NOTICE TO PROCEED

Please be notified that this shall signify the start for the Supply and Installation of Medical Gas Bid Package for the above-
mentioned project in accordance with the plans and specifications prepared by Archion Architects and Meinhardt
Philippines, Inc. and other requirements of the bid documents subject to the following terms and conditions:
1. The Total Contract Amount in Pesos: Nineteen Million & 00/100 (Php19,000,000.00), inclusive of taxes.
2. Ten percent (10%) down payment in the amount of One Million Nine Hundred Thousand & 00/100 (Php1,900,00.00)
shall be released upon submission of proof of the acquired necessary bonds and insurances (Guarantee Repayment
Bond (10%), Performance Bond (30%), and Personnel Accident Insurance or (GPA) Group Personal Accident
Insurance). The outstanding balance shall be paid under a progress billing scheme, which shall consider a ten percent
(10%) retention of the Contract Amount and a pro – rate reduction on the down payment.
3. The CONTRACTOR, prior to the start of the said Works, shall secure the following bonds and insurances from the
Approved List of Insurers. Thereafter, Contractor shall ensure the same bonds and insurances remain in full force and
effect throughout the duration of the contract. All bonds shall be “callable on demand”.
a. Guarantee Repayment Bond (DP):10% of the Total Contract Price
b. Performance Bond : 30% of the Total Contract price
c. Warranty Bond (Retention) : 10% of the Contract Price
d. Contractor‟s All-Risk Insurance (CARI): shall be procured by Owner. Contractor must report to the
Owner and the Insurer any loss or damage within 14 calendar days from the incident. Processing of
claim will be the responsibility of Contractor. In the event the insurer denies the claim, any losses,
third-party claims and/or resulting damages shall be for the account of the Contractor. Addressing
related investigations and negotiations with the Insurer, Brokers, Adjusters and/or third-party
claimants shall be the primary responsibility of the Contractor.
e. Personnel Accident Insurance or (GPA) Group Personal Accident Insurance of minimum Php250,000.00
coverage per person.

f. Ten (10%) retention shall be released upon acceptance and submission of Warranty Bond and Turn Over
Documents.
5. System warranty shall be Ten (10) years and Two (2) years for Workmanship and Equipment upon signing of
Certificate of Acceptance by the OWNER.
6. The OWNER shall have the right to impose to the CONTRACTOR a Liquidated Damages equivalent to one tenth of one
percent (1/10 of 1%) of the Contract Amount for each and every calendar day of delay (Sundays and legal holidays
included), not to exceed an amount equivalent to ten percent (10%) of the Contract Price. Start of Liquidated Damages
shall be applied starting the day after the January 31, 2023 completion. For purposes of calculating the actual date of
completion date shall be the date certified by Archion Architects and the CONSTRUCTION
MANAGER/CONSULTANT.

8. No claims for change order variation unless ordered in writing by the owner. The value of work shall be agreed upon
prior to implementation.
9. The Contractor hereby agrees that this particular project will not be subjected to any labor and material price escalation.

10. The CONTRACTOR agrees and binds itself to indemnify and hold THE OWNER free and harmless against any and all
losses, cost, damages and expenses arising out of any claim or cause of action in respect of any injury, sickness, disease
or death of any person or loss or damage to any property or business suffered by reason of the failure, negligence, delay
or conduct on the part of CONTRACTOR and or its employees in the performance of its obligations hereunder arising
out of or in connection with the performance of this agreement and shall, at its own cost defend THE OWNER in any
proceedings involving the same where such injury, sickness, disease, death, loss or damage is caused or contributed
to by the fault or negligence of CONTRACTOR and/or its employees.
11. The OWNER shall have the right to terminate this Contract at any stage of The Works without any costs or penalties. In
the event of termination, the CONTRACTOR shall be entitled to receive equitable payments based on the
CONTRACTORS work done. The term equitable payment shall mean an aggregate amount, as computed in accordance
with the measurement/ survey made and certified by CONSTRUCTION MANAGEMENT/CONSULTANT using „bills of
quantities‟ rate and prices.
The CONTRACTOR shall also be entitled to the costs of demobilization which is included on the contract price. No
other claims or compensation shall be made by the CONTRACTOR except those mentioned in this Contract.
The computed equitable payment and the costs of demobilization shall be set-off against the down payment made by
the OWNER to the CONTRACTOR. In case the amount of the down payment is in excess of the aggregate claimable
amount by the CONTRACTOR based on this Contract, the excess amount shall be reimbursed to the OWNER by the
CONTRACTOR, within 30 calendar days from the date of Termination.
