Appendix I

ROUTINE MAINTENANCE WORKS

The Company shall submit the Proposed Works Programme Schedule for the
Routine Maintenance Works before the start of the Concession Year

SCOPE OF WORKS

ITEM NO. BRIEF DESCRIPTION OF WORKS

R 01 PAVEMENT

The Company shall provide all labour, equipment, tools, material,


transport and whatever necessary for the execution of the works below:

1 Patching of potholes

2 Sealing or surface cracks

3 Reinstate edge deterioration of back filled trenches

4 Treatment to deterioration of concrete pavement

5 Repair to concrete pavements joint

6 Repair to paving blocks and slabs

The total aggregate quantity of work to be carried out under this category of works
shall be up to a maximum of 1% of paved area per year.

ITEM NO. BRIEF DESCRIPTION OF WORKS

R02 MAINTENANCE OF ROAD SHOULDER

The Company shall provide all labour, equipment, tools, material,


transport and whatever necessary for the execution of the works below:

1 Re-grading and clearance of vegetation

2 Topping up of shoulders with suitable earth material.

3 Filling irregularities in unsealed shoulders.

4 Filling pavement/shoulder level differences

The total aggregate quantity of work to be carried out under this category of works
shall be up to a maximum of 20% of road length considering 10% on each side of the
road per year.

R03 GRASS CUTTING

The Company shall provide all labour, equipment, tools, material,


transport and whatever to carry out the grass cutting works to the limit
and extend described below:

The grass shall be cut to a height of 50 mm.

1 Road shoulder

2 Slope area

3 Berm drain, interceptor drain and all other types of drain on slopes.

4 Median

5 Clear vegetation on paved surface

Cycle:

i. Protocol roads : 12 cycles per year


ii. Primary roads : 12 cycles per year
iii. Secondary roads : 12 cycles per year

The Company shall provide all labour, equipment, material, transport


and whatever necessary for the execution of the works below:

iii. Secondary roads : 2 cycles/year

1 Cleaning of guardrails and barriers

2 Cleaning of signage and posts

R 05 MAINTENANCE OF BRIDGES AND CULVERTS

The Company shall provide all labour, equipment, tools, material,


transport and whatever necessary to carry out the works as routine
exercise to prevent bridge / structure deterioration:

Cycle:

a. Cleaning Works and Removal of Vegetation

i. Protocol roads : 6 cycles/year


ii. Primary roads : 2 cycles/year
iii. Secondary roads : 2 cycles/year

1 Cleaning of weep holes

2 Cleaning of waterway or culvert opening and bridge carriageway

Appendix I

A LANDSCAPING – NOT APPLICABLE

B ROUTINE INSPECTION

The Company shall provide all necessary manpower, transport and


equipment to carry out daily routine inspection along all Peninsular
Federal Roads to identify defects that require Routine Maintenance
Works.

This work shall include the following:

Cycle:

Cleaning Works
i. Protocol roads : 2 cycles/week
ii. Primary roads : 2 cycles/week
iii. Secondary roads : 2 cycles/week

1 Removal of minor obstruction which affect the traffic upon detection by


the Inspectors

2 Provide monthly reports to the Government

Appendix II

PERIODIC MAINTENANCE WORKS

1 The Periodic Maintenance Works shall comprise the following:

(a) Preventive maintenance works

(b) Pavement strengthening of roads.

(c) Normal preventive maintenance works on all roads, including


resurfacing and all other associated works.

(d) Preparation of Works Programme Schedule as in Appendix X.

2 The Periodic Maintenance Works shall be carried out in accordance with


JKR's Standard Specification for Road Works JKR/SPJ/1988 and/or JKR's
Standard Specification for Road Works JKR/SPJ/2008 (in relation to
pavement works), approved Addendum, Method of Measurement and/or
other relevant Standards as specified by the Government.

3 (a) The Surface Regularity as measured using the Rolling Straight


Edge/Straight Edge device or the IRI Test under the pavement works
shall only be applicable for pavement works involving:

(i) more than 500 metres road with full width; and

(ii) total regulations or total reconstruction or total Cold In Place


Recycling (CIPR)

(b) The lane IRI measured for the whole road length and each 100-meter
section shall be in accordance with the practice applicable during the
time the IRI Test is or to be carried out.

4 The Trial Lay for pavement works shall be carried out at the actual
location and the approved Trial Lay shall be considered as part of the
works.

Appendix III

EMERGENCY WORKS

This category of works refers to those road maintenance activities where the occurrences of
which are difficult to predict or not within the control of the company but which have an
immediate effect on road maintenance and therefore have to be dealt with without delay. The
occurrences of incidents whereby the company shall be responsible for the Emergency Works
are as follows:

1.0 LANDSLIDE

1.1 Occurrence where the road is partially or totally blocked by collapsed


material and not passable to traffic but pavement is not damaged.

a. Provide traffic management at the affected area within one hour


or earlier wherever possible.

b. Clearing of debris/material and make the road passable to traffic


within 24 hours of notification or detection.

c. Provide warning signs to warn traffic

2.0 EMBANKMENT FAILURES AND ROAD SUBSIDENCE

2.1 Occurrence where the road is totally subsided/washed out and not
passable to traffic.

a. Provide traffic management at the affected area within one hour


or earlier wherever possible.

b. Provide and construct temporary diversion where space is


available. Where space is not available and it is not passable,
the Company shall advise the Government of the necessary
route diversion required. The Company shall provide traffic
management at locations where the traffic is to be re-routed.

