ARBITARTION – ARBITRATOR (AKASH)

Good Evening Everyone

I welcome both the parties in the case of Charan Singh Chaudhary, MD of Mumbai Hospital v.
Keshav Singh at this 5th hearing. Let the record reflect that the issue to be resolved is regarding
the application filed on behalf of the hospital authorities under section 17 of the Indian
Arbitration Act, 1996 for an order of injunction to restrain the respondent from practicing his
profession for two years in the city of Mumbai and also to pay damages to the tune of Rs.
23,00,00 Lakhs which is the salary given to the respondent at the termination of his services by
the hospital.

As per the procedure agreed by the parties, the rules of Indian Evidence Act will be taken into
account to check the veracity of the documents produced. I invite the counsel of plaintiff to make
his submission.

I now invite the counsel of the respondent to make his submission.

ORDER

After hearing all the arguments put forth before this tribunal, I cannot agree with the contention
put forth by the side of petitioners. Therefore, this tribunal sees no merit in the application filed
by the petitioners and hence dismiss the same with no costs.
