GENERAL CONDITIONS
1. Sealed tenders should be addressed to Chief Manager, (P&D) Regional Office, Jaunpur (U'p.) and
superscribed NAME OF WORK - FURNISHING & ELECTRICAL WORKS FOR UNION BANK OF INDIA
AT VIKAS BHWAN Branch and ATM, JAUNPUR and should reach the office before 4.00 P.M. on 10-10-
2019
2. No tenders shall be received after 4.00 P.M. on 10-10-2019and the tenders shall be opened on the same
day at 5:00 P.M. unless otherwise informed.
3. Any clarification (in writing) whatsoever shall be sought from the Architect, minimum two days before the
tender submission date.
4. The tenders shall remain valid for a period of 30 Days from the date of opening of tenders. Bank reserves
the right to accept or reject any or all the tenders without assigning any reason to do so.
5. At the time of submission, every tender must be accompanied by a Demand Draft of as mentioned above
in favour of Union Bank of India payable at JAUNPUR (U.P.) as earnest money. No interest shall be paid
on earnest money. Any tender which is not accompanied by the earnest money shall be summarily
rejected.
6. The tenders should quote the rates in figures as well as in words.
7. All erasures and alterations made while filling the tender must be attested by initials of tenderer.
Overwritingof the figures in not permitted.
8. The earnest money deposit of unsuccessful tenderers shall be returned after the tender is decided or on
expiry of validity period.
9. The earnest money of the successful tender shall be adjusted in the initial security deposit.
10. The UBI, Nodal Regional Office, Union Bank of India, 1st Floor, Hotel River View, Jaunpur (U.P.) reserves
the right to reject any or all the tenders, accept part of any tender or entrust the entire work to any
contractor or divide the work to more than one contractor (item wise) without assigning any reason or
giving any explanation. The rates quoted by the contractor shall hold good for this bifurcation and no
compensationshall be paid on this account.
11. Joint tenders shall not be considered.
12. On receipt of intimation from the Bank, the acceptance of his tender, the tenderer within 7 days should
submit his acceptance of the work order. If the successful tenderer fails to undertake the work, the earnest
money deposited by him shall be forfeited and acceptance of his tender may be withdrawn.
13. The rates quoted in the tender shall include all charges of materials, shifting of furniture, scaffolding I
ladder, lift up and down, mechanical transportation, loading, unloading, any or special tools and plants,
railway freight, labour, taxes etc. It shall also take care for all conditions and fluctuation in the material and
labour rates, excise duty, sales tax, trade tax, service tax, cartage, octroi and any other taxes or
expenditurefor carrying out the work.
14. The rates quoted in the tender shall also include for the charges for carrying out various types of
laboratoryI site tests for different types of materials.
15. The contractor shall arrange water and electricity for completing the work.
16. No escalation in rates shall be allowed under any circumstances.
17. The successful tenderer is bound to carry out entire work within the period stipulated in the Appendix. The
tenderer shall have to pay liquidated damages for non-completionof job within stipulated period at the rate
of 1% of the contract value for every month of delay up to 6 months and 2% for every month, thereafter.
18. The liquidated damages as mentioned above may not be enforced if the contractor applies for extension of
time mentioning the reasons for extension. Extension of time in days shall be granted by the Bank if it is
proved that contractor is not at fault for extending the work beyond stipulated date of completion.

