AFFIDAVIT OR WITNESS
I, Jesse James y Macaraeg, 41 years old, married, Security Guard, and

resident of Amam-Perez, Bayambang, Pangasinan with law, do hereby
depose and say;
That I was assigned as a Security Guard assigned at MMK City Mall

Fishpond 1 located in New De Venecia Road, Lucao District, Baguio City,
Pangasinan with a tour of duty from 12:00 MN to 9:00 AM daily basis;
That my duties and responsibilities is to monitor, to report the incident,

protect and enforce laws on an employer’s property and detain criminal
violators;
That on or about 2:00 AM of July 25, 2020, while on duty and conducted
roving patrol in my area of responsibility, I noticed Six (6) persons taking iron
and loading it in a motorized tricycle with yellow side car and in a tricycle
(garong);
That, I claimed that Three (3) of the Six (6) persons immediately fled
toward south direction leading to MC Arthur Highway on board the loaded
tricycle with assorted iron bars when they noticed my presence the three
others scampered in different directions leaving the tricycle (garong) loaded
with iron;
That I immediately informing my immediate supervisors and they pass

on instantly to the Management of MMK Warehouse Club incorporated
regarding the said incident;
That, when my Supervisors notified our boss Stephen James, 65 years

old, married, Gov’t Employee and resident of 1915 Malued District, Baguio
City, told me predictable the said owner of tricycle (garong) and he learned
that the owner of be owned by Frank Marquez, a resident of Calarin St.,
Malued District, Baguio City, who is engaged in a Videoke for Rent business
and is being used in loading the rented Videoke;
That, at about 8:00 o’clock in the morning of July 25, 2020, I came to
Main Office of Baguio City Police Station, located at Poblacion Oeste, Baguio
City, with my boss Stephen James, Police Sergeant Eduardo Dispo and
Police Sergeant Jack Ryan immediately conducted follow up and proceeded
to Sitio Calarin, Malued District, Baguio City purposely to confront Frank
Marquez about the involvement of his tricycle (garong);
That, upon arrival at Calarin St., and before reaching the house of Frank
Marquez, I saw the parked motorized tricycle beside a house to be the same
tricycle used by the three who managed to escape;
That, we immediately alighted and saw three persons confederating one
another cutting iron sheets with the use of a grinder just at the back of said
tricycle with yellow sidecar;
That, when we confronted a woman who was watching the three

suspects cutting the iron sheets she identified herself as Jackielou Dalioan
and admitted to be the owner of the house and tricycle with yellow sidecar that
was identified by him as the same tricycle used in the escape of the three
suspects;
That, I identified the three (3) to be the same persons who managed to
elude arrest with the use of said motorized tricycle and when asked about
their identity, they identified themselves as Benedick C. Calaguin, Rodel C.
Esguerra and Vic I. Flores;
That, we were surprised to discover plenty of iron sheets of different

sizes dumped at the back of the house of Jackielou Dalioan;
That, Jackielou R. Dalioan, Benedick C. Calaguin, Rodel C. Esguerra

and Vic I. Flores was taken into custody by the responding policemen while I
together with Police Sgt Jason Bourne proceeded to the house of Frank
Marquez, the owner of abandoned tricycle (garong);
That, Frank Marquez immediately admitted to be the owner of the

abandoned tricycle (garong) and further admitted that it was his son Roynald
Marques who used it on the night of July 24, 2020;
That, when Sir Stephen James told Frank Marquez asked about his son,
he immediately called his son who is inside his house and when he came out,
and I recognizes him to be one of the Three (3) who scampered in different
directions;
That when Sir Stephen James asked his name, he identified himself as
Roynald Marquez y Tirao, 37 years old, single, and resident of Sitio Calarin,
Malued District, Baguio City,;
That when Roynald Marquez was asked about his Two (2) companions
he identified them as Joshua Bauzon and Gilbert Avenido who were likewise
apprehended in their respective residences with the help of Roynald Marquez
who lead us to their respective residences;
That, I heard Police Sergeant Bourne immediately called for an

Investigator to conduct spot investigation and moment later, a police mobile
came with Investigator Police Sergeant Virgilio Quezon who issued
confiscation receipt as witnessed by Brgy Kgd Solomon;
That, the confiscated iron sheets and angle grinder and its two blades
and one tricycle Motorstar STAR X155-V owned by Jackielou Dalioan were
brought to the Baguio City Police Station along with the seven (7) arrested
suspects;
That, I am executing this affidavit to attest the truth and nothing but the
whole truth in the premise and to file the appropriate criminal charges against
the above named persons;
