Compromise Agreement

This compromise agreement is between Resheil B. Awe and Jonathan Sr. C. Awe to settle a criminal case filed by Resheil against Jonathan for violation of domestic abuse laws. COMPROMISE AGREEMENT

This Agreement is entered into by the parties voluntarily, freely and without
coercion on either of the contracting parties. This Agreement is executed this
_______________________________ at the Municipality of Bansalan, Davao del
Sur, by and between:

RESHEIL B. AWE, Filipino, of legal age, married, and a resident of


Marber, Bansalan, Davao del Sur, herein, referred to as the First Party.

-and-

JONATHAN SR. C. AWE, Filipino, of legal age, married and a resident of


Marber, Bansalan, Davao del Sur, herein, referred to as the Second Party.

WITNESSETH

WHEREAS, the first party has filed a criminal complaint for the
VIOLATION OF SEC. 5(i) OF THE REPUBLIC ACT 9262, docketed as CRIM.
CASE NO. XXI-2210(17)FC (NPS-XI-04-INV-17F-00165), pending before the
Honorable Regional Trial Court Branch 21, Bansalan, Davao del Sur;

WHEREAS, the both parties are married to each other.

WHEREAS, the Second Party has already posted a Bail Bond for his
Provisional Release in the amount of TWELVE THOUSAND PESOS (PHP. 12,
000.00).

WHEREAS, the First Party has already signed and executed an Affidavit of
Desistance under the faith of Honorable Prosecutor
__________________________.

WHEREAS, the both parties willingly agreed to settle the case amicably.

NOW THEREFORE, in consideration of the foregoing premises, both


parties agreed to abide by the following TERMS and CONDITIONS:

1. That the custody of their Three (3) Children shall be on the First Party.

2. That the time that the posted bail of the Second Party in the amount of
TWELVE THOUSAND PESOS (PHP. 12, 000.00) be released, it shall
be given to the First Party.

3. That the Second Party shall give financial support to the First Party in the
amount of THREE THOUSAND PESOS (PHP. 3,000.00) every month.

4. That the Second Party shall no longer go near to the First Party and no
longer harass or do any form of abuse to the First Party and to their
children.

5. That Failure to comply on the aforesaid provision may result to re-open


the case.

That both parties understood the Terms and Conditions stated above and
voluntarily affixed their signature below as an act of good faith in consummating
this Compromise Agreement.