19. The successful tenderer is bound to carry out items of work necessary for completion of job even though
the same are not included in the schedule of quantity. Rates of extra items shall be derived from the
tender. In case the rates do not exist in the tender and extra item is not similar to tender item, then the
rates shall be worked out on the prevailing market cost of material and labour, including wastage plus 10%
towards tax and Contractor's profit.
20. The Contractor must co-operate with other contractors appointed by the Bank so that entire work shall
proceed smoothly with least possible delay and to the satisfaction of the Bank
21. The Contractor shall remove all malba etc. wash and clean the floors regularly at his own cost and hand
over the site in proper manner on the completion of work.
22. The tenderer is advised to visit the site and acquaint himself with the site conditions, making his own
arrangement for storing of material at site, lift, cartage, etc.
23. The initial security deposit shall be made, @ 2% of the accepted contract value less (subtracting) earnest
money deposit, by the successful tenderer within 7 days of acceptance of his tender through Bank Draft in
favor of Union Bank of India Payable at Jaunpur
24. The successful tenderer shall have to enter in to an agreement with the Bank.
25. 10% of the value of work done shall be deducted as retention money from the interim payments made to
the contractor, and shall be retained for defects liability period (as mentioned in the Appendix) and shall be
released after the defects liability period, provided no defects are noticed during the period. This retention
money along with earnest money deposit and initial security deposit would make the security deposit to be
deposited by the contractor for 12 months after work completion.
The security deposit shall be worked out as under-
For first RS.1.0lakh of the estimated cost -@ 10.0%
For next Rs. 2.0 lakh of the estimated cost -@07.5%
For remaining part of the estimated cost up to Rs. 2.0 Crore - @ 05.0%
It shall be subjected to a maximum of Rs. 5.0 lakh.
26. The contractor shall attend to all defects noticed during defects liability period. If the contractor fails to
attend the defects, these defects shall be rectified by the Bank and the expenditure incurred on this
account shall be recovered from security deposit.
27. The contractor shall make adequate arrangement for watch and ward of his material and shall ensure the
safety, breakage and any theft of materials fixed or unfixed by him or other sub-contractors.
28. The work executed should be got approved by the Bank and contractor shall rectify any bad workmanship
pointed out at any stage and remove from site all the rejected materials immediately.
29. The contractor shall be responsible for application of labour laws, compensation for injury and accident to
person, whether employed by him or by his sub-contractor.
30. The contractor shall take necessary precautions for carrying out the work avoiding any damage to
structures/decorative parts of the property. The contractor shall rectify any damages done at his cost.
31. The contractor shall ensure that workmen employed by him for execution of work are suitably covered
against Workmen's Compensation Act and that all liabilities arising out of Workmen's Compensation Act,
ESIS and other legislative enactment application to such works and workmen shall be to the contractor's
account. The contractor shall also ensure that he has gone under the cover of all sorts of insurances that
are subjected to the said job, before commencing the job.
32. Furnishing, Civil, Water Supply & Sanitary, Electrical and Demolition works shall be carried out as per
drawings I specifications and to the entire satisfaction of the Bank

33. The contractor shall give due notice to the Bank to check measurements of any work which is likely to be
hidden before covering the same.
34. The contractor shall submit running bills for the value of work done not less than interim payment (as
mentioned in the Appendix) mentioning full nomenclatures of items, rates, amount, measurements sheets,
reasons for part rates claimed, if any.
35. In case of non-completion or delay in completion of work or removal of defects in time, the bank shall be
free to appoint another agency to get the job done at contractor's risk and cost.
36. For fixed as well as loose furniture, rates quoted by the contractor shall be inclusive of all taxes, including
sales tax, trade tax, octroi, transportation etc. and no extra amount shall be paid on this account.
37. Income-tax at the rate as applicable from time to time) of the bill amount shall be deducted at source from
the contractor's bill and shall be deposited with the I.T.O. as per rules.
38. Bank may delay the progress of work without, in any way, vitiating the contract and grant such extension
of time for the commencement I completion of the contract as it may think proper and sufficient in
consequence of such delay and the contractor shall not make claim for compensation or damage in
relation thereof.
39. The contractor shall not execute any extra item without Bank's permission in writing.
40. The quantities mentioned in the schedule of quantities are approximate. Payment shall be made on actual
work done by the contractor. However, the contractor should not deviate the quantity without bank's
permission.
41. Conditional tenders quoted by the tenderer are liable to be rejected.
42. The Bank has a right to alter the nature of work and to add or omit any items of work or to have the option
of the same carried out departmentally or otherwise and such alterations or variations shall be carried out
without prejudice to this contract.
43. In case the particular make of material mentioned not available at the time of execution of the work, the
alternative make of materials shall be got approved from the Bank before its use.
44. The Bank has right to terminate the contract, if the contractor abandons the work, or fails to commence
and complete the work in time, or fails to abide by the contract conditions.
45. Arbitration - In case of any dispute between Bank & contractor, the decision taken by the arbitrator who
shall be appointed by the UBI, Nodal Regional Office, Union Bank of India, 1st Floor, Hotel River View,
Jaunpur (U.P.) shall be final.
46. The contractor shall have to BUY BACK the dismantled items. The particulars, quantity etc. of the said
items shall be provided by the Bank at a later date.

