Subject: Explanation Letter

To: 1LT CARMELO R. ENOLVA JR (INF) PA


Headquarters Commandant

In compliance with the Memorandum dated June 8, 2020, the undersigned was
directed to submit an explanation within 24hrs from receipt regarding my alleged
violation committed under Articles of War 64, 66 and 97, respectively.

With all due respect, the allegation related to Article of War 64 is utterly FALSE. I
admit that I received counselling conducted by PA Commanding Officer LTC Joey
Baybayan and TSg Ronnie T Pama, with respect to family problems. Nonetheless, I believe
that I responded to all questions with due care and in accordance with what is good and
what is right. In fact, I took the advice positively most especially when the same is
connected to family relations; a copy of the voice recording is hereto attached as
ANNEX “A”.

Contrary to the language used in charging me with violation of Article of War 66, I
never intend to insult any of my colleagues nor disrespect anyone through my language
“Kung idadamay ang unit, Hindi naman siguro tayu ganun ka Bobo kung civilian
lang ang mag ano sa atin dito”. The same is just an explanation regarding the text
messages which allegedly received by our unit that I have a death threat since February
2020. At the risk of being repetitive, I have a very high respect to the council and I
submitted myself to the rules and regulations of the Armed Forces of the Philippines
(AFP).

Most importantly, after I was assaulted by PA Pama, I was also threatened by


saying “HINDI KITA PATUTULUGIN DUMUHO KA PATAYIN KITA GAGO KA” “ANO
GUSTO MONG MANGYARI PAGBIBIGYAN KITA”. Thinking that my life will be put in
jeopardy, I immediately proceeded to the PNP Bayugan Police Station as I was already
disarmed at that time. Thereafter and in compliance with the instruction of the PAO
Lawyer in order to record the incident, the same was likewise reported before the
Barangay of Noli, Bayugan City, Agusan Del Sur. Again, I have no intention whatsoever to
by-pass the jurisdiction and judgment of the Chain of Command and NCO Support
Council by filing a complaint against comrade to the Barangay council without any
consent and permission from the headquarter, Commanding Officer. The same were all
products of securing my life in accordance with the instruction of a PAO Lawyer; a copy
of the Medical Certificate dated June 2, 2020 is hereto attached as ANNEX “2”.

Finally, that I reserve my right to be represented by competent counsel during the


entire formal proceeding of this incident.