2.2 Occurrence where the road is partially subsided/washed


out/collapsed and one or two lanes are not passable but not
damaged

a. Provide traffic management at the affected area within one hour


or earlier wherever possible.

b. Clearing of debris/material to make the road passable to traffic.

c. Provide temporary protection

3.0 FAILURE / COLLAPSE OF BRIDGES AND THEIR RELATED COMPONENTS

a. Where a bridge has failed/collapsed/declared unsafe by the


government and traffic has to be re-routed, the company shall only
provide traffic management at locations where the traffic is re-routed.

b. Provide traffic management at the affected bridge within one hour or


earlier wherever possible.

c. The company shall construct temporary crossing e.g. Bailey Bridges,


wooden bridge, culvert etc. as instructed by the Government as soon as
possible or any such time as stipulated by the government.

4.0 COLLAPSE OF CULVERTS AND DRAINAGE STRUCTURES

a. Provide traffic management at the affected area within one hour or


earlier wherever possible.

b. Provide temporary road diversion if necessary.

c. To provide all works required to make the road passable within twenty-
four (24) hours.

5.0 FLOODING

a. Provide and erect ranging poles along affected roads.

b. Provide traffic management at the affected area within one hour or


earlier wherever possible.

c. To advise the government on possible route diversion.

6.0 CLOSURE OF ROADS DUE TO SPILLAGE OF CHEMICAL, HAZARDOUS,


TOXIC OR INFLAMMABLE MATERIALS.

a. The company shall provide traffic management within one hour earlier
wherever possible.

7.0 CLOSURE OF ROADS DUE TO FALLEN TREES

a. Provide traffic management at the affected area within one hour or


earlier wherever possible

b. Clear road carriageway of fallen trees to make the road passable to


traffic within two hours of notification or detection.

8.0 TRAFFIC MANAGEMENT PLAN

Any traffic management plan to be undertaken by the Company related to any of the
Emergency Works for any period exceeding thirty (30) days shall be paid by the
Government to the Company in accordance with the Schedule of Rates as stipulated
in Appendix VII.

Appendix IV

ROUTINE MAINTENANCE PAYMENT

1. The agreed Routine Maintenance Payment payable by the Government to the


Company in accordance with this Agreement shall be at the rate of Ringgit
Malaysia: One Thousand Seven Hundred and Twelve (RM 1,712.00) only per
kilometer per month based on the length of the Peninsular Federal Roads
within the Concession Area at the Takeover Date.

2. The Routine Maintenance Payment shall be varied in accordance with the


formula as set on Appendix VIII, after the Effective Date:

(a) the Company is required by the Government to undertake the carrying


out of the Routine Maintenance Works in respect of any other existing
roads not comprised in the Concession Area or any newly constructed
roads.

(b) the Company is required to undertake the carrying out of the Routine
Maintenance Works in respect of any additional lanes being
constructed within the Concession Area;

(c) the joint inspection conducted or to be conducted by the Government


and the Company establishes that there is a variation of the total length
of the Federal Roads within the Concession Area from the total length
of the Federal Roads within the Concession Area as at the Effective
Date;
(d) the Periodic Maintenance Works overlaps with the Routine
Maintenance Works during the Defects Liability Period (the formulae of
which is as specified under (item C of Appendix VIII). The variation of
the Routine Maintenance Payment resulting from such overlapping
works shall only be applicable for overlapping works caused by
Periodic Maintenance Works commencing from 05 April 2018 onwards;
or

(e) the pavement works itemized in RO1 of Appendix IX is not claimable


during the Defect Liability Period of the Periodic Maintenance Works.

Appendix V

PERIODIC MAINTENANCE PAYMENT

The parties hereby agree that the Periodic Maintenance payment shall be calculated
on actual work done based on the Schedule of Rates as stated in Appendix VII.
However, for works / items not covered in the Schedule of Rates, payment shall be
on Day works and / or Agreed Rates.

Appendix VI

EMERGENCY WORKS PAYMENT

Emergency Works / items instructed by the Government are to be paid under the
Schedule of Rates for Periodic Maintenance as in Appendix VII. However, for works
/ items not covered in the Schedule of Rates, payment shall be on Day works and /
or Agreed Rates.

Appendix VII

SCHEDULE OF RATES PREAMBLE

1 The Schedule of Rates shall be applicable for all Periodic Maintenance Works and
Emergency Works.

2 All Periodic Maintenance Works and Emergency Works shall be carried out in
accordance to JKR's Standard Specification for Road Works JKR/SPJ/1988 and
JKR's Standard Specification for Road Works (in relation to pavement works)
JKR/SPJ/2008, approved Addendum, Method of Measurement and other relevant
Standards as specified by the Government.

Appendix VII

SCHEDULE OF DAY WORK RATES PREAMBLE

Any works ordered by the Government to be carried out by daywork shall be paid for at the
rates entered in the dayworks schedule or any other approved rates subject to the following
conditions:

1 The rates entered for labour shall be deemed to include all on-cost associated
with the employment of such labour including (inter alia), head office charges,
overhead charges, profit, site expenses, subsistence allowances, time lost due to
inclement weather, bonus, holiday and sick pay, and any other employer's fringe
benefit(s), small tools and consumable stores temporary equipment such as
wages, temporary track, ladders, staging scaffolding and all items of a similar
nature unless these are provided or set up exclusively for daywork.

2 The wages for gangers and leading hands working with their gangs shall be paid
for at the appropriate rates, but the time of working gangers, sub-foreman and
foreman will not be included and shall be deemed to be included in the rates
entered for labour under site supervision and staff.

3 Payment for overtime work, if chargeable and approved by the Government


Representative shall be made at the rates entered herein, but the time so worked
as overtime shall be adjusted in the same proportion as that used for paying the
normal workmen on the site and approved by the Government Representative.
Thus, if a man works 1 hour overtime for which the rate payable is double-time,
payment shall be made for 2 hours at rate entered in dayworks schedule.

