JUDICIAL AFFIDAVIT OF Francisco Historillo
I, Francisco Historillo, of legal age, married, employed as a janitor at the

local school while studying at Engineering at night. after having been
duly sworn to in accordance with law, hereby depose and state:
PRELIMINARY STATEMENT
That in accordance with A.M. No. 12-8-8-SC, which prescribes the use of
judicial affidavits to serve as the direct examination testimony of the
witness, on the basis of which the adverse party may conduct their cross-
examination on such a witness, I hereby execute this judicial affidavit in a
question and answer format;
That conformably with section 3 (b) of the said A.M. No. 12-8-8-SC, I
also state that it was an investigator who conducted the examination of
the undersigned affiant;
That conformably also with section 3 (c) thereof, I hereby state under the
pain of perjury that in answering the questions asked of me, as appearing
herein below, I am fully conscious that I did so under oath, and that I may
face criminal liabilities for false testimony or perjury;
AND UNDER OATH AVERS THE FOLLOWING:
1. Q: How do you know the plaintiff, Patricia Jimenez and the

respondent, Cleo Annalise Rodriguez?
A:Patricia Jimenez is my landlady and neighbor on the left side facing the
road while Cleo is my neighbor on the right side.
2. Q:If that is the case, then you might have preference in testifying for
your landlady?
A: No, I don’t. I just find it unfair that my roommates and I, make it a
point to pay our rent on time.
3. Q: Have you ever been late on your payment?
A: We were late only twice, due to my transferring to another job. I
talked to Patricia about this while my roommate had additional expenses
because his brother, Lucario, died.
4. Q: Are you familiar with the stipulation of an additional 2% interest
rate for late payments?
A: Yes, I am. But this is not very strict. On the one time that I was late in
paying, Patricia waived the 2% interest because I explained my
predicament to her.
5. Q: Were you aware that Patricia reported the non payment of Cleo to
the barangay?
A: Yes, I am aware. This was the talk of the barangay, and as their mutual
neighbor, many people where asking me about this.
6. Q: Are you aware of what Cleo does for a living?
A: Yes, she has many racket for a living and is also a call center agent. I
always see a shopee delivery guy pick up something from her apartment.
Sometimes it would be her sister who would give the item.
7. Q: Do you know when Patricia asked Cleo to leave the property?
A: I do not know the exact day, but after not paying for three months,
Patricia got angry and asked Cleo to leave. They were yelling at each
other on the side walk and I was peeping from the living room, so I heard
the argument.

language the questions asked of him/her and the corresponding answers
that he/she gave in response to the questions asked; Neither I nor any
other person/s coached this witness-affiant regarding the answers given
