DECLARATION OF HEIRSHIP
WITH SPECIAL POWER OF ATTORNEY
KNOW ALL MEN BY THESE PRESENTS:
WE, ALMA BELLA K. FIRMEZA, of legal age, Filipino, single and a resident of Bacolod City,
DENIA F. ABAJADO, of legal age, married to PABLITO ABAJADO, a resident of Bacolod City,
ZENIA F CATALONIA, Filipino, of legal age, married to DINDO CATALONIA, and a resident of
Bacolod City, JOSEPHINE K. FIRMEZA, of legal age, Filipino, single and a resident of Bacolod City,
AILYN K. FIRMEZA, Filipino, of legal age, Filipino, single and a resident of Bacolod City Negros
Occidental, hereinafter referred to as the DECLARANTS.
WITNESSETH:
That the above-named DECLARANTS are the legal and sole heirs of the late BELLA K.
FIRMEZA, who died on March 3, 2012 at Dr. Pablo O. Torre Sr., Memorial Hospital, Bacolod City,
without any will;
That the said deceased, at the time of her death, is the owner of a parcel of land known
as Lot 938-B, covered by TCT No. 120103, located at Bacolod City, Philippines;
That no personal properties are involved in the execution of this instrument;
WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the Philippines,
and all being with capacity to contract, we do hereby adjudicate to ourselves the above-
mentioned property and we assume full responsibility of whatever amount of the loan existing
at the time of the execution of this instrument;
That, We, ALMA BELLA K. FIRMEZA, DENIA F. ABAJADO (married), ZENIA F. CATALONIA
(married), and AILYN K. FIRMEZA of legal ages, Filipinos, with residence at Bacolod City, Negros
Occidental, have named, constituted and appointed our sister JOSEPHINE K. FIRMEZA, of legal
age, Filipino, single, as our true and lawful Attorney-in-Fact, for us and in our names and stead,
for our use and benefits, to do and perform the following acts and things:
1. To honor our commitment to JOSEPHINE K. FIRMEZA that she shall look for prospective
buyers of our aforesaid land at the price agreed upon by us, and if successful, she shall
be entitled to receive from us without need of demand, her corresponding sales
commission in accordance with law provided the said buyer/s is/are FORMALLY
registered and made known to us before the sale is consummated.
2. To sign any documents or papers necessary or requisites for the accomplishment of the
foregoing purpose;
HEREBY GIVING AND GRANTING unto our Attorney-in-fact full power and authority to
do and perform all and every act requisite and necessary to carry into effect the foregoing
authority as fully to all intents and purposes as We might or could lawfully do if personally
present and hereby confirming and ratifying all that our said Attorney-in-Fact shall lawfully do
or cause to be done under the premises.
IN WITNESS WHEREOF, the DECLARANTS have hereunto set their hands this 17 th day of
February, 2021, at Bacolod City, Negros Occidental, Philippines.
