Alva v. High Capacity Security Force Inc.

G.R. No. 203328

November 8, 2017

FACTS:
Petitioner filed for a complaint for illegal dismissal, other monetary claims and attorney’s fees
against the respondent. He was assisted by a lawyer of PAO. LA and NLRC awarded him the
attorney’s fees but the CA deleted the same noting that petitioner was represented by PAO.

ISSUE:
Whether or not CA erred in deleting the attorney’s fees

RULING:
Yes. The fees shall be awarded to PAO as a token to recompense for the free legal services to
litigants who have no means of hiring a private lawyer. In actions for recovery of wages, the
award of attorney’s fees is legally and morally justifiable. The same shall be deposited in the
National Treasury and shall be disbursed for special allowances of officials and lawyers of PAO.
