JUDICIAL AFFIDAVIT
OF WITNESS

PRELIMINARY STATEMENT

I, Enteng Barbell, Filipino, of legal age, with address at #11


Dalanginan Dr., Makati City, after having been sworn in accordance
with law, hereby execute this Judicial Affidavit, in Question and
Answer form, and hereby answer the following questions below in
support of the claims and allegations of Peitioner Corazon Bosco, in
Civil Case No. 45 for Damages pending before Branch 139 Regional
Trial Court, Makati City. Consciously knowing that I am under oath,
and with understanding that I may face criminal liability for false
testimony or perjury, I hereby answer the following questions from
Atty. Maria Labo with office address at 1, Yuchengco Tower, #6819
GF, RCBC PLAZA Ayala Ave, Makati, Metro Manila, who conducted
this examination in her office.

JUDICIAL AFFIDAVIT PROPER

1. Q: Do you swear to tell the truth and nothing but the truth?

A: Yes, I do.

2. Q: Are you aware that you may face criminal liability for false
testimony of perjury if you will not tell the truth?

A: Yes, I am.

3. Q: Please state your name, age and other personal


circumstances.

A: I am Enteng Barbell, of legal age, married, and with


address at 11 Dalanginan Dr., Makati City.
4. Q: Where are you currently working and for what position?

A: I am the incumbent Brgy. Chairman of Dalanginan, Makati


City.

5. Why are you present here today?

A: I am here today to execute my Judicial Affidavit in relation


to the Petition for Declaration Damages filed by Corazon Bosco.

6. Q: Do you the know the Petitioner in the instant case?

A: Yes.

7. Q: How do you know the Petitioner?

A: The petitioner went to us asking for help. She wanted to


settle with the respondent regarding the accident which the
respondent and the petitioner is involved.

8. Do you know the Respondent in the instant case?

A: Yes.

9. Q: How do you know the Respondent?

A: The respondent is a resident of the barangay where I am


the Brgy. Chairman.

10. Q: When did the petitioner went to you and ask for help?

A: On September 2, 2021 at 2pm.

11. Q: What was the reason of the petitioner?

A: Mrs. Bosco asked for my help to finally reach an amicable


settle with Mr. Lobo because of the accident.

12. Q: Did you go to the respondent’s residence on the same


day?

A: Yes.

13. Q: Did you go alone with the petitioner?

A: No. We went together with SPO1 VICENCIO TECSON.


There are three of us.

14. Q: What happened at the time you three went to Mr. Lobo’s
residence?
A: We knock on his gate and saw him cleaning his house
and garden. We ask for his cooperation and talk about the
incident where his company is involved.

15. Q: What did the Respondent tell you, if any?

A: He agreed to talk and let us inside his residence.

16. Can you tell us how the settlement went, was it agreed by both
parties?

A: No. First, he offered us water as he frequently drinking


water.

17. Q: What happened during that moment?

A: We ask Mrs. Bosco about her intention to settle and told


Mr. Lobo that maybe it can be settle but he refused.

18. Q: What did the respondent say?

A: The price for the settlement was not met that’s why he
refuse.

19. Q: What happened thereafter?

A: Mrs. Bosco calmly insist to settle so that they won’t have


to go court anymore. She added that, she doesn’t want to
remember the incident and that she is grieving for the loss of
her husband. That’s why she wanted to settle. However, it was
interrupted.

20. Q: Why was it interrupted?

A: Mr. Lobo was having a hard time breathing and he


frequently coughing. A medicine was also given to him by his
wife.

21. What happened next?

A: We decided to postpone conversation regarding


settlement to make LEONARDO rest because he was starting
to look pale.

22. Q: What happened after the party failed to settle?

A: Mrs. Bosco said that she will just continue to file a case.

23. Q: What was the respondent’s response, if any?


A: We were not able to tell him since he appears suffering
from an illness.

24. Q: What happened after?

A: We left and went back to the barangay. Mrs. Bosco went


home after we talk.

25. Q: Can you tell us the time when the petitioner went home?

A: It was already 6 in the evening.

26. Q: For what purpose are you executing this Judicial


Affidavit?

A: I am executing this statement as part of my testimony in


the above entitled case.

27. Q: Mr. Witness, is there anything else you wish to add?

A: None, Ma’am.

IN WITNESS WHEREOF, I have hereunto affixed my signature


this September 27, 2021 at Makati City.
