Dangerous Drugs Act of 2002 and its IRR.
1.2. PDEA MC 2021-009 re Guidelines in the Application,
Evaluation and Approval of PDEA Operational Plan
(OPLAN).

2. In connection with the above, submitted herewith is the application


for approval and funding of Operational Plan “Alpha” (Tab A).

III. SITUATION:

The subject person is IVAN RAY ROMARATE also known as @Bobong,


married, legal age and jobless, a native of Malaybalay City, Bukidnon. Based
on the information gathered from confidential informant and other law
enforcement agencies, the above-named personality is the main supplier of
illegal drugs in the said city.

Mostly, his peddlers were minors and they came from neighboring
municipalities and cities so that he can easily spread out his supplies of
illegal drugs particularly ‘shabu’ all throughout the province of Bukidnon. The
CI also divulged that he will not hesitate to sell illegal drugs in his area of
responsibility since he has “coddlers in the other operating Units in
Bukidnon”.

BACKGROUND:

That the above-named personality is engage in illegal drug activity in


the City of Malaybalay. He is the main source of illegal drugs in the said city
and other nearby municipalities.
Through the conduct of thorough validation, investigation and
intelligence operations, this office discovered that @BOBONG, IVAN RAY
ROMARATE was Target-Listed drug personality since July 2020. However,

last August 2020 elements of PDEA 10-Bukidnon Provincial Office conducted


a buy-bust operation against @bobong together with his cohorts but
unfortunately, he was able to elude arrest. Only his cohorts namely Alexander
Abarabar and Alberto Daigan were captured during that time.
Further, as per casing and surveillance conducted, the team found out
that his residence is located at Purok 4B, Aglayan, Malaybalay City,
Bukidnon. The CI also divulged that he was known to their place as ‘Alpha or
Asset’ since, if there were newly identified street level pusher who is
competing to him, he will directly report to it to the authorities that lead to their
positive operation. Sometimes he will be going to threatened small time
pushers if they will not agree to be one as his peddlers, if not, then he will
immediately report to the authorities.
Currently, the subject actively involved in selling Methamphetamine
Hydrochloride locally known as “Shabu” which his primary source of income.
Allegedly, he acquired his supply of shabu from Kalilangan, Lanao del sur.
Together with his wife, they are selling cookies and other home-made bake
goods, in which they use as a front for their illegal drug activity.
Moreover, @bobong right now is more active since KAAMULAN
FESTIVAL in Malaybalay City is approaching a month-long celebration in the
whole province of Bukidnon. The more tourist and visitors, the more users
hence, all the stores and night entertainments were open until early in the
morning.

OPERATIONAL CONDITIONS:

An Operational Plan is necessary in order to neutralize the subjects


of this operation because of the following reasons:

1. PDEA10 RSET, PDEA1O BUKIDNON P.O and PNP10 RIU


confirmed the validity of the illegal drug activity of the
subjects as Target-listed in the Target Listed Drug
Personalities and classified as high valued target (HVT)
Personality;
2. Being previously a target of an anti-illegal drug operation
which he was able to elude arrest, the subjects have become
wise and discreet in their illegal drug proliferation and strictly
sell drugs only to their trusted customers. Recruitment for an
Action Agent (AA) who can directly access the target is
needed with additional monetary incentives.
3. Operational support is necessary for the gas and meal
allowance and or possible renting of a house/ pad during
case build-up up to the actual negation operation and
additional funding for the conduct of Test-Buy operations;
4. A joint operation with other PDEA Provincial Offices and
other Law Enforcement Units as needed is recommended
during actual neutralization to prevent armed encounter.

Hence, additional mobility and other operational needs for


our agents is necessary;
5. And additional funding for buy-bust money in case a buy-
bust operation will be pushed through in lieu of Search
Warrant operation.

IV. MISSION:

1. To conduct of buy bust operation against the subject/s and his


cohorts and to identify other protectors.
2. To neutralize the subjects by arresting them and by seizing
their illegal drugs in order to lessen the supply of illegal drugs
circulating in Region 10 particularly in Malaybalay City and the
whole province of Bukidnon.

VI. ASSUMPTIONS:

A. Good weather condition conducive for implementation of Buy-


Bust/Search warrant operations.
B. Transportation requirements have been met before the
implementation of the OPLAN.
C. It is expected that this operation will last for 24 hours upon
actual implementation of the negation operation.

VII. RECOMMENDATIONS:

It is recommended that necessary coordination be made to local


police in Bukidnon PPO specifically Malaybalay City Police Station to avoid
mis-encounter with other law enforcement units. Security and safety must
be a main concern in the conduct of the operation for the safety of the
troops. In the conduct of the actual operation, division of troops is needed
to avoid compromise of operation and to neutralize all possible threats and
armed encounter.

Members from the Media, NPS representatives and elected local


officials shall be coordinated prior to the conduct of actual buy-bust/search
warrant operation in order to comply with the requirements of Section 21 of
R.A. 9165. Further, Covid 19 protocols must also be observed and strictly
followed for the safety of the operating team.

In addition, commendation will be given to all team members


signed by the Director General, PDEA.

Lastly, in view of the above, it is respectfully recommended that


the financial requirements for the implementation of OPLAN “ALPHA”
amounting to fifty thousand pesos (Php 50,000.00) be given to be used and
replenish our depleted Operational Funds.