Note: Overtime is working time over and above 8 hours per working day including
Saturday or 48 hours per week.

4 The cost of special watching and lighting necessitated by dayworks shall be


included in the rates.

5 The rates entered for plant shall apply only to plan which is available on the site.
Such rates shall be deemed to include all overhead charges, profit, site
supervision, staff, hire charges, maintenance, fuel, spare parts, insurance, etc (but
excluding wages for plant operators and drivers).

6 Payment for mechanically operated plant shall be made only at such time as the
plant is engaged in daywork and shall exclude all standing, idle or down time.

7 If any workmen or items of plant on daywork do not readily belong to any


classification included in the schedule, the Company shall propose the equivalent
classification to be adopted for such workmen or items of plant and payment for
such will made accordingly.

8 The daywork rates entered hereunder and agreed by the Government


Representative shall not be further subject to a fifteen percent (15%) addition.

Appendix VII

9 The Company shall produce for verification to the Government Representative


vouchers specifying the time and materials employed on the work, if required, the
Company shall also produce his receipted bills and wages book in support of his
account.

10 Where special mechanical plant is required for use on daywork, the cost to be
paid to the Company shall be subjected to agreement by the Government
Representative.

11 A 'day' is considered normal working day of 8 hours, that is between 0800 hours to
1700 hours. Fraction of a day shall be paid on pro-rata basis for work involving
labour/manpower, whereas for work involving machinery, a day or fraction of a
day shall be considered a full daywork.

12 Rates for power driven tool are not included in the labour rated but charges for
hand tools shall be deemed to be included.

13 Additional cost for mobilization/demobilization of plants and machineries and


traffic management shall be applicable to pavement and shoulder works excluding
maintenance of footpath, concrete pavement repair and maintenance of wire rope,
and shall be based on four percent (4%) of the basic Schedule of Rates values.

14 Any works instructed by the Government to be carried out during night time
between 2100 hours to 0600 hours is considered as night work and shall be
subjected to an additional seven percent (7%) of the basic Schedule of Rates
values.

15 All rates pertaining to Drainage Works in the Schedule of Rates are only
applicable for roadside drains, first (1st) and second (2nd) berm drain. For works
involving third (3rd) berm and above, agreed rates shall be applied.

b) The company is required by the government to undertake the carrying out of the Routine
Maintenance Work in respect of any additional lanes being constructed within the
Concession Area;

c) The joint inspection conducted or to be conducted by the Government and the Company
establishes that there is a variation of the total length of the Federal Roads within the
Concession Area as at the Effective Date;

Maintenance Work commencing from 05 April 2018 onwards; or

e) The pavement works itemized in RO1 of Appendix IX is not claimable during the Defect
Liability Period of the Periodic Maintenance Works.

WORKS PROGRAMME SCHEDULE

PROPOSED WORK IMPLEMENTATION SCHEDULE FOR ROUTINE MAINTENANCE


WORKS AND PERIODIC MAINTENANCE WORKS.

The Company shall submit to the Government for its approval a proposed work implementation
schedule for the Routine Maintenance Work and the Periodic Maintenance Works as follow :

(i) Submission of Proposed Works Programme

The Company shall submit to the Government for its approval the proposed
Works Programme for the Routine Maintenance Works and the Periodic
Maintenance Works two (2) months before the Effective Date.

(ii) Approval of Proposed Works Programme by the Government


The Government shall approve the proposed Works Programme as submitted by
the Company with such condition and/or amendment as deemed necessary by
the Government within one (1) week before the Effective Date.

Unless the Company receives written objection from the Government, the Works
Programme shall be deemed approve and the Company may commence the
carrying out of the Routine Maintenance Works and the Periodic Maintenance
Works for that Concession Year.

Notwithstanding the approval of the Works Programme by the Government, the


Government may by a written notice to the Company, request the Company to
vary the Works Programme within a reasonable period form the date of such
notice.

(iii) Implementation By The Company

The Company shall implement the Works Programme as approved by the


Government.

FORM OF DESIGN GUARANTEE BOND

A. By the privatization Agreement dated *(the ‘’Agreement’’) made between the

Peninsular Federal Roads within the Concession Area upon and subject to
the term and conditions of the Concession Agreement.

B. Pursuant to Clause 7.6 of the Agreement the Company shall provide a design
guarantee to the Government as security for the design of the relevant portion
of the Periodic Maintenance Works, in accordance with the term herein
provided.

In consideration of your accepting our obligations herein contained discharge of


the Company’s obligation to provide such guarantee, we *(full name and address

1. Upon receipt of a written demand made by you from time to time stating that
the design works under the Agreement has not been carried out in
accordance with the Design and/or Approval Design under the Agreement
and/or that any defect of damage has occurred to the relevant portion of the
Periodic Maintenance Work or any part thereof as a result of any defect, fault,
insufficiency or inadequacy in the design including workmanship, material or
equipment arising from design default and without the need for you to take
legal action against or obtain the consent of the company and notwithstanding
any objection by the company and without any further proof or conditions and
without any right of set off or counterclaim, we shall forthwith pay to you the
amount or amount specified in such demand or demands given, which shall
be made by transfer to an account in your name at such bank in such place
as you shall direct.