Indemnity Bond with-in 10 days of issue of work order in favor of the Bank against
third party claims, civil or criminal complaints, site mishaps and other accidents or
disputes, against any damages, lossor expensesdue to or resulting from any negligence
or breach of duty on the part of the contractor, his subcontractors or his
employees and agents etc., as per the appropriate Indemnity Bondattached.
It will also be covered by labour laws of the Govt. of India.

2. We agree that any other terms or conditions of contract or any general reservation
which may be printed on any correspondenceemanating from us in connection with
this tender or with any contract resulting from this tender shall not be applicable to
this tender or to the contract.
3. We have obeyed the rules about confidentiality of tenders and will continue to do so

completion is adequate. Time allowed for completion of entire job or part job
assigned shall be reckoned from the fifth dayof the date of acceptance of work
order. We shall be under the obligation to pay the sum as stated in the contract for
every day that the works shall remain incomplete, damagesas compensation subject
to the conditions of contract relating to extension of time.
7. We agree to deposit Rs as Earnest Money Deposit of the contract amount

by way of DD/PO in favour of UNIONBANKOF INDIA, payable at Jaunpur. This
amount shall be released after virtual completion of work. We further agree for a
deduction of 10%from the running bill as retention money till 12 months.
8. The Bank is at liberty to accept or reject any tender, without assigningany reasons
whatsoever.
9. The work may be split up in the first instance as per exigencies of the Bank. But it
may be split up in more parts or parts combined if so desired by the Bank without
assigningany reasonswhatsoever. We will not have any claim either for lossof profit
or revision in rates.
10.We are aware that the quantities of work indicated in the bill of quantities are
approximate, may vary to any extent, even it may be omitted; we will not have any
claim of any kind against the Bank.

arrangement/hydraulic door closer, mortise locks (Godrej,Dorma make ali), etc.
The rate shall include cost of all materials, labour, T&P, wastages, etc. required for
proper completion of work, all complete to the satisfaction of the Architect.

Providing and fixing of Aluminum grill work in cash counter top with all nesseccary
fixing support of 'L' , 'H' and 'C' aluminium sections and etc.Cost include 'L' ,'H'
and 'C' aluminium sections, hardwares, tools, wastages, lead, lift, labour
charges, oading,unloading charges, cutting, transport and etc.Complete as per
instructions of the Architect.

Providing & Fixing clerical counter made out of 19.0mm thick ply
(as per list of materials) frame work for top, verticals, shelves,
apron, sides, drawer unit, shutters, side units, customer top, foot
rest, 12.0mm thick ply(as per list of materials for drawer sides,
sliding shutters, front apron & Smm thick ply for side unit back,
drawer bottom, drawer unit back along with necessary 2" X 2" or
2" X 1.5" of laminate matching imported wood molding & teak
wood supports for fixing of top. The clerical counter shall have 2'_
S" in depth & counter shall have two tops Le. one at 2'-S" for
writing and second at 3'-0' for customer in height finish in
approved make/color 1.0mm thick laminate etc. complete. The
clerical counter shall have 1 No. of key board tray, 2 Nos. of
equal drawers or as per the Bank requirements & one open able
shutter.
All exposed surfaces Le. apron, counter side etc. finish with
approved make/color 1.00mm thick laminate & moulding finish
with 3 coats of melamine polish and internal surfaces shall have
zinc oxide polish along with necessary approved Stainless Steel

1 ATM UPS earthing - S/burying of Dual pipe technology (Pipe in Pipe) earthing

chemical compound. The vacant space between pipe & hole shall also be filled with
