Today i.e on 25.03.2021 at 21.30 Hours received an English Typed complaint from
Komarasetti Murali Krishna, Occ: Employee of M/s CheQ IP, office at 2201,M3M Merlin, Sector-67,
Gurugram, also authorised by M/s Gemini Edibles and Fats India Pvt Ltd office at ‘’FREEDOM
HOUSE’’ 8-2-334/70 & 71, Road No.05, Banjara Hills, Hyd. In which he compliant against
infringement of Intellectual property of Gemini Edibles and Fats India Pvt Ltd and cheating. He
stated that sometime during the August-Sep 2019, Gemini sales team started getting complaints
from some rural customers that the products quality of their edible oil under different brands is
deteriorating day by day. Some even complained of foul smell and very different taste that they are
used to, as far as Gemini oil such as ‘’Freedom’’ is concerned. As such compliant started surfacing
in different cities in Telangana and Andhra, hence this matter was investigated internally. However
when this products were analysed and checked, it was found that all such products had a
deceptively similar TRADE DRESS and COLOUR SCHEME as that of ‘’Freedom’’. oil. It was found that
these imitating products were always sold in rural and semi-rural areas, where people are either
illiterate or not so aware about the brands and often products are purchased on the look and feel of
the packaging, believing it to be a Gemini products. Once Gemini understood the matter and scale
imitation and blatant cheating by these unscrupulous players all across two states, it issued legal
notices to all such parties. One such entity by name Kedia Udyog, located in Malakpet, Hyderabad
was confirmed to be manufacturing and selling ‘’Freedrop’’ oil in Hyderabad. Freedrop packaging
Trade Dress which includes arrangement of typical colour scheme, packaging design etc are
deceptively similar to their trademark ‘’Freedom’’. Further trademark ‘’Freedrop’’ is also
phonetically similar to their trade mark Freedom, with only difference of ‘’rop’’ in the trade mark. All
this is done deliberately to pass of this inferior edible oil as Gemini Freedom oil and constitute act
of cheating. Further ‘’Freedrop’’ is not a registered trade mark, as per their knowledge. Gemini also
released newspaper advertisement in Times of India on October 20,2019, to deter all such players
from indulging in such manufacturing and usage of Trade Dress of ‘’Freedom’’ Oil having similar
colour scheme and packaging art work as that of ‘’Freedom’’ oil. Advertisements were also issued in
Telugu language, apart from English. However, inspite of several initiatives and warning, several of
these players continued with their illegal activity. In this view of the above submission they
requested to take action to stop this act of cheating and imitating a popular brand like Freedom.
This will ensure all customers are insulated from buying cheap and substandard oil, which may have
health implication in future.