2. Our obligations hereunder shall not be affected by any act, omission, matter
or thing which but for this provision might operate to release or otherwise
exonerate us from our obligations hereunder in whole or in part, including
without limitation and whether or not known to us you;

a. Any time or waiver granted to the Company or any other person.

b. The undertaking variation compromise, renewal or release of or refusal


or neglect to perfect or enforce any rights remedies or securities
against the Company or any other person.

c. Any legal limitation, disability or incapacity relating to the Company or


any other person.

d. Any variation of or amendment to the Agreement or any obligations to


be performed thereunder or any other document or security so that
references to the Agreement in this Guarantee shall include each such
variation and amendment ; and

e. Any variation of or amendment to the Privatization Agreement of any


obligations of the Company or any other person under Agreement or
any other document or security.

3. This Guarantee shall remain valid and in full force and effect from ( )

Completion for the relevant portion of the Periodic Maintenance Works the

returned to us for cancellation PROVIDED THAT in the event that no demand
has been made by you under this Guarantee within six (6) month after the

4. The right of the Government to make demand on us to make payment under


this Guarantee shall be an independent right and shall be without prejudice to
any other right of the Government under this Guarantee or under the
Agreement.

5. We shall not be discharged or released from our obligations hereunder by


any arrangement between the Company and the Government entered into
with or without our consent or by any alteration in the obligations
UNDERTAKE by the Company under this Guarantee or by any forbearance
by the Government whether as to payment, performance or otherwise by us.

3. This Guarantee is a continuing guarantee and shall be irrevocable and shall


remain valid and in full force and effect until you shall have notified us in
writing that the Company has performed all its obligations and discharged all
its liabilities under or relating to the Agreement, following which this
Guarantee shall be returned to us for cancellation PROVIDED THAT if no
demand has been made by you under this Guarantee within twelve (12)
months after the date of issuance of Final Completion Certificate in respect of
the Works provided in the Agreement, this Guarantee shall then expire and
be returned to us for cancellation. This Guarantee will in any event expire on

MONITORING RIGHTS OF THE GOVERNMENT

In addition to the other rights of the Government under this Agreement, the Government, in
relation to the concession granted to the Company to maintain the Peninsular Federal Roads
within the Concession Area, shall have the following rights:

1. Before the carrying out the Periodic Maintenance Works, the Company shall provide
to the Government all relevant data, including design calculation, the technical
specifications, construction drawings and schedule of local materials, required by the
Government for the monitoring of the quality control of the Periodic Maintenance
Works.

2 The Government shall have the right to:

a. Visit at any time the Concession Area accompanied by a representative of the


Company where necessary:

b. Witness any quality control tests being carried out in the field or in the
laboratory;

c. Inspect site records, test results and other data relevant to quality control;

d. Request from the Company any additional information relevant to quality


control;

e. Inspect the Concession Area to ensure that any Periodic Maintenance Works
carried out comply with the approved Technical Standards/ Specification; and

f. Make periodic visits to the Concession Area to ensure that the Routine
Maintenance Works are being carried out in accordance with the Agreed
Performance Standards.

3. The Company shall provide to the Government:

a. The Works Programme prior to the start of any Concession year;

b. Monthly progress reports on the progress of the Periodic Maintenance Works


and technology transfer (if any); and

c. Method Statements, Project Quality Plans and Specifications for all items
before the commencement of all Periodic Maintenance Works.

DEFECTS LIABILITY PERIOD

The Defects Liability Period for the Periodic Maintenance Works shall be as follow:

i. For works below the value of RM100, 000.00, the Defects Liability Period applicable
shall be six (6) months from the date of issuance of the Certificate of completion for
such work.

ii. For works above the value of RM100, 000.00, the Defects Liability Period applicable
shall be twelve (12) months from the date of issuance of the Certificate of completion
for such work.

iii. For Periodic Maintenance Works where the company is required by the Government
to design pursuant to Clause 5, the Defects Liability Period applicable shall be
twenty-four (24) months from the date of issuance of the certificate of Completion for
such work.

METHOD OF MEASUREMENT FOR


ROUTINE MAINTENANCE WORKS

1. INTRODUCTION
The method of measurement for Routine Maintenance Works is to identify the units
of measurement in relation to the works carried out under the Routine Maintenance
Works' Scope of Works. The method of measurement shall be applied to all the types
of works in the Routine Maintenance Works' Scope of works and as described in
Appendix I.

2. UNIT OF MEASUREMENT
The unit of measurement for Routine Maintenance Works is based on "Lump Sum
Schedule Payment" for each of the month in the contract period.

3. METHOD OF CLAIM AND PAYMENT


The Company shall submit monthly Lump Sum claim based on the agreed “Lump
Sum Schedule Payment” for each of the month in the contract period. Payment shall
be made upon submission of each of the monthly Lump Sum claim in the contract
period.

RO 1 – PAVEMENT

RO 1.1 SCOPE OF WORKS

The Company shall provide all labour, equipment, tools, materials,


transport and whatever necessary to the execution of the works below:

a. Patching of potholes
b. Sealing of surface cracks
c. Reinstate edge deterioration of back filled trenches
d. Treatment to deterioration of concrete pavement
e. Repair to concrete pavement joints
f. Repair to paving blocks and slabs

The defect shall be capped at a maximum of 1% paved area per year.

RO 1.2 PATCHING OF POTHOLES

a. Definition

A pothole is defined as minor loss of pavement surface materials at


a defined location.

For the “minor loss of pavement surface materials” to be defined as


a pothole, the minor loss shall exceed 200 mm width in any
direction and 25 mm depth but shall not exceed 1000 mm width.

Any loss of pavement surface materials exceeding the size as


mentioned above and any recurrence of potholes, shall be treated
as pavement failure and rehabilitation works such as pavement
reconstruction shall be carried out under the Periodic Maintenance
Scope of Works.

Pothole less than 200mm wide shall be patched but without cutting
the edges.

