SC MANDAMUS (March 02, 2011)

The MMDA
1. on or before June 30, 2011 –
a. submit to the court the names and address of the informal
settlers in Metro Manila who as of December 31, 2010, own ,
occupy houses, structures, constructions and other encroachment
established or built along the Pasig-Marikina-San Juan Rivers, The
NCR (Paranaque-Zapote, Las Pinas) rivers, and the Navotas-
Malabon-Tullahan-Tenejeros Rivers, and connecting waterways and
esteros (violation of RA 7279 and other applicable laws).

b. submit removal plans for identified informal settlers and the


demolition of the aforesaid houses, structures, constructions and
encroachments, as well as completion dates for said activities,

-shall direct all LGU’s in Metro Manila, Rizal, Laguna, Cavite, Bulacan,
Pampanga, and Bataan to inspect all factories, commercial
establishment, and private homes along the banks of the major river

water ways that eventually discharge water into the Manila Bay to
determine whether they have wastewater treatment facilities or
hygienic septic tanks as prescribed by existing laws, ordinances,
and rules and regulations.

-The DILG is required to submit a five year plan of action that


will contain measures intended to ensure compliance of all non-
complying factories, commercial establishments, and private
homes.

respective compliance reports which will contain the names and
address or offices of the owners of all complying factories,
commercial establishments and private homes copy furnished the
concerned environmental agency, be it the local DENR Office or the
Laguna Lake Development Authority.

 Section 2 – Water Rights Over Laguna de bay and other
water bodies of water within the Lake Region. -
” To effectively regulate and monitor activities in the
Laguna de Bay region, the Authority shall have
exclusive jurisdiction to issue permit for the use of all
surface water for any projects or activities in or
affecting the said region including navigation,
construction and operation of fishpens, fish enclosures,
fish corrals and the like.

For the purpose of this Executive Order, the term


“Laguna de bay Region” shall refer to the
Province of Rizal and Laguna; the cities of San
Pablo, Pasay, Caloocan, Quezon , Manila and Tagaytay;
the towns of Tanauan, Sto. Tomas and Malvar in
Batangas Province; and the towns of Marikina , Pasig,
Taguig, Muntinlupa and Pateros in Metro Manila.”
