    JOINT COUNTER-AFFIDAVIT

    We, JOHN JET LEE NOCIETE, JOHNNY NOCIETE, JR.,


    JOHNNY NOCIETE SR., and JULIET NOCIETE, all of legal
    age and all are residents of Brgy. Supa, San Jose De
    Buenavista, Antique, after having been duly sworn to in
    accordance with law, do hereby depose and say that:

    1. We, JOHN JET LEE NOCIETE, JOHNNY NOCIETE, JR.,


    JOHNNY NOCIETE SR., and JULIET NOCIETE have been
    made respondents in the abovementioned complaint;
    2. That on October 08, 2020, we received a subpoena from
    the OFFICE OF THE PROVINCIAL PROSECUTOR
    requiring us to submit a counter-affidavit within ten (10)
    days from receipt of the same;
    3. The charge is based on the allegations and affidavits of
    the complainant that we mauled her minor son,
    Frederick B. Celiz, Jr. on August 30, 2020.;
    4. We strongly deny the allegations in the Complaint
    affidavit of Christine Celiz y Barcemo that we mauled
    Frederick B. Celiz, Jr for being untrue, malicious and
    unfounded.
    5. We strongly deny the allegations in the Judicial affidavit
    of Frederick B. Celiz that we mauled him on August 30,
    2020. We also deny the allegation that Mr. Johnny
    Nociete, Sr., pointed a gun at him at the same date for
    being untrue, malicious and unfounded.
    6. That on the day of August 30, 2020, at around 8:00 in
    the evening, we were all inside our house at Brgy. Supa,
    San Jose, Antique except for John Jet Lee Nociete who
    was at Anteco Compound, Brgy. Atabay, San Jose,
    Antique, see (ANNEXES “1 and 2”).
    7. . We were startled when somebody started shouting
    outside our house. When we went to check who was
    shouting, we saw that it was Mr. Frederick Celiz, Sr., his
    wife, Christine Celiz and their child, Frederick Celiz, Jr.
    They were challenging us to go out of our house for a fist
    fight. They also threatened to kill us, see (ANNEX “3”).
    8. That it was Johnny Nociete, Jr., was the one who
    checked what was happening outside. That when he was
    opening the gate, Christine Celiz y Barcemo suddenly
    attacked him. Luckily, Johnny Nociete, Jr., was able to
    defend himself and flee and only sustain minor injuries,
    see (ANNEX “4”).
    9. The complaint is purely made to harass and maliciously
    tarnish our reputation.
    10.That we are executing this Counter-Affidavit for the
    purpose of attesting to the truth of the forgoing
    statements. To inform the proper authorities of the above
    facts, to support the dismissal or dropping of the instant
    case against us and for whatever legal purpose this may
    serve best.