Measurement for recurrence of pothole notified in advance shall be


considered in the total aggregate quantity.

b. Works Procedures

i. Preparation Works

The Company shall remove all loose materials and excess


materials from the potholes. The edges of the area shall be cut
at 50 mm from outer edge of pothole and shaped using the

pavement cutter. The excavated materials shall be disposed


off from the site.

ii. Tack Coat

The bituminous tack coat shall be sprayed uniformly in the


range of 0.25 to 0.55 litre/sq m on to the cleaned bituminous or
bitumen prime surface.

The temperature of the bituminous material shall be


maintained in the range of 25° to 45° during spraying
operations.

Traffic shall be kept off the tack coat

iii. Laying Of Premix

Hot or cold mix asphalt shall be used to fill the cut-out area and
compacted to match with the level of the adjacent section.

Cold mix shall be used if the strength parameters comply to

RO 1.3 SEALING OF SURFACE CRACKS

a. Definition of Cracks

Cracks are fissures resulting from partial or complete fractures of


the pavement surfaces can happen in a wide variety of patterns,
ranging from isolated single crack to an interconnected pattern
extending over the entire pavement surface. The possible causes
of cracks include:

i. Depression
ii. Fatigue life of the surfacing being exceeded
iii. Age brittlement of the surface
iv. Reflection of cracks in underlying layers

b. Work Procedures for Crack Sealing


(More Than 2mm Wide And 1 m long)

i. Preparation Works

All loose and foreign materials shall be removed from cracks


using hot air compressor, wire brushes or other suitable
equipment.

ii. Crack Sealing

A layer of approved purpose made cold or hot crack sealant


shall be applied on to the effected area using watering can or
pressurized spray. The sealant shall then be brushed into the
cracks and left to dry. As soon as the sealant has dried a layer
of granite dust shall be applied. Material for sealing of crack
shall comply with JKR/SPJ/2008.

c. Opening To Traffic

The Company shall ensure that excess loose materials be swept


away all to the satisfaction of the Government before the road is
opened to traffic.

RO 1.4 REINSTATE EDGE DETERIORATION OF BACKFILLED TRENCH

a. Definition

This pavement defect is described as loss of pavement surface


material at the edges of backfilled trenches within the road
carriageway. These areas disintegrate due to the weakening of the
base course or poor quality reinstatement works. Free water
collecting the underlying base accelerates its deterioration. Such
defects, if not corrected may lead to subsequent loss of pavement
structural integrity. It influences the riding quality of a pavement and
may reflect structural inadequacies.

b. Work Procedure

i. Preparation Of Works

The edges of the affected area shall be cut at 150 mm from the
outer edge and shaped using the pavement cutter. All loose
and excavated materials shall be swept, removed and
disposed off from the site.

ii. Prime Coat / Tack Coat

Where applicable, Prime Coat shall be applied to the affected


area. The Prime Coat shall be applied with a layer of diluted
emulsion and shall be sprayed thinly and uniformly over the
cleaned bituminous prime surface (60% of cationic grade
emulsion). Traffic shall be kept off the prime coat.

Bituminous tack coat shall be sprayed uniformly in the range of


0.25 to 0.55 litre/sq.m on to the cleaned bitumen surface.
Traffic shall be kept off the tack coat.

iii. Laying Of Premix

Hot or cold mix asphalt shall be used to reinstate and backfill


the cut out area and compacted to match with the level of the
adjacent section. Cold mix shall be used if the strength
parameters comply to Table 4.10 of JKR/SPJ/1988 or latest
publication of Standard Specification for Road Works.
Compacted density of the hot mix shall be in the range of 90-
100% of Marshall Density. Material for hot mix shall comply
with subsection 4.2.5.2 of Standard Specification for Road
Work JKR/SPJ/1988 or latest publication of Standard
Specification for Road Works.

c. Opening To Traffic

The repaired area shall not be opened to traffic until compaction


has been completed and the material has thoroughly cooled and
set.

RO 1.5 TREATMENT TO DETERIORATION OF CONCRETE PAVEMENT

a. Definition

The main cause of defects in concrete pavement slab is the


movement of the subgrade due to differential settlement, plastic
flow or washing out of the subgrade material, although the actions
of traffic and weather also contribute. The common defects are
spalling and cracking of slab.

b. Work Procedures

i. Preparation Works

All loose and foreign materials be removed from cracks using


air compressor or power broom or other suitable equipment.
Pneumatic tools shall be used to break out all cracked or faulty
concrete when part of damaged concrete slab to be replaced.
Care shall be taken during operation to avoid unnecessary
damages to steel reinforcement. When spalling of concrete
occurs, the damaged part shall be cut and shaped by using a
concrete cutter until all unsound material and all spalled
surfaces are removed.

ii. Repair Works for

 Spalling Of Slab

The affected area shall be milled off. The milled area


shall be resurfaced using epoxy cement or other
materials approved by the Government.

 Cracking Of Slab

After removal of all loose materials and the effected part has
been thoroughly cleaned, approved hot sealant material shall
be poured into the damaged area. The materials and works
procedures for concrete pavements shall comply with the
requirements in section 5 of JKR/SPJ/1988 or latest
publication of Standard Specification for Road Works.

c. Opening To Traffic

The Contractor shall ensure excess loose materials be removed


and swept away, all to the satisfaction of the Government, before
the road is opened to traffic.

