1.0 Preamble: Cadastral Survey in simple term is the survey of individual property
which eventually leads to the production of plans which could be used for the
registration of title documents and other purposes like planning, designing, e.t.c.

Nearly all known Registered Surveyors are engaged in Cadastral Survey


practice. It is the most practiced type of survey through which the general public
knows one as a Surveyor. There is therefore the need to periodically provide
guidelines for its practice (as occasion demand) so as to create sanity in the
practice of the profession. There is no doubt that the Surveyors are in close
contact with the general public through the cadastral aspect.

1.1 Survey Fee: There is no gain saying that Surveyors are the most poorly
remunerated Professionals in the construction industry considering the risk,
rigor, labour and cost of equipment; while the fees of other Professionals are
based on the percentage of the construction cost or value of property, but that of
the Surveyor is rarely considered as such.

1.2 Quarterly Pillar Number Allocation


1.2.1 Regular Allocation: A Resident Surveyor is entitled to collect a specific
beacon numbers per quarter while Non Resident Surveyor is entitled to collect a
specific beacon numbers per quarter, or as may be determined from time to by
the General House of the Practitioners.

1.2.2 Special Allocation


Special beacon numbers shall be allocated for any survey requiring 20 beacons
or more. The survey must fulfill certain criteria as may be required by NIS, the
SSEC, and the Office of the Surveyor General.

However the Resident Surveyor can waive this and use his/her regular numbers
as special.

Non Resident Surveyor is entitled to allocation of special beacon numbers once


per quarter while Resident Surveyor is entitled to Five (5) special jobs in a
quarter, the returns of which must be made before another allocation. The
entitlement is not transferable to another quarter.

2.0 Mandatory Payment Scheme (MPS): Mandatory Payment Scheme has


actually helped in stabilizing the scale of fees to some extent and is yielding
some benefits. As a result of the increase in the cost of surveying equipment
(foreign currency) and the attendant effects on economy, the SSEC and the
Nigerian Institution of Surveyors of Oyo State Branch hereby review the
payment scheme of some aspects of surveying practice in the State.

2.1 Perimeter Survey: The computed survey fee and the corresponding mandatory
payment are shown in the schedule of payment marked Schedule-A.

2.2 Change of Title: Change of title can only be carried out by the Surveyor who
did the job originally and no change of title should be endorsed by Surveyor
without visiting the site (because sometimes the property might need a total re-
survey, fixing of details etc). Henceforth, the fee of the change of title shall be
same as for perimeter survey, or 10% of the cost of the property. However,
when the cost of the property is very high Surveyor is at liberty to negotiate the
fee. Mandatory Payment for any title change shall be 75% of payable MPS as
shown in the schedule of payment of appropriate categories.
In addition to the above, Surveyors should request for the agreement of transfer
of title and keep same for future reference.

2.3 Plan Revalidation: Survey plan prepared for over 10 years should be
revalidated or updated. The fee shall be the same as obtain in change of title and
50% mandatory deposit.

2.4 Site Inspection: Site inspection should attract a minimum fee of N10,000.00
(Ten Thousand naira). This depends on the site to be visited. Sometimes a
Surveyor would have to spend a whole day on site-visit or inspection and the
job might not be given to him at last. This fee should be paid before the
Surveyor leaves the office for inspection.

2.5 Detail Survey: The Surveyor shall charge 60% of the minimum survey fee.

2.6 As-Built Survey: This is developed property. The survey plan is sometimes
needed for mortgages, securities etc. some allied professionals make lots of
money on such transaction in terms of percentages. The cost shall not be less
than 150% of minimum survey fee.

2.7 Court Appearance Fee:


A Surveyor shall appear in corporate attire at the court of law as expert witness
This shall be charged as follows;
(a) Individuals
(i) Minimum rate of N30,000 for appearance within the town where the
Surveyor resides.
(ii) Minimum rate of N50,000 for appearance outside the town where the
Surveyor resides, plus cost of transportation and accommodation.

(b) Corporate Bodies


(i) Minimum rate of N75,000 for appearance within the town where the
Surveyor resides.
(ii) Minimum rate of N125,000 for Corporate organizations (transport and
accommodation inclusive) if outside town of residence of the Surveyor.

2.8 Extra Prints:


10% of the mandatory payment of the survey job but must not be less than
N10,000.00 per copy.

Minimum of N12,500.00 per copy for cloth print of foolscap size. Once the size
is more than fullscap sizes, the surveyor should prorate the charges.

2.9 Re-Establishment of Beacons: Many Surveyors see this aspect of survey work
as an operation without any added value because no new plan is usually
required to be produced. Surveyors don’t attach value to the work involved
whereas in the actual sense, it is more cumbersome, energy, and time
consuming. Cost of re-establishment should be a ratio of the No. of missing
beacons to the whole perimeter beacons in relation to the cost of the perimeter
survey i.e.

2.10 Commercial Title survey: This includes survey for Organization such as
Corporation, Worship Centers, Institutions, Companies, And Firms e.t.c.
excluding family land, joint Individual owners, and even township possession.

