LEGAL NOTICE
We upon specific instruction and direction of our valuable client
Mr/Mrs. Backiyam.O wife of late Otchanan, Hindu aged
about…..years residing at No: 18, Perumal Nagar, Keelamuthupatti,
Palanganatham, Madurai District, Tamil Nadu – 625 003. (herein after
referred to as “our Client”), serve upon you instant Legal Notice to the
following causes;
1. My client states that her demised husband M.Otchanan was
passed away as on 07.06.2022. Through their wed lock they got
three children’s and all of them possess inheritance over the
ancestral property of late M.Otchanan.
2. My client states that her deceased husband M.Otchanan was the
2nd son of the late Mayathevar and Nallamal.
3. My client also states that belatedly 20 years before she was
residing in the ancestral property with her husband and
children. But still reiterates that all celebrations and festivals
will be held in the ancestral property as joint family.
4. My client also states that amid enquiring about her position and
share towards her husband ancestral property under Hindu
Succession Act 2005. You willfully failed to reply, intentionally
encumber her enjoyment and also acted with malicious intent to
disturb her peace and harmony possession.
5. My client states that while seeking for her and children rights
over the ancestral property share. You disclosed a false
document bearing no: 3536/1992 & 6822/1992 by stating that
the sale deed was over and the share towards the ancestral
property was executed in favour of you by her husband. While at
the time of such sale deed the absolute owner of the property
was alive who is the father of you and Otchanan.
6. My client also states that while her husband presence you never
disclosed such affirmative statements over the ancestral
property. The deceased husband was never furnished or
disclosed such statements to her yet before pertinent to the
supra.
7. My client state that no partition over the property for legal heirs
was executed still now. At this situation such false documents
show your willful evil intention to obtain their share over the
ancestral property.
8. My client also states that the property in which you are residing
are the Joi property and all the legal heirs of deceased
Mayathevar and Nallammal possess right of enjoyment and
share over the house property. But you with malicious intent not
allowing or permitting legal heirs possession and right of living.
9. My clients states that one of her son O.Jeyapandi who is said to
be the legal heir of her deceased husband made a representation
to the Panchayat Chairman not to render the house property tax
in favour of you as you were in undue possession over the supra
property and also reiterated that you made partition without
their knowledge as on 05.12.2022.
10. My client state that the document was obtained by you
through the undue influence and coercion without their
knowledge.
11. Our client also states that she was suspicious over the
document legality and validity.
12. My client states that she puts into mental agony,
frustration and depression through the execution of such false
documents.
I, therefore, call upon you through this legal notice to inform our client
regarding their shares over the ancestral property, your obstruction
over their right of possession and enjoyment on their property share
was against to law, without partitioning such sale deed was “void ab
initio”, the supra house property belongs to all the legal heirs, your
undue influence over such property is legally unfit, in order to show
your transparency and fairness over the ancestral property reply
within the period of 15 days from the date of the receipt of this notice
failing which my client has given clear instructions to file Civil,
Criminal and other Misc. proceedings against you in the competent
court of law and in that event you shall be fully responsible for all
costs, risks and consequences thereof.

A copy of this legal notice is retained in my office for further necessary


action.
