Obligations and Contracts

Assignment No. 1

a.) Give five (5) examples of obligations based on Law


1. Mr. Santos bet the lottery regularly in hopes of winning a big amount of money. Luckily,
one day he won the lottery and as a winner of almost a 100 million pesos he had an
obligation to pay taxes.
2. Aira is a student of San Antonio De Padua College, a private school. So she is obliged to
pay her tuition fee monthly. But suddenly during the month of August she wasn't able to
pay the tuition right away. So she write a promissory note stating that
She will surely pay the tuition fee the following month.
3. Brian has been an online buyer since 2020 and he likes to purchase clothes on Online
Shopping platforms. One day he decided to purchase a tee from a shop named Urban
Clothing. So the shop receives the order right away and makes sure that it will be
delivered to the buyer. On the other hand, the buyer has an obligation also to pay for
what he has received.
4. James is a reckless driver but as a resident of the Philippines he had an obligation not to
exceed his speed to 80kph when driving.
5. Ms. Marissa purchased a washing machine and is expecting to deliver it properly. So the
delivery boy is obliged to take care of the equipment so that it will not be damaged.

b) Give five (5) examples of obligations based on Contracts.


1. John sells his car to Andy. So John is obliged to to transfer the ownership of it to Andy,
while Andy has an obligation also to pay for the car.
2. Leni purchased a loan from a Bank. So the lender and the borrower had a loan
agreement which regulates the mutual promise for both parties.The lender agreeing to
provide a loan and the borrower is obliged to repay the money including the interest.
3. When we apply for College enrollment, the registrar's office gets all our information
including personal one's with our permission. So as an officer they are obliged to keep
that information with utmost confidentiality.
4. Mr. Ramon and Mr. Ching, a contractor, agreed together on a contract wherein the
contractor must finish his house for a period of 1 year. The contractor must pay all the
expenses while building the house but when it is fully furnished it is Mr. Ramon's
obligation to pay for the exact amount stated in the contract.
5. The landlord created a lease agreement for her new tenant. The tenant signed the
agreement that he will pay the exact monthly rental fee in exchange for occupying the
space.

c) Give five (5) examples of moral obligations.


1. Mary is the adopted child of Gloria who is an old maiden. After a decade she found her
biological parents and decided to live with them. Then, one day Gloria gets sick and
therefore Mary is morally obliged to take care of her adoptive parent Gloria.
2. Jane and Ivan are lovers so both of them must not cheat with each other.
3. As a daughter, I am obliged to become honest and to tell everything that my parents
want to know more about me.
4. Sean saw the crime happened last night so it is his moral obligation to state all the facts
to help solve the crime.
5. Your best friend who's always there for you through ups and downs needs help for
financial matters. As a good friend you lend her money to help her solve her problem.

Essay. Explain your answer in at least five (5) sentences. (10 points
each)
a) In your own understanding, what are obligations? And what are
Contracts?
For me, Obligations and Contracts are different from one another yet they are connected to
each other. Obligations are the promises, or things we must do or accomplish in compliance to
the law. While a contract is a material that will prove an obligation or agreement signed by two
parties. Contracts are also helpful in every kind of industry whether it is business or not because
it makes each and every obligation clear and understandable. Knowing and understanding this
concept is also a big help in realizing what are the obligations in this society as a person.

b) What do you think will happen if a person would breach his legal and
contractual obligations?
-Breach of contract is the inability to fulfill the specifications of the contract by one party without
any legal reason. Those who are proven guilty of a breach of contract may not be imprisoned as
it is a civil case, and not a crime. They can, however, receive a complaint by the other party.
And must be held liable for all the damages. Lastly, the guilty party must also remedy the
breach.

c) If a person breaches his moral obligation, will there be any sanction?


In my own opinion, if a person breaches his moral obligation there are no legal sanctions but we
can apply moral sanctions. There are no legal sanctions for those who breach because they
didn't violate any law. But moral sanctions can be applied because a person violates moral
norms. For example, some countries legalized abortion for birth control measure. It is a legal act
yet it is immoral when we talk about ethics and morality.
