We, the legal and legitimate heirs of SPS. IRENEO RIOS and ABUNDIA NUENA
RIOS namely:
BIENVENIDO N. RIOS, of legal age, married to Merla Cometa, Filipino Citizen with
postal address at Lo-ong, Tabogon, Cebu, Philippines;
ESTRELLA R. TOLEDO, of legal age, married to Govino Toledo, Filipino Citizen with
postal address at Lo-ong, Tabogon, Cebu, Philippines;
LEONILA R. ESCARLAN, of legal age, married to Felix Escarlan, Filipino Citizen with
postal address at Poblacion, Santa Fe, Cebu, Philippines;
SATURNINO N. RIOS, of legal age, married to Janet P. Rios, Filipino Citizen with postal
address at Banilad, Cebu City, Philippines;
AMELIA N. RIOS, of legal age, Single, Filipino Citizen with postal address at Lo-ong,
Tabogon, Cebu, Philippines;
Marline N. RIOS, of legal age, Single, Filipino Citizen with postal address at Lo-ong,
Tabogon, Cebu, Philippines;
and
IRENEO N. RIOS, of legal age, married to Aireen C. Rios, Filipino Citizen with postal
address at Lo-ong, Tabogon, Cebu, Philippines;
hereinafter collectively referred to as the HEIRS, after having been duly sworn to, do
hereby voluntarily depose and say THAT:
1. That we are the only legitimate and surviving heirs of SPS. IRENEO and ABUNDIA
NUENA RIOS. IRENEO RIOS who died on February 3, 2011, copy of his death certificate is
hereto attached as Annex “A” and ABUNDIA NUENA RIOS who died on March 12, 1999,
copy of his death certificate is hereto attached as Annex “B”. The Spouses died intestate without
no known debts;
2. That the decedents SPS. IRENEO and ABUNDIA RIOS acquired parcel of land
located in the Municipality of Tabogon, Cebu, which are more particularly described as
follows:

3. For and in consideration of the foregoing premises, invoking the provision of Section
1, Rule 74 of the Revised Rules of Court, We, the HEIRS above named by these presents
do hereby agree to adjudicate unto and among ourselves and to settle the estate of the
decedent extra-judicially and to this effect hereby partition which are more particularly
described as follows:
SUBDVISION PLAN
1. LOT A- Heirs of RICARDO OBERES, Represented by RENALYN V. OBERES;
2. LOT B- Heirs of EMELITA O. ROSALITA, Represented by ROSALINDA R.
ACOSTA;
3. LOT C- BENJAMIN OBERES
4. LOT E- RODULFO OBERES
5. LOT F- MAGDALENA O. LARGO
6. LOT G- ALFREDO OBERES
7. LOT H- DESIDERIO OBERES
8. LOT I- LUCRESIA O. DEL SOCORRO
9. LOT J- DIONISIO OBERES
with each Lot Area of Three Hundred Sixty-Nine (369) Square meters more or less;
4. In the remote event that any other property of the decedent should ever be found
which is not included hereinabove, the HEIRS hereto further agree as they do so agree
to settle and distribute the same in like manner and proportion as herein established
and disposed.
5. The HEIRS hereby affirm that they have executed this instrument out of their own
free will without force, intimidation or violence upon their person, and that they have
hereby received their just and proper share and have no more claim or demand against
each other in connection with the adjudication of the above-described parcel of land.

ACKNOWLEDGMENT
BEFORE ME, a notary public for and in Cebu City, Philippines, personally appeared
after exhibiting their Competent Evidence of Identity:
the above-mentioned persons are known to me as the same persons who executed the
foregoing instrument and that they acknowledged to me that the same is their free act
and voluntary deed and that this instrument consists of five (3) pages of which all the
parties have signed every page with their material witnesses.