2.11 Prime Area: These are land within designated Towns or Urban area of the state
mentioned in delineation of Prime Area below. The survey fees chargeable and
the corresponding mandatory deposits are as shown in Schedule-B. The Towns
are delineated below.

2.12 Special Prime Area: These are land within highly urbanized area of the state
mentioned in delineation of Special Prime Area below. The Survey fees
chargeable and the corresponding mandatory deposits are as shown in
Schedule-C. The Towns are delineated below.

3.1 All the above fees exclude the statutory payments for beacon numbers.

3.2 Effective date is 1st July 2016.

1. Once the number of plot is more than Twenty (20), additional charges of N100,000:00 per

MODE OF PRACTICE IN OYO STATE
i. Surveyors practicing in Oyo State are to submit two passport photographs to the
NIS Secretariat for identification when registering to practice in the State.

ii. All Surveyors practicing in Oyo State must submit evidence of payment of the
following:
a. SURCON practicing fee
b. NIS National annual fee.
c. NIS State annual due on or before the last working day of the first month
of the year

iii. Beacon numbers are not to be collected by proxy except for:


a. Surveyors who are 65 years of age and above
b. Those incapacitated with acceptable evidence
c. Fellows of the Institution

iv. A proxy must be: A person whose credentials have been submitted and accepted
by the NIS/SSEC Secretariat. The person must carry the employers’ office I.D.
card.

v. Quarterly quota of beacon numbers for the use of Resident Surveyor practicing
in Oyo State shall be One hundred beacon numbers.

vi. Quarterly quota of beacon numbers for the use of the Non Resident Surveyor
practicing in Oyo State shall be Twenty (20).

vii. Each Non-Resident Surveyor is allowed the use of special numbers for special
jobs once in a quarter (special jobs are jobs which require a minimum of
Twenty (20) beacon numbers).

viii. Beacon numbers not used within a quarter are not transferable to another
quarter.

ix. Beacon numbers are to be requested for after necessary payments had been
made at designated banks by the Surveyor. Cash payment at the Secretariat is
not allowable.

x. All request for special beacon numbers by Surveyors practicing in Oyo State
must include acceptable evidence of the job, The Chairman NIS & Chairman,
SSEC State Ethics Committee are at liberty to inspect the site before requests
are approved.

xi. Request for beacon numbers must be endorsed by either Chairman of SURCON
State Ethics Committee (SSEC) or Chairman NIS State branch before issuance
could be made.

xii. Any surveyor intending to practice in Oyo State shall make his intention known
in writing to :-
a. The Chairman SURCON State Ethics Committee
b. The Chairman Nigerian Institution of Surveyors Oyo State branch.
Such intending Surveyor shall meet with the NIS Ethics Committee (Oyo) and
must satisfy the conditions for practice before the commencement of practice in
the State.

CONDITIONS FOR RESIDENCY


i. The Surveyor must have been a financial and active member of Oyo State
Branch of NIS for at least two years
ii. The Surveyor must have a functional office in the State.
iii. The Surveyor must also have at least sixty percent (60%) attendance at all the
State Branch activities/functions/meetings every year.
iv. For any Surveyor transferring residency to Oyo from other states, he must
present evidence of his activities from the State Branch, signed by the
Chairman.
v. The Surveyor must satisfy the guidelines of the Local Chapter of APPSN.

CONDITIONS FOR NON-RESIDENCY


i. The Surveyor must have been a financial member of his state of residency for at
least a period of three years.
ii. He or she must present a letter of recommendation from the state branch signed
by the Chairman (NIS).
iii. Any Surveyor intending to practice in Oyo State must have ethically practiced
in his/her state of residency for a period of not less than two years.
iv. The surveyor must satisfy the APPSN State Chapter condition.

Lodgment of Record Tracings.


1. This guidelines frowns at late submission of record tracings by both Resident
and Non-Resident Surveyors and therefore suggest that prompt lodgment of
records tracing be made.
2. The quarterly submission of Record tracing Vis-a-Vis the requests for the
beacon numbers must be pasted at the State’s NIS Secretariat.
3. Requests for beacon numbers shall not be accommodated unless about 30% of
record tracings of plans produced at the previous quarter are dully lodged.

RECOMMENDATIONS OF THE COMMITTEE
The followings were the recommendations of the Committee:
1. That the scale of fees / cadastral policy should be kept under review every two
years, and most importantly the delineation of Prime and Special Prime required
collaborated efforts of Surveyors from different part of the State, because it is
difficult for one to be well familiar with all the areas of the State.

2. That the pillar number allocation be reviewed downward for the first two
quarter of the implementation of this new scale. The Committee was of the
opinion that pillar number for the Resident Surveyors be reviewed to eighty (80)
and that of Non-Resident Surveyors be reviewed to sixteen (16).
The Committee was of the opinion that rationing of pillar numbers took its
source from simple theorem of Demand and Supply, which must be put into use
at this juncture for both efficient and effective implementation of the new scale.
