife doesn’t like to make love with him. Lydia left him and stayed in the other house where her
other siblings lived during that night. It was very disappointing in the part of Antonio upon
realizing that his wife doesn’t like to make love with him. He attempted many times if they could
have sex as husband and wife but the woman refused many times. Until one day, the woman left
him without notice. No consummation happened to them as husband and wife.
The family and relatives of Antonio were very disappointed about what had happened.
They said that they spent a lot of money on their wedding and yet everything went for nothing.
Until after how many months Lydia left. They received news that Lydia was living with another
woman that shocked Antonio and her family. It was already late when they found out that Lydia
prepares a woman than a man. Because of this, Antonio was brokenhearted and never expected
that the woman he loves was a lesbian. Antonio left his hometown and went to Manila to forget
his wife. After several years, he found another woman to whom he fell in love for the second
time. Antonio and his new live-in partner were living happily together. Right now, Antonio has a
child from his live-in partner. Even though Antonio wants to marry her in the Church but
because he was already married before he couldn’t pursue his dream. One of the problems that
trouble him to marry her in the Church was due to a financial problem to file for an annulment
case against his first wife.

Ground for annulment


Based on Canon 1095 no. 3 - Those who are not able to assume the essential obligations of
marriage for causes of a psychic nature.
- The psychological problem in the part of Lydia since she prepared women than a man
before their marriage.
Based on Can.  1096 §1. For matrimonial consent to exist, the contracting parties must be at least
not ignorant that marriage is a permanent partnership between a man and a woman ordered to the
procreation of offspring by means of some sexual cooperation.
- No consummation happened during their honeymoon since Lydia doesn’t like it.
