I. YES. Even public officials can commit this crime of usurpation of official functions acting as if he is
the governor of another area where in fact he is not. The representation that he is making is different
from that of his true position. As per Art. 177 of the RPC, in usurpation of official functions, any
person who, under pretense of official position, shall perform any act pertaining to any person in
authority or public officer, without being lawfully entitled to do so, shall suffer the penalty of prision
correccional in its minimum and medium periods. A public officer may also be an offender because
the act performed without being lawfully entitled to do so to the government.