RO 1.6 REPAIR TO CONCRETE PAVEMENT JOINTS

a. Description

Joint sealing compounds deteriorate with age and become brittle


and are likely to be plucked out of the joint and also prevent the
ingress of water, it is necessary that the joint be cleaned out to
remove incompressible materials and refilled with approved joint
sealant.

b. Works Procedure

i. Concrete cutter or other suitable cutter shall be used to break


out the existing damaged materials. All loose materials shall be
removal by compressed air or power brushes.

ii. After the joint is cleaned out, it shall be refilled with hot- poured
sealant compound and other approved joint material.

iii. The materials and works procedures for concrete pavements


shall comply with the requirements in Section 5 of
JKR/SPJ/1988 or latest publication of Standard Specification
for Road Works.

RO 1.7 REPAIR TO PAVING BLOCKS AND SLABS

a. Description

Block slab paving repairs include replacement and reinstalling the


damaged or missing block paving units and damaged edge
restraints.

b. Works Procedures

i. Material

Paving blocks shall be in accordance with the manufacturers


specification and as approved by the Government. Paving
blocks are laid in accordance to the existing combination of
shapes and laying patterns.

ii. Sub base Layer

Granular or crushed rock will be adequate for use as a


subbase material for interlocking pavers. The required
compacted thickness of the sub base layer will depend on the
existing ground conditions. The existing ground shall be boxed
cut and shaped as closely as practicable to the required
dimensions and levels. Compaction of the ground shall be
carried out using overlapping passes of vibration plate
compactor or 2-tonne roller.

The sub base material should be loosely spread in one layer to


the required level and if necessary water shall be added before
compaction to reach the desired moisture content.

iii. Edge Restraints

The top level of the edge restrain shall be slightly lower than
adjacent paving units to ensure that water can drain freely from
channels of abutting units.

iv. Sand Bedding Layer

At the time of placing the sand shall have uniform moisture


content. The sand shall be spread and screeded in a loose
condition. The loosely screeded sand layer will have a small
surcharge to allow for compaction to the recommended
thickness of 30 mm.

v. Laying Paving Units

Paving blocks shall be placed with 2- 3 mm gaps between


adjacent units, maintaining correct joint alignment but without
pre-compaction of the sand-bedding layer. It is important that
the joint width between paving blocks be maintained. Complete
rows of full blocks shall be laid first. Any gaps at the pavement
edge adjacent to edge restraints shall be neatly fillet by cutting
locks to size. To fill gaps less than a quarter block in size, dry
packed mortar shall be used.

vi. Compaction And Joint Filling

After laying the blocks shall be immediately compacted and


brought to level by not less than three (3) passes of vibrating
plate compactor. The plate shall have sufficient area to
simultaneously cover 12 units. Immediately after compaction,
sand for joint filling shall be broomed over the pavement and
into the joints. Excess sand shall be removed as soon as joints
are filled.

The sand used for joint filling shall be finer than that used for
bedding layer and shall be free from salts or contaminants
likely to cause efflorescence.

RO 1 – PAVEMENT

RO 1.1 SCOPE OF WORKS

The Company shall provide all labour, equipment, tools, materials,


transport and whatever necessary to the execution of the works below:

a. Patching of potholes
b. Sealing of surface cracks
c. Reinstate edge deterioration of back filled trenches
d. Treatment to deterioration of concrete pavement
e. Repair to concrete pavement joints
f. Repair to paving blocks and slabs

The defect shall be capped at a maximum of 1% paved area per year.

RO 1.2 PATCHING OF POTHOLES

a. Definition

A pothole is defined as minor loss of pavement surface materials at


a defined location.

For the “minor loss of pavement surface materials” to be defined as


a pothole, the minor loss shall exceed 200 mm width in any
direction and 25 mm depth but shall not exceed 1000 mm width.

Any loss of pavement surface materials exceeding the size as


mentioned above and any recurrence of potholes, shall be treated
as pavement failure and rehabilitation works such as pavement
reconstruction shall be carried out under the Periodic Maintenance
Scope of Works.

Pothole less than 200mm wide shall be patched but without cutting
the edges.

Measurement for recurrence of pothole notified in advance shall be


considered in the total aggregate quantity.

b. Works Procedures

i. Preparation Works

The Company shall remove all loose materials and excess


materials from the potholes. The edges of the area shall be cut
at 50 mm from outer edge of pothole and shaped using the

pavement cutter. The excavated materials shall be disposed


off from the site.

ii. Tack Coat

The bituminous tack coat shall be sprayed uniformly in the


range of 0.25 to 0.55 litre/sq m on to the cleaned bituminous or
bitumen prime surface.

The temperature of the bituminous material shall be


maintained in the range of 25° to 45° during spraying
operations.

Traffic shall be kept off the tack coat

iii. Laying Of Premix

Hot or cold mix asphalt shall be used to fill the cut-out area and
compacted to match with the level of the adjacent section.

Cold mix shall be used if the strength parameters comply to


Table 4.3.5 of JKR/SPJ/2008.

RO 2 - MAINTENANCE OF ROAD SHOULDER


(Re-grading and Topping-Up Works)

RO 2.1 SCOPE OF WORKS

The Company shall maintain road shoulder to a condition where it should


have a smooth running surface, a minimum of loose material, an
adequate slope for drainage, sufficient strength to support wheel loads
and a surface flush with the pavement edge.

The Company shall provide all labour, tools, materials, equipment,


transport and whatever necessary for the execution of the works below:

i. Re-grading and clearance of vegetation.


ii. Topping up of shoulders with suitable earth material.
iii. Filling irregularities in unsealed shoulders,
iv. Filling pavement/shoulder level differences

RO 2.2 WORK PROCEDURES

i. Re-grading and Clearance of Vegetation

Re-grading of earth shoulder shall involve in smoothing, reshaping,


and compacting the existing shoulder material. It also involves in
clearing of vegetation and disposing them.

