INTRODUCTION
This was a civil miscellaneous appeal under Order XLIII Rule I(q) of the Code of Civil
Procedure, 1908 (CPC)) by defendant whereunder the Court of Additional District Judge,
Rajahmundry, directed to issue warrant of attachment before judgement in 2008.

When we look into the matter of the fact in aforementioned case then we find that the case is
totally based on the Order XXXVIII Rule 5 and Rule 6 of the CPC which talks about the
attachment of property before the judgement. So, in my research work I’ll be majorly
discussing about the provisions laid down under the Order XXXVIII and Order XLIII.

AIMS AND OBJECTIVE


The researcher tends to analyze

1. The legal complexities discussed by the court in the aforementioned case.


2. The provisions of CPC which are being laid down in the case.
