letter dated November 4, 2019 of M r s . Analiza B . Lagura,
Chairperson/President o f the Awao Farmers a n d C o m m u n i t y Savings
Association (AFACSA), Awao, Monkayo, Compostela Valley, addressed t o
the Municipal Mayor through M r . Geronimo O. Balana, MPDO, r e
requesting for t h e reclassification of a P A R C E L O F L A N D D E S C R I B E D

W H E R E A S , a n i n t e n s e p e r u s a l w a s c o n d u c t e d b y t h e Office o f t h e
M u n i c i p a l P l a n n i n g a n d D e v e l o p m e n t Officer ( M P D O ) w h i c h s u b m i t t e d a
positive review of the said reclassification;

W H E R E A S , t h e Office o f t h e M u n i c i p a l A g r i c u l t u r i s t also i s s u e d a
certification dated N o v e m b e r 1 1 , 2 0 1 9 w h i c h certifies t h a t t h e properties
applied for are outside t h e n e t w o r k of protected areas for agricultural
a n d a g r o - i n d u s t r i a l d e v e l o p m e n t o f t h e m u n i c i p a l i t y , c a n be eligible for
reclassification f r o m agricultural to residential purposes i n conformity
w i t h existing laws a n d zoning ordinances w h i c h determines greater
economic value for residential a n d other purposes, thus interposing n o
objection o n t h e same;

W H E R E A S , as Public Hearing w a s duly conducted o n this proposal


on October 15,2 0 1 9 with t h e members of t h eAssociation, stakeholders
a n d other residents of Barangay A w a o t o w h e r e this lot is located, t h e
S a n g g u n i a n g B a r a n g a y o f A w a o t h r o u g h i t s R e s o l u t i o n No. 3 8 , series-
2 0 1 9 likewise did n o tinterpose objection;

WHEREAS, t h e Local Government Code of 1 9 9 1 a n d its


Implementing Rules a n d Regulations provides t h e powers, duties a n d
responsibilities of the Sangguniang Bayan, a m o n g others :

a) G e n e r a t e a n d m a x i m i z e t h e u s e o f r e s o u r c e s a n d r e v e n u e s o f t h e
area
b) R e c l a s s i f y a g r i c u l t u r a l lands within the jurisdiction of the
municipality subject to Rule V I I of t h e Local Government Code;

W H E R E A S , Section 2 0 o f R A 7 1 6 0 "Reclassification of Lands"


- (a) A c i t y o r m u n i c i p a l i t y m a y , t h r o u g h a n o r d i n a n c e p a s s e d b y t h e
s a n g g u n i a n after conducting Public Hearings for t h e purpose, authorize
the reclassification of agricultural lands a n d provide for t h e m a n n e r of
t h e i r u t i l i z a t i o n a n d d i s p o s i t i o n i n t h e f o l l o w i n g c a s e s : (1) w h e n t h e l a n d
ceases t o be economically feasible a n d s o u n d for a g r i c u l t u r e purposes a s
d e t e r m i n e d b y t h e D e p a r t m e n t o f A g r i c u l t u r e ( D A ) (2) w h e r e t h e l a n d
shall have substantially greater economic value for residential,
commercial or industrial purposes as determined by the sanggunian
concerned: provided, that such reclassification shall be limited to a
percentage of t h e total agricultural land area at t h e time of t h e passage
of the ordinance".

W H E R E A S , t h e subject area for reclassification meets all the


provisions of Rule VII of theI R Rof R A 7160;