The grading process consists of bringing material in from the sides


and/or cutting down corrugations of the surfaces and filling the low
spots with the surplus loose material. Motor grader or other suitable
plants shall be used to re-grade level the surface and then follow by
compaction using roller or other suitable plants.

ii. Topping up Shoulders with suitable earth material

The Company shall bring the suitable earth from stockpile place or
others, deliver, place and topped up on low portion of the earth
shoulders. Earth shoulder material shall be suitable material as
described in Section 4.4 of the Standard Specification for Road
Works JKR/SPJ/2008.

Motor grader or other suitable plants shall be used to level the


topping up material and then further compacted by using roller
compactor or other suitable plants.

Each layer of shoulder material shall be processed as necessary to


bring its moisture content to a uniform level throughout the material

suitable for compaction, and shall then be compacted using


suitable compaction equipment to not less than 95% of the
maximum dry density determined in the B.S. 1377 Compaction Test
(4.5 kg rammer method). Compaction shall be carried out in a
longitudinal direction along the shoulder and shall generally begin
at the outer edge and progress uniformly towards the carriageway,
except on super elevated curves where rolling shall begin at lower
edge and progress uniformly towards the higher edge. In all cases,
compaction shall be carried out in such a manner that each section
received compactive effort appropriate to its thickness.

Throughout the placing, adjustment of moisture content and


compaction of shoulder material, care shall be taken to maintain a
uniform gradation of the material and prevent its separation into
coarse and separate parts.

Shoulders shall be finished in a neat and workmanlike manner. The


top surface of each shoulder shall have the required shape, super
elevation, levels and grades, shall be everywhere within 10 mm of
the required plane, and shall provide a flush joint with the
carriageway surface and shall be uniformly free draining away from
the carriageway.

iii. Topping up and/or re-grading of road shoulder at areas where


there are obstruction.

In areas where guardrails are obstructing the works, the payment


for removing and reinstalling the guardrails shall be paid in
accordance with the payment for Periodic Maintenance Works.

Grass cutting shall be defined as the cutting, removal and disposal of the
grass.

a. Area of grass cutting shall be within the specified limits. These


limits are:

i. Along the road shoulders and verges including the roadside


and shoulder drains. The grass cutting works shall be for the
maximum width of 3 meters of the shoulder or 1 meter beyond
the road side drain, whichever is greater,

ii. On cut slopes and embankments, grass cutting works shall be


limited up to one (1) meter of the slope.

iii. Grass cutting for berm drains, interceptor drains and all other
type of drains on slope shall be limited to the drains of the first
and second berm of the cut slopes only and at a width of 1
meter on left and right of the drains at a frequency of 12 cycle
per year and subsequent berms at a frequency of 6 cycle per
year.

iv. At medians.

v. Clear paved surface of all vegetation.

RO 4 - MAINTENANCE OF ROAD FURNITURES

RO 4.1 SCOPE OF WORKS

The Company shall provide all labour, chemicals, materials, equipment,


transport and whatever necessary for the execution of the works below:

a. Cleaning of existing road furniture, i.e guardrails and barriers, traffic


signboards and post, delineator posts, kilometer post and traffic
signal aspects. For cleaning of sign face on gantry and butterfly
posts overhead traffic signal aspect which require the use of
cranes and sky lifts, day work rates for rental of these machinery
shall apply, provided always that the use of such machineries are
instructed by the Government.

RO 4.2 WORK PROCEDURES FOR CLEANING

a. Cleaning Of Guardrails

Guardrail including delineators mounted on it shall be washed with


clean water. All surfaces must be cleaned.

Stains of tar, grease or oil shall be removed by using chemical,


followed by detergent and thoroughly rinsed with clean water.

All chemicals and detergents used by the Company for cleaning


purposes shall cause no harmful effects to the materials and
surfaces to be cleaned.

Care should be taken by the Company to prevent the reflective


strips from being scratched, defaced or other damages during the
cleaning operation.

b. Cleaning Of Signs And Posts

The warning, regulatory and directional signboards on the site shall


be cleaned. The following procedures of cleaning shall be used:

i. For surface contaminated with tar, oil, smut or/and bitumen,


mild solvent such as mineral spirits shall be used. The surface
shall then be washed with mild detergent and water, and then
rinsed with clean water.

ii. For surface contaminated with pollen and fungus, the surface
shall be washed with a 3 - 5% Sodium Hypochloride solution,
following by detergent and water. The surface shall then be
rinsed with clean water.

The Company shall exercise great care to avoid the sign face from
being scratched and other damages during the cleaning operations.

c. Cleaning Of Delineator Posts, Kilometre Post and Concrete


Barriers

The concrete barrier, delineator posts, kilometer post and its


reflector units shall be cleaned with clean water, approved
chemicals or detergent.

The Company shall exercise due care during the cleaning


operations to avoid the reflectorized faces being defaced and
scratched.

d. Cleaning Of Traffic Signals Aspects

The cleaning of lenses shall be carried out using an anti-static


water based alkaline cleaner/degreaser and cloths complying with
the following requirements:

i. The cleaning solution shall be non-toxic and cause no handling


dangers to personnel.

ii. The cleaning solution shall cause no harmful effects to the


range of materials and surfaces to be cleaned.

iii. The cleaning solution shall be highly effective against greasy


surface deposits, fast acting and suitable for use in cold water,
in hard or soft water areas.

iv. The cleaning shall not give to smearing.

v. The cleaning solution shall not cause persistent foaming in use


and shall not promote the formation of static charges on the
equipment surfaces.

vi. The cleaner/degreaser solution shall be diluted with clean


uncontaminated water in accordance with the Manufacture’s
instruction and shall be applied by means of soft cloths.

