MOTION TO CONDUCT HEARINGS VIA


VIDEOCONFERENCE

Accused through counsel, and unto this Honorable


Court, most respectfully states:

1. The pretrial conference of this case is set on 05 July


2021, at 2:00PM.

2. In view of the current situation and restrictions on


movement caused by the COVID-19 pandemic, the Supreme
Court promulgated A.M. No. 20-12-01-SC or the Guidelines
on the Conduct of Videoconferencing (Guidelines) which
states that the conduct of videoconferencing shall be
considered as an alternative mode to in-court proceedings.

3. Moreover, Accused xxxx by profession, who is


regularly tasked to collect specimens for Covid testing and
provide medical care for Covid-19 patients. As such,
Accused xxx is considered to be at higher risk of carrying
such virus, thereby putting the Honorable Court at higher
risk of exposure to Covid-19 with his in-court presence.

4. In view of the foregoing, the undersigned counsel


respectfully moves for the conduct of the pre-trial conference,
as well as all of the subsequent hearings of the
aforementioned cases via videoconferencing pursuant to the
Guidelines.
5. The Accused and the undersigned counsel may be
contacted by this Honorable Court through their email

6. Further, the Accused movant and intended witnesses


are technically ready to participate in the videoconferencing.
Accused also endeavors to conduct test of technology
videoconference with intended witness at least a day before the
scheduled hearing to lessen possible difficulties .

WHERFORE, premises considered, it is hereby


respectfully prayed for the Honorable Court to conduct the
pretrial/arraignment set tomorrow, 08 June 2021, as well as
all subsequent hearings of this case via
VIDEOCONFERENCING.

Other relief just and equitable are likewise prayed for.
