New York Marijuana

The legalization of marijuana in New York has been an ongoing process for decades. Since there
had been many arrests before, the mayor of New York city proposed issuing fines instead of
arresting those in possession of weed. Another major purpose of the bill is to put an end to racial
injustice in communities. People in color suffered more from using weed than white people. In
2014, Andrew Cuomo, the governor of NY, signed a bill granting permission to use marijuana
for medical purposes. The new law allows doctors to treat their patients employing different
methods. These methods provide consuming weed with non-smoking programs. Five private
cannabis growers signed a contract that permits them to work with four dispensaries.

Recreational Cannabis
In 2014, Cuomo legalized only the medical use of cannabis. From 2018-2021, legislators have
fought for the legalization of recreational marijuana. Finally, on March 30 of 2021, the Senate
and New York State Assembly voted for the bill to pass. After the legalization of recreational
cannabis, New Yorkers can own up to three ounces of recreational weed. Besides, the law
permits them to own 24 grams of concentrated marijuana, too. For example, you can have oils
derived from the plants of marijuana. However, you can start the sales of recreational weed
around April of 2022. It might take around 2 years to start the legal sale of recreational cannabis
too.

Use of Weed

People at the age of 21 and above have the legal right to smoke, consume, or use cannabis.
Wherever smoking cigarettes is not banned, people can smoke weed in those areas, too.
Meanwhile, you have no right to use weed at schools, in cars, in offices, and in workplaces. The
University of Syracuse is against the consumption, use, and smoking of cannabis on campus.
This rule applies to the use of medical marijuana within the campus, as well.

As you see, the consumption of marijuana is not always good for your health. Be careful and

New York Cannabis Laws


New York State, as I stated, legalized the use of cannabis. However, there are some laws and
regulations relating to growing weed.

their houses. They also have permission to sell marijuana to adults. Those, who want to grow or
keep weed at home, have to make sure they store it in a safe and secure place. You can store up
to five ounces of cannabis at your place. Meanwhile, this part of the law gets into effect after
someone first time sells the first recreational marijuana legally.

Cities have the right to forbid the sale of cannabis, but districts can't. They have no authority to
ban the sale of weed.

New Yorkers, however, can't grow marijuana plants for recreational purposes. They can grow
three mature and three immature cannabis plants in a household. Similarly, houses with multiple
residents can grow double the quantity, which means six mature and the same number of
immature plants.

What concerns driving, it is not legal to drive under the influence of weed. If the police stop your
car and smell burned weed, they have the right to assume that you are under the influence.
However, they are limited to searching only those areas wherever the driver can reach. For
instance, the police have no right to search the trunk of the car, as it is not reachable to the driver
at the moment of driving.

The lawmakers decided to drop the charges from those, who were affected or charged due to the
use of weed. There are certain groups that were affected the most:

● people with color


● women
● disabled veterans.

Application Process for Medical Marijuana Card


There are two ways to apply for a medical marijuana card:
1. Online
2. Offline.

You should keep in mind that for application, you need to:

● Be at least 18 years of age,


● Be NY resident with valid residency or proof that you are being treated in NY for the
condition you are applying the marijuana card for,
● Have been diagnosed with one of the qualifying conditions (e.g. autism, cancer,
Alzheimer’s disease, epilepsy, HIV/AIDS, multiple sclerosis, muscular dystrophy,
Parkinson’s disease, rheumatoid arthritis, spinal cord injury with spasticity, etc.),
● Have a doctor certifying your qualifying condition.

If you have all of the above, then you need the following:

● Certification form from your doctor,


● Fee,
● New York State Driver's License ID number or New York State Non-Driver ID Card,
● Information from the assigned caregiver and his/her card fee if any.

Another way to apply for a medical cannabis card is by contacting a telemedicine provider. They
will connect you with a licensed doctor who will provide you with a certification and
instructions. This is for being able to receive a medical marijuana card in case you are qualified.

If you are wondering how to get a doctor to certify your condition, then here is the answer. You
should book an appointment with a licensed doctor for a consultation. After the doctor’s
approval, you will receive a patient ID. Afterward, you should use that number for the
registration in the New York State Department of Health and complete your application online.
Then do the above-mentioned steps. Those who received medical cannabis ID, have to recertify
it each year by a licensed doctor.

Marijuana regulations in dispensaries

Since the legalization of weed has been very recent, the State does not permit dispensaries to
start supplying weed yet. They are limited to selling some sorts of cannabis, such as whole
flowers. It is a long process for NY to start the whole manner of granting licenses to dispensaries,
doctors, and practitioners. However, municipality areas have the right to ban dispensaries from
supplying weed. They can do this only till the end of 2021 to pass such a law. The good news is
that deliveries of weed will be allowed. This means that municipalities won’t be able to ban
dispensaries from owning weed through delivery services. An important note to consider is that
you can't use nor sell marijuana within dispensaries.