The cleaning cloths shall be continually cleaned to ensure that no


scouring or abrasive action damages the surface of the optical
components.

After the use of the cleaning solution all surfaces treated shall be
wiped with a clean dry cloth.

RO 5 - MAINTENANCE OF BRIDGES AND CULVERTS

RO 5.1 SCOPE OF WORKS

The Company shall provide all labour, equipment, tools, materials,


transports and whatever necessary to carry out the works as a routine
exercise to prevent bridge/structure deterioration:

a. Simple cleaning operation, removal of foreign material such as


trash, dirt, drift, debris or vegetation by hand or simple tools, the
area concerned include the bridge carriageway, waterway, weep
holes, culvert opening.
b. Any cleaning which requires the use of plants and machinery shall
be paid based on the Schedule of Daywork for Labour and Plant &
Machineries as particularly set out in Appendix VII.

RO 5.2 WORK PROCEDURES

a. Cleaning And Removal Of Debris

i. The waterway of bridges and culvert shall be kept clear from


logs, stumps and others debris.

ii. The deck of bridges, culverts and the approaches shall be kept
free of loose material. Scupper drain and water down pipes
shall be cleared from any blockage and unwanted material to
ensure smooth water flow.

iii. The weep holes in abutments shall be cleaned periodically to


ensure that the hole through the wall is not blocked by foreign
material which could prevent the free flow of seepage water.

RO 7 - Drainage

RO 7.1 SCOPE OF WORKS

The Company shall provide all labour, tools, chemicals, materials,


equipment, transports and plants as may be necessary to carry out the
cleaning of lined and unlined drains sumps, culverts and blocked grating.
For other drainage works which are not specified herein shall be carried
out by the Company upon Work Order and the payment of such work
shall be in accordance with Schedule of Rates in Appendix VII.

RO 7.2 DEFINITION

i. Cleaning of drains shall be defined as the collection, transportation


and disposal of debris, silt, stone aggregates, boulders, wastes and
thrash, timber and fallen branches and leaves and all other
materials which will reduce the efficiency of all types of drains.

ii. Cleaning of sump shall be defined as the desilting, emptying and


cleaning of all sumps.

RO 7.3 TYPES OF DRAINS

The types of drains defined under the contract are as follow:


i. Concrete lined drains.

ii. Earth drains - works limited to cleaning and desilting only.

RO 7.4 WORK PROCEDURES

The Company shall remove and dispose of silt, debris, vegetation, fallen
leaves, branches and any other obstruction found in the drains and
sumps.

RO 7.5 LIMIT OF WORKS

The extent of the drain cleaning works shall be as follows:


i. All open drains (line or unlined) along the road shoulder and
verges.

ii. All drains on the slope surfaces.

iii. Sumps at areas as described in items (i) and (ii).

(B) - Routine Inspection

(B) - ROUTINE INSPECTION

(B) 1 SCOPE OF WORKS

The Company shall provide all necessary manpower, transport and


equipment to carry out daily routine inspection along all Peninsular
Federal Roads to identify defects that require Routine Maintenance
Works and to collect all road data as required in the contract.

(B) 2 WORK PROCEDURES

i. The Company shall employ Inspectors to carry out daily routine


inspection along all Federal Roads within the area concerned.

ii. The Inspectors shall be equipped with a motorcycle or other


suitable vehicle, safety gears and communication equipment to
perform his daily task/duty.

iii. The Inspectors shall also inspect and collect all road data such as
width and type of roads, shoulders, drains, slopes, berms,
structures and road furnitures.

iv. The Inspectors shall also inspect, identify and note down all defects
and damages to road pavements, shoulders, drains, road furniture
and structures.

v. in the case of major defects or damages that require urgent


attention and/or which may affect the safety and the comfort of the
road user, the Inspectors shall inform the Section Manager and
JKR immediately via simple message services (SMS) or through
the communication equipment provided for necessary action.

vi. The Company shall submit daily report in weekly basis in the form
of soft copy (CD or E-mail) to JKR of all defects identified for his
necessary action.

vii. Removal of minor obstruction which affect the traffic upon detection
by the Inspectors.

viii. Submit monthly reports to the Government in soft copy form. The
report shall include but not limited to the following:

(a) Summary of actions taken on defect detected in the


reporting month.

(b) Summary according to mutually agreed format.

Appendix XVII

PROCEDURE FOR AMENDMENT OF APPROVED DESIGN

1. REQUEST

Any request by the Government for amendments to the Approved Design or for
additional works in relation to the Periodic Maintenance Works or any part thereof
to be carried out by the Company pursuant to Clause 5.4 shall be in writing and
shall be accompanied by a design brief.

2. SUBMISSION BY COMPANY

Within four weeks after the receipt of any such request by the Government, the
Company shall submit:

a. its comments concerning the desirability of such amendments to the


Approved Design or such additional works;

b. its estimate of the additional costs and expenses which will be incurred in
making such amendments to the Approved Design or in carrying out such
additional works;
c. its assessment of the time within which such amendments to the Approved
Design can be made or such additional works can be carried out; and
d. its assessment of any delay to the carrying out of the Periodic
Maintenance Works or any part thereof.

3. ADDITIONAL COSTS

After confirmation from the Government that the amendments to the Approved
Design or the additional works are to be carried out by the Company, the parties
hereto shall negotiate:

a. the additional costs and expenses which will be payable by the Government
to the Company;
b. the time periods within which such amendments to the Approved Design
will be made or such additional works will be carried out by the Company;
and
c. the frequency with which claims for reimbursement of additional costs and
expenses are to be submitted by the Company pursuant to Clause 5.4,
and the Company shall thereupon carry out the amendments to the
Approved Design or the additional works (as the case may be).
