PRODUCER AND ACTOR MUTUAL AGREEMENT
THIS AGREEMENT is made and entered into as of _____________________________ by and between
MARIA ELIZA L. CORNEJO, Filipino, married residing in

Makati City (hereinafter referred to as "Producer"),
AND
________________________________________________________________
________________________________________________________________
(hereinafter referred to as "Actor").
WHEREAS Producer intends to undertake the filming of an independent film feature

production entitled KALEIDOSCOPE WORLD (hereinafter referred to as the "Project”);
WHEREAS Producer wishes to contract the services of Actor in connection with the Project
upon the terms and conditions herein contained.
NOW, THEREAFTER, in consideration of the premises and mutual covenants herein

contained, the parties agree as follows:
1. ROLE: Producer hereby engages Actor to render services as such in the role of
______________________ in the Project while Actor hereby agrees to make his services
available for rehearsal and shoots within the duration of this agreement.
2. TERM: The term of contract hereunder covers rehearsal and filming activities and
shall commence on or about November 3, 2012 and continue until a maximum end
date of December 22, 2012 unless otherwise extended by the Producer due to
unavoidable circumstances or acts of God, as long as the Producer seeks the
amicable consent of the Actor.
3. TALENT FEE: The talent fee of PHP____________ per day or a package fee of
PHP_______________ is assigned to Actor who in turn accepts such engagement upon
the terms herein specified. Producer assures an additional honorarium of
PHP __________________ if the Project earns more than PHP 100 Million after the
Project’s regular theater run in the Philippines.
4. METHOD OF PAYMENT: The Actor hereby acknowledges that his Talent Manager
/Agent (if any) is authorised to collect and receive all sums of money payable to the
Actor provided that the Actor may require payments to be made directly to the
Actor upon written notification to the Producer.
Actor hereby acknowledges and understands that the Project is independently

produced and that the Producer is requesting the Actor for an instalment payment
option spread across a calendar period of November 2012 to ______________________.
No specific amount nor payment dates can be promised by the Producer due to the
pending loan applications made by the Producer. However Producer assures Actor
that payment of talent fees will be made accordingly as soon as funds for the Project
become available.
5. COMMUNICATION: All notices which the Producer is required or may desire to give
to the Actor may be given either by mail or electronic mail or personally, either
orally or in writing. The Actor must keep the Producer advised as to where the
Actor may be reached by telephone or mobile phone without unreasonable delay.
6. FURNISHING OF WARDROBE: The Actor agrees to furnish his personal wardrobe

and wearing apparel reasonably necessary for the portrayal of said role; it being,
however, that should so-called "character" or "period" costumes be required, the
Producer shall supply the same.
7. CREDITS: Actor shall receive a credit at the beginning of the film and/or during end
credits based on the Actor’s assigned billing using the screen name
___________________________________.
8. HEALTH, SAFETY AND INSURANCE: Producer will use its best efforts to ensure
Actor’s health, safety and welfare during the Project. However Producer warrants
that he will not maintain public liability insurance to cover Actor during the Project.
9. FOOD: Producer will provide Actor with food and refreshments during those
periods when Actor’s presence is required at the rehearsal and filming of the
Project.
10. DVD OF PROJECT: Producer will provide Actor with a DVD copy of the completed
Project within 10 days after the Metro Manila and provincial theater runs of the
Project in the Philippines.
11. NAME AND LIKENESS: Producer shall have the exclusive right to use and to license
the use of Actor’s name, photograph, likeness and/or voice by any means in and in
connection with the Project’s advertising, publicizing, marketing exhibition, and/or
other exploitation of the film project.
12. CONSENT: The Producer shall have the right to photograph, record and/or
otherwise produce, reproduce, transmit, exhibit, distribute and publicise in
connection with the Project any and all of the acts, poses, plays and appearances of
any and all kinds of the Actor appearing in the Project containing such acts, poses,
plays and appearances.
The Producer shall likewise have the right to use and give publicity to the Actor’s
name and likeness, photographic and otherwise, and to recordings and
reproductions of the Actor’s voice and all instrumental, musical and other sound
effects produced by the Actor in the Project in order that it may be publicised or
advertised.
13. EXHIBITION OF PROJECT: Actor agrees not to exhibit the Project in public without
the written consent of Producer; provided, however, that Actor may use portions of
the Project in which Actor appears for Actor’s demo reel.
IN WITNESS WHEREOF, the parties have executed this agreement as of the day and year
first above written.
